Dear Mr. Couch:
The Wilmington Regional Office received the Stormwater Management Permit Application for D & M Apartments / Covil
Avenue on April 24, 1998, with final information on September 15, 1998. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Management Regulations set forth in Title 15A
NCAC 2H.1000. We are forwarding Permit No. SW8 980436 dated September 15, 1998, for the construction of D & M
Apartments / Covil Avenue.
This permit shall be effective from the date of issuance until September 15, 2008, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

construction, operation and maintenance of a detention pond in compliance with the provisions of 15A NCAC 2H .1000
(hereafter referred to as the "stormwater rules") and the approved stormwater management plans and specifications and
other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of
this permit.
This permit shall be effective from the date of issuance until September 15, 2008 and shall be subject to the following
specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this
pemut, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 522,284 square
feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.
4. The tract will be limited to the amount of built-upon area indicated on page 3 of this permit, and per approved
plans.

5. The runoff from all built-upon area on the project must be directed into the permitted stormwater control system.
The amount of offsite runoff into the pond cannot exceed the permitted amount as indicated in the calculations.
6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-
upon area.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that.other revisions to the project should require a modification to the
permit. .
8. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
IL SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended
use prior to the construction of any built-upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the ponds.
6. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.

7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
9. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall
be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion
of the property.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components
of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

Dear Ms. Lewis,
I am submitting to you a revised set of plans of the proposed Detention Pond
addressing the items you outlined in your letter to us dated August 19, 1998. Since we
received your letter we (CHJT, P.A. and NCDENR) have had a series of discussions
concerning the geometry of the pond surface and volume. Per the fax we received from you
on August 28, 1998 we feel that the current pond design is adequate and meets the required
water quality goals set by NCDENR. Thank you for considering the interpretation we
presented to you. In addition to the geometry issue that is addressed by review comment#4
are four more comments that we have addressed in the following manner.
1) We have added an antfsiphon tube to the drawdown tube. This will allow the siphon to be
broken without increasing the outflow as modeled during the water quality drawdown.
2) The entire pond perimeter pess the dam and inside the forebay) has an aquatic shelf as shown
on the detail sheet. The dam does not include an aquatic shelf because we do not encourage
plant growth along the dam in order to prevent degradation to the earthen slopes and core.
3) The pond's permanent pool dimensions are included on the detail sheet.
4) The required flow path has been achieved.
5) A trash rack has been added to the notched weir
Please consider this letter as certification with Engineer's Seal for the enclosed information.
Otherwise we look forward to obtaining a Stormwater Management Permit for this project.

Dear Jeanette:
I tried to Email you something on Tuesday, the 25th, but it came back as
undeliverable. I suppose that your new office location has upset the
system. I'll try again.
This is that 3:1 L:W ratio thing again. Ken Wrenn says that he has provided
additional surface area and volume. When I checked the file, 14,562 square
feet of additional surface area was provided, and 1,736 cubic feet of
additional volume was provided.
He said he could provide additional depth, and wanted to know how much.
I told him this was something out of the ordinary, and we didn't have hard
and fast numbers for him to provide. He seemed a little shocked that I
couldn't offer any specifics for him.
I'm inclined to trade off the additional area and volume for the reduced
flow path, in this case.

Dear Mr. Wrenn:
Thank you for your recent request regarding the requirement for a 3:1 length to width ratio in the
detention pond. You asked that this requirement be waived because you had provided excess surface area
and volume, due to City flood requirements. You stipulated that the pond, if constructed with the minimum
State requirements for surface area and volume, would meet the 3:1 L:W requirement.
After a considerable amount of discussion and studying, it has been determined that your request to
waive the 3:1 requirement can be granted due to the fact that the pond has been oversized. Approximately
33% additional surface area and 4% additional volume has been provided, above the minimums required.
Together, these overages provide sufficient justification to grant your request to waive the 3:1 LW ratio
requirement. The proposed pond inlets and outlet must be located at opposite ends of the pond (lengthwise),
with a forebay provided for each inlet in order to permit the project.

