The Division is hereby notifying you that permit SW8 99412 has been renewed on January 6, 2013, and shall be effective until October 21, 2022. Please attach this cover letter and new page 2 permit to your High Density Permit issued on October 21, 1999. The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and conditions of this state stormwater permit. The plans previously approved on October 21, 2022, in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995, remain in full force and effect. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame an additional 3 years. Accordingly, Stormwater Permit No. SW8 990412, which expired on October 21, 2009, is now in effect until October 21, 2012. The Division is returning the Renewal application and renewal fee that we received on October 27, 2009. Please resubmit the renewal application and fee at least 180 days prior to October 21, 2012. Please see attached photos. Based on this reinspection, I believe the following measures are necessary in order to bring the project into compliance: 1. A submerged and vegetated perimeter shelf is required in the main pond. This shelf should have a slope of 6:1 or less, and vegetation must be established and maintained as per the O&M Agreement. 2. Outlet swale does not have uniform 3:1 slope. This swale must be smoothed out to make the side slopes uniform. Swale must also be reseeded with grass or have grass sod installed in all bare areas. Also, please round out all sharp turns. 3. Pond and forebay need to be mucked out by approximately 1 ft. depth, as shown in diagram of O&M Agreement. 4. Eroded section of forebay berm must be filled in with dirt and riprap. 5. Forebay berm must be reseeded with grass or have grass sod installed in all bare areas. Also, I believe a Plan Revision is necessary. The plan should be revised to show the correct outlet swale design. The original design was not constructed. In other words, it was not built according to plans, and if not corrected soon,we will have to issue an NOV. I plan to put these items into an inspection report as soon as possible. In the meantime, please contact me to discuss if you have any questions. I already had a discussion with the person responsible for getting the work done at the site, Tim Williams of Frischkorn. It would be helpful if he had a revised plan to use, showing the new outlet swale design. This permit expires on October 21, 2009. Section .1003(h)of 15 A NCAC 2H .10W(the stormwater rules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at$505.00. If this is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should be completed and submitted along with your renewal application.
