Sullins Dee Freeman Governor Director Secretary Mr. William Bolton, III July 2, 2009 Windlass II, LLC 591 Howell Mill Rd Waynesville, NC 28786 Subject: NOTICE OF INSPECTION 4206 Bridges Street Extension Permit No. SW8 991210 Carteret County Dear Mr. Bolton: On June 22, 2009, Angela Hammers of the Wilmington Regional Office of the Division of Water Quality (DWQ) inspected 4206 Bridges Street Extension in Carteret County to determine compliance with Stormwater Management Permit Number SW8 991210 issued on March 10, 2000. DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Submit a PE for the stormwater system to DWQ. It has been noted in the attached report that a letter stating that this property has been sold was received by DWQ. However, the response letter forwarded by DWQ denied the request for transfer because a PE had not been submitted and signatures of the new owner(s) were not submitted on the transfer request or the Operation & Maintenance Agreement. The transfer of ownership form may be found at the following weblink: ham://h2o.enr.state.nc.us/su/documents/SW PermitOwnership-NameChangeFormO80606.pdf Please inform this Office in writing before August 5. 2009, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by August 5, 2009 then DWQ staff will re-inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Per permit condition (III. General Conditions, #1.), if a desire to change ownership, a formal request accompanied by documentation by the parties involved and other supporting materials must be submitted to DWQ. Inspection Date: February 8, 2005 Weather Conditions: Warm & Dry (50's) 3. Compliance Issues: Y N ❑ ❑ The drainage area (including offsite) and built-upon area to the permitted system are per the approved plan. No unpermitted offsite drainage enters the system. ❑ ❑ All the built-upon area associated with the project is graded such that the runoff drains to the system. ❑ ❑ For ponds/infiltration, the outlet/bypass structure relative elevations are per the approved plan. (Must be verified via as-built survey if in question). ❑ ❑ The inlets and outlet structure are located per the approved plans and do not cause short-circuiting. Required Actions: (Explain each deficiency and what needs to be done to bring the system back into compliance) (a) The banks and slopes of the pond are extremely overgrown. The shrubbery and wild vegetation must be cut down to a manageable level. (b) The abundant amount of cat-tails around the edge of the pond, may cause a problem in the near future. The cat-tails in the fore-bay section of the pond need to be thinned out before spring. (c) The pond and surrounding wetlands are full of trash and debris. Please remove the trash and debris from these areas. (d) Upon completion of the above, please have the designer/ engineer certify the pond.