Dear Mr.Wrenn:
The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for Covil Avenue/D&M Apartments on June 18 and August 11, 1998. A
preliminary review of that information has determined that the application is not complete. The following
information i5 needed to continue the stormwater review:
1. The outlet details show a 1.5" hole drilled in the top of the 4" orifice pipe. This will
effectively make the 4" pipe act as the limiting factor instead of the 3.5" orifice specified. The
net effect will be to draw down the pond in less than 2 days. Please delete this 1.5" hole. The
plans given to me on June 18, 1998, had this 1.5" hole located above elevation 26, which was
fine because the permanent pool was at 24, and the storage elevation was at 25..
2. The revised calculation sheet again indicates that the aquatic shelf is placed "where practical".
This is not acceptable. The shelf is located under the permanent pool, so you do not lose any
required surface area by creating the shelf. Please revise the pond contours shown on drawing
SD3A to reflect a vegetated shelf around the entire pond perimeter.
3. Please place the detail drawing of the pond's permanent pool dimensions on the detail sheet.
4. The required 3:1 L:W ratio in the pond has still not been met. Additional storage is all well
and good, but it does not provide sufficient justification for having a 2.2:1 ratio. The ability
of the pond to settle the solids is contingent on providing a sufficiently long flow path, which
the State has set at 3:1. Please provide baffling, bulkheads or berms in the pond to create a
3:1 or longer flow path.
5. Please provide a trash rack for the overflow.weir at elevation 26. It doesn't do.much good to
have one only for the larger storms, when 90% of the rain events are 1" or smaller.

Engineering Report for Water Quality Considerations Utilizing the High_

Project location: Bordered on West side by Covil Ave., on North side by Darlington Ave. and on
the East side by CSX Railroad and Burnt Mill Business Park.

Cover characteristics: Sandy soils, several large borrow pits, mixed pine&hardwood forest

NARRATIVE OF STORMWATER TREATMENT AND MANAGEMENT
Introduction
The Covil Ave.Apartment Project is subject to certain watershed restrictions because the water
that leaves the site drains to surface waters that are being protected by NCDENR and the local
govemment. This project is categorized as"high density option"and is limited to 60% impervious area
with stormwater control. A wet detention pond will function as the water quality control necessary to
meet the State requirements. The wet detention pond is intended to function as designed forever. The
operation and maintenance of the Detention Pond Facility will forever be the legal responsibility of the
Owner and or Home Owners Association associated with the site. This requirement is legally upheld
by an Operation and Maintenance Agreement between the Owner and the NCDENR. The Operation
and Maintenance Agreement should be administered by a responsible party to ensure that the
objectives are met. As the Agreement dictates; routine maintenance of the Wet Detention Pond Facility
and the associated stormwater collection system should be performed to ensure continuous water
quality goals set by NCDENR. Following is a nanative of how the treatment and management goals
will be achieved.
A. Construction
Construction of the facility will conform to the Engineer's plans and specifications. All sediment that
collects in the basin during construction will be removed after the site is stabilized.
B. Basin Access
Access to the pond and forebay will be allowed for via two entry points. The parking lots will serve
as entryways to the basin. The forebay will be accessed through the space east of building 4. The
basin will be accessed through either of the aforementioned open spaces or the openspaee
between buildings 4&5. A 10'access easement measured from the top of bank of the basin will
be recorded and maintenance will be performedperiodically to ensure that access is provided as
intended.
C. Routine Maintenance
Refer to the"Operation and Maintenance Agreement"between the Owner and NCDENR.

Item I.) A 30 ft.vegetative filter•is not provided at the outlet because the basin is sized according to
the 90%TSS'removal chart
Item m.) A recordeddtainage easement for the basin with access to the nearest right-of-way will be
provided.
Item b.) A 3:1 length to width ratio could be obtained using the minimum required pond size.
However,we have provided additionatwater quality storage than required while creating a
length to width ration of approximately 2.2 to 1. See figure one of this report for an
explanation.

