Subdivision Lot 32. As of this date, the items cited in the letter have been resolved, and the project has
been determined to be in compliance with the Stormwater Certification issued on December 21, 1990.

Dear Mr. and Mrs. Penegar:
On January 13, 1993 this Office issued a Notice of Violation to you for exceeding your built-upon
area limitation of 2,500 square feet by constructing a bricked parking area approximately 250 square feet
in area. On April 30, 1993 a compliance inspection was conducted by Regional Office staff and found
the brick had been removed and replaced with pinestraw. This is still not acceptable. Pinestraw is
considered an impervious surface due to the fact that it is driven over and compacted. It must be removed
and not replaced with anything else.
This letter is to inform you that your lot 32 is not considered to be in compliance with the
Stormwater Certification issued on December 21, 1990. Please take corrective action immediately.

impervious coverage, as stated in the Certification of Compliance with Stormwater regulations, Number
880622, issued on December 21, 1990. That Notice should have been addressed to the Homeowners
Association. I have issued a Notice of Violation to Mr. Tracy Bowling, President of the Island Quay
Homeowners Association, concerning your Lot Number 32 and its impervious coverage.
You should be receiving a copy of that Notice shortly as well as some correspondence from the
Homeowners Association.

On December 21, 1990, a Certification of Compliance with Stormwater Regulations, Number
880622, was issued to you for Island Quay Subdivision, located in Atlantic Beach. As stated in the
Certification of Compliance, Lot 32 is limited to 2,500 square feet of impervious surface.
On January 4, 1993, Regional Office Staff conducted a compliance inspection of Lot 32 found that 7
a bricked parking area approximately 250 square feet in area had been added after the final survey was '
done. This brings the total amount of impervious coverage of Lot 32 to 2,762 square feet.
You are directed to take the necessary action to bring this site into compliance with Certification
No. 880622 issued December 21, 1990. Failure to correct this violation by February 1, 1993 will result
in enforcement action initiated by this Office and may include recommendations for the assessment of
civil penalties and/or revocation of the Stormwater Certification.

On December 21, 1990, a Certification of Compliance with Stormwater Regulations, Number
880622, was issued to Mr. Tracy Bowling, President of the Homeowner's Association, for Island Quay
Subdivision, located in Atlantic Beach. As stated in the Certification of Compliance, your lot #32 is
restricted to a total of 2,500 square feet of impervious surface.
On January 4, 1993, Regional Office Staff conducted a compliance inspection of your lot and
found that a bricked parking area had been added after the final survey. Your impervious coverage before
construction of the parking area was 2,562 square feet. The approximately 250 square feet that has been
added as brick parking area cannot be overlooked.
You are directed to take the necessary action to bring this site into compliance with Certification
No. 880622 issued on December 21, 1990. Failure to correct this violation by February 1, 1993 will
result in enforcement action initiated by this Office and may include the recommendations that the
Stormwater Certification be revoked and /or the assessment of civil penalties.

Dear Mr. Tetterton:
On October 3 , 1990, Mr. Paul Rawls of this Office and Mr.
Lloyd Wood, Chief Building Inspector for the Town of Atlantic
Beach, visited Lot #30 at Island Quay Subdivision. As a result of
the onsite investigation and the information provided by the Town
of Atlantic Beach; it has been determined the structure on Lot #6
exceeds the 1817 square foot maximum built-upon area outlined in
the restrictive covenant portion of Stormwater Certification
880622 dated July 1, 1989 . As you have failed to comply with the
restrictive covenant for Island Quay Subdivision, this Office
must consider Lot #6 noncompliant with the Certification.
In a related matter, this Office has been provided with a
copy of the "IMPERVIOUS CERTIFICATION" required by the Town of
Atlantic Beach. This certification indicates that the total
built-upon area of the structure to be 1700 square feet and the
actual built-upon area was determined to be 2140 square feet.
Further information obtained from the Town included an September
7 , 1990, letter addressed to you from Mr. Wood which indicated
that the built-upon area of the homesite is in excess of the 1817
square foot limit resulting in noncompliance of stormwater
regulations. Mr. Wood further advised you that removal of the
excess built-upon area would allow him to issue a Certification
of Compliance for the site.

You are directed to undertake the corrective actions that
are necessary to bring the site into compliance with Stormwater
Certification No. 880622 . This action should be taken on or
before November 9 , 1990. Failure to correct the noncompliance on
or before the date specified will result in appropriate
enforcement actions being initiated by this Office which may
include recommendations for the assessment of civil penalties as
outlined in NCGS 143-215. 6 .

built-upon area of the structure to be 1700 square feet and the
actual built-upon area was determined to be 2140 square feet.
Further information obtained from the Town included an September
7, 1990, letter addressed to you from Mr. Wood which indicated
that the built-upon area of the homesite is in excess of the 1817
square foot limit resulting in noncompliance of stormwater
regulations. Mr. Wood further advised you that removal of the
excess built-upon area would allow him to issue a Certification
of Compliance for the site.

You are directed to undertake the corrective actions that
are necessary to bring the site into compliance with Stormwater
Certification No. 880622 . This action should be taken on or
before November 9, 1990. Failure to correct the noncompliance on
or before the date specified will result in appropriate
enforcement actions being initiated by this Office which may
include recommendations for the assessment of civil penalties as
outlined in NCGS 143-215. 6.

SUBJECT: Impervious Coverage
Dear Mr. Tetterton:
When we conducted a final inspection on the development of Island Quay, Lot
#30, we believed that the project .was in compliance with all applicable
regulations. However, during normal permit closeout procedures, we noted
that the impervious coverage exceeds the limit imposed by existing
stormwater regulations. The built upon area also exceeds the coverage noted
on your certification presented to this office with the building permit
application. The limited impervious coverage was also presented to the Town
as a restriction on the Planned Unit Development.
In view of the above, it is my opinion that this office can not issue a
certificate of compliance for the reference project at this time. A
certificate may be issued provided approximately 323 square feet of
impervious coverage is removed or some relief is granted by the Department
of Environment, Health, and Natural Resources.
