Anderson, Director of Facility Planning New Hanover County Schools 1802 South 15th Street Wilmington, NC 28401 Subject: EXEMPTION from Stormwater Management Permit Regulations Stormwater Project No. SW8 990546 Williston Middle School Renovations Phase I Demolition New Hanover County Dear Mr. Anderson: The Wilmington Regional Office received a copy of the Sedimentation Erosion Conrtrol application for the project known as Williston Middle School Renovations Phase I . Staff of the Wilmington Regional Office have reviewed your application request for the applicability of the Stormwater Management rules to this project: Based on our review, you do not appear to be proposing development activities on this site at this point in time that would be subject to the stormwater requirements as provided for in 15A NCAC 2H.1000. However, be advised that other regulations will potentially apply to your proposed activities. In accordance with 15A NCAC 2B.0231 and Division policy, new or continued ditching activities after March 1, 1999, may be a violation of state wetland standards. Violation of these standards may result in the assessment of civil penalties and other requirements to bring the project into compliance without additional wetlands impacts. In addition to the wetland standards, if your project disturbs five acres or more and has a point source discharge of stormwater runoff then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. If at any time in the future, development of any part of this site is planned, as defined in NCAC 2H.1000, you must apply for and receive a Stormwater Management Permit. As you will note, Phase I consists of demolition only and less than one acre is disturbed. As such, we understand that we are exempt from the State stormwater requirements for Phase I. Phase 2 will consist of building and parking lot construction and the addition of a stormwater pond. We are in the process of completing the design for Phase 2 at this point. Construction will not begin on Phase 2 until a stormwater permit has been obtained from the State. The erosion control plan was initially submitted for both Phase I and 2. It was then determined that it was more advantageous to have separate plans for the contractors of each phase. We hope this clarifies and resolves the issue. The North Carolina Administrative Code requires any project that must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to apply for and receive a Stormwater Management Permit by the Division of Water Quality. Any construction.on the subject site,prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office. Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and supporting documentation, or a written response regarding the status of this project and the expected submittal date must be received in this Office no later than June 26, 1999. Failure to respond to this request may result in the initiation of enforcement action, and construction may experience a subsequent delay. Anderson, Director of Facility Planning 1802 South 15th Street Wilmington, NC 28401 Dear Mr. Anderson: This office has received a soil erosion and sedimentation control plan for the project listed below which was submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 1 13A- 57(4)) Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil erosion control plan prior to the commencement of said land-disturbing activity (NCGS 113A-54(d)(4)). The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan if the submitted plan is complete. Commencement or continuation of a land-disturbing activity under the jurisdiction of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act. We have performed a preliminary review of your submitted plan and have determined that additional information will be necessary before a final review can be completed. Enclosed is a checklist of items that must be submitted before we can complete the review orocess. Failure to provide the additional information may result in disapproval of your plan.