In permitting the wetland area on our site,our biologist/soils engineering company, ECS determined
that we should be able to classify our wetlands as isolated wetlands and the Corps of Engineer
consequently would have no jurisdiction. I am sending you a copy of the map and Notification of Non-
Jurisdictional Determination letter.

I am re-submitting to you an application and supporting documentation for the
permitting of a water quality detention basin for the proposed Covil Apartment complex in
Wilmington, N.C. Enclosed is an original Stormwater Management Permit Application Form
with Wet Detention Basin Supplement, a signed operation and maintenance agreement,
sealed supporting assumptions and calculations, a spreadsheet printout showing the required
min. 48 hr draw down of the water quality pool, two copies of a preliminary grading plan and
details and a narrative describing stormwater treatment and management for this facility.
Please consider this letter as certification with Engineer's Seal for the enclosed

NARRATIVE OF STORMWATER TREATMENT AND MANAGEMENT
Introduction
The Covil Ave.Apartment Project is subject to certain watershed restrictions because the water
that leaves the site drains to surface waters that are being protected by NCDENR and the local
government. This project is categorized as"high density option"and is limited to 60%impervious area
with slormwater control. A wet detention pond will function as the water quality control necessary to
meet the Slate requirements. The wet detention pond is intended to function as designed forever. The
operation and maintenance of the Detention Pond Facility will forever be the legal responsibility of the
Owner and or Home Owners Association associated with the site. This requirement is legally upheld
by an Operation and Maintenance Agreement between the Owner and the NCDENR. The Operation
and Maintenance Agreement should be administered by a responsible party to ensure that the
objectives are met. As the Agreement dictates; routine maintenance of the Wet Detention Pond Facility
and the associated stormwater collection system should be performed to ensure continuous water
quality goals set by NCDENR. Following is a narrative of how the treatment and management goals
will be achieved.
A. Construction
Construction of the facility will conform to the Engineer's plans and specifications. All sediment that
collects in the basin during construction will be removed after the site is stabilized.
B. Basin Access
Access to the pond and forebay will be allowed for via two entry points. The parking lots will serve`
z_ as entryways to the basin. The forebay will be accessed through the space east of building 4. The
basin will be accessed through either of the aforementioned open spaces or the open space
between buildings 4&5. A 10'access easement measured from the top of bank of the basin will
be recorded and maintenance will be performed periodically to ensure that access is provided as
intended.
C. Routine Maintenance
Referto the"Operation and Maintenance Agreement"between the Owner and NCDENR.

The Wilmington Regional Office received a Stormwater Management Permit Application for Covil
Avenue / D&M Apartments on April 24, 1998. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater review:
1. Please use ink or type the information for the permit application.
'�:j 2. Please don't use odd depths for the SA/DA computation. Use only the standard depths as
G listed in the table. This pond is 5' deep, according to the elevations.
3. Detention ponds may not be located in 404 wetlands, unless a permit to fill the wetland has
been approved. Please provide a copy of the approval letter from the Corps and a 401 Water
Quality Certification, or relocate the pond out of the wetland.
/ 4. Provide a dimension plan. Include dimensions for all buildings, parking areas, walks, tennis

8. All built-upon area associated with the project must drain into the system, or provide it's own
treatment system. There appears to be a recreation area outside of the drainage area that is not
directed into the pond and does not provide a separate treatment system. Please show
proposed elevations for this area.

surfaces. The note on the plans that the forebays will be constructed after the site is stabilized
must be removed. You only need to clean out the forebays regularly.
10. Please seal the plans.

south bank of the pond.

r ) current design does not utilize all of the pond, does not meet the 3:1 L:W ratio, and has the
potential for short circuit. If site geometry precludes a 3:1 ratio. provide sufficient baffling
in the pond to create a flow path to meet this requirement.
✓13. Please note on the plans that all roof drains must be collected and directed either into the
forebay, or into the collection system.
14. What type of development is planned for the offsite area? Please account for this area in the
calculations at the full buildout potential. I am also concerned that the developers of that tract
will tie in their development drainage to the catch basin in the street, (not just that small part
shown within your drainage area) and it will dump a lot more water into this pond that we are
permitting it for.
15. Please identify the site on the location map.
16. The invert of the orifice is supposed to be at the permanent pool. Please revise your
spreadsheet calculation to reflect this.

19. Why does the application show a total impervious area of 12.15 acres, and the pond design
calculations account for only 11.87? See comment #8 on Page 1. The proposed impervious
in the first box on page 2 of the application lists 12.05 acres. Please clarify.

requested information should be received by this Office prior to July 3, 1998, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including

1. Deed Restriction Language
The following statements must be recorded for all low density projects and for all projects that involve the
subdivision and selling of lots or outparcels:
1. No more than _ square feet of any lot, including that portion of the right-of-way between the
edge of pavement and the front lot line, shall be covered by impervious structures including
asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permii issued by the State of North`Cdrolina. The covenant may not be changed or
deleted without the consent of the State.
2. No one may fill in, pipe, or alter."any roadside swale except as necessary to provide a minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number,size and the allowable built-upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be

NARRATIVE OF STORMWATER TREATMENT AND MANAGEMENT
Introduction
The Covil Ave.Apartment Project is subject to certain watershed restrictions because the water
that leaves the site drains to surface waters that are being protected by NCDENR and the local
govemment. This project is categorized as"high density option"and is limited to 60%impervious area
with stonnwater control. A wet detention pond will function as the water quality control necessary to
meet the State requirements. The wet detention pond is intended to function as designed forever. The
operation and maintenance of the Detention Pond Facility will forever be the legally responsibility of the
Owner and or Home Owners Association associated with the site. This requirement is legally upheld
by an Operation and Maintenance Agreement between the Owner and the NCDENR. The Operation
and Maintenance Agreement should be administered by a responsible party to ensure that the
objectives are met. As the Agreement dictates; routine maintenance of the Wet Detention Pond Facility
and the associated stormwater collection system should be performed to ensure continuous water
quality goals set by NCDENR. Following is a narrative of how the treatment and management goals
will be achieved.
A. Construction
Construction of the facility will conform to the Engineer's plans and specifications. All sediment that
collects in the basin during construction will be removed after the site is stabilized.
B. Basin Access
Access to the pond and forebays will be allowed for via two entry points. The parking lots will serve
as entryways to the basin. The west forebay will be accessed through the space between
buildings 5&6. The east forebay will be accessed through the space east of building 4. The basin
will be accessed through either of the aforementioned open spaces or the open space between
buildings 4&5. A 10'access easement measured from the top of bank of the basin will be
recorded and maintenance will be performed periodically to ensure that access is provided as
intended.
C. Routine Maintenance
Refer to the"Operation and Maintenance Agreement"between the Owner and NCDENR.

Item b.)The basin length to width ratio is approbmately 2.5:1 and not the suggested 3:1 ratio. We
request a variance to this requirement in order to achieve the site geometry we strive for on
the grading plan.
Item l.) A trash rack for both the orifice and riser will be specified on the constmdion drawings.
Item k.) Sediment storage is not provided for in the permanent pool as additional volume above the
required volume associated with the average depth, however access to the basin for routine
clean-outs is provided.
Item I.) A 30 ft.vegetative fitter is not provided at the outlet because the outlet flows into a wetland
where the effluent is then held and infiltrated into the ground overtime. The wetland now
captures runoff and infiltrates all of this into the ground.
Item m.) A recorded drainage easement for the basin with access to the nearest right-of-way will be
provided.

I am resubmitting to you an application and supporting documentation for the
permitting of a water quality detention basin for the proposed Covil Apartment complex in
Wilmington, N.C. Enclosed is an original Stormwater Management Permit Application Form
with Wet Detention Basin Supplement and required $385.00 fee, a signed operation and
maintenance agreement, sealed supporting assumptions and calculations, a spreadsheet
printout showing the required min. 48 hr draw down of the water quality pool, two copies of a
preliminary grading plan and details and a narrative describing stormwater treatment and
management for this facility.
Please consider this letter as certification with Engineer's Seal for the enclosed
information. Feel free to contact our office to discuss this project if you so desire. Otherwise
