I visited the Village at Cypress Bay today. It's been raining a lot lately and there was some flooding in the
road in a low area. The stormwater pond was overflowing slightly but looked basically in compliance.
However, as I reviewed the recorded deed restriction document, I noticed what appears to be a mistake. The
document states "The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number SW8 070723 MOD, as modified and issued by ..."
The aforementioned permit number SW8 070723 is for an entirely different permit, not for this site. The
permit number should be SW8 070232. Can you please have this document amended and recorded
again. Once this has been done, I can then transfer the permit.

Brunswick County
Dear Mr. Merritt:
Effective August 1, 2013,the State Stormwater program was transferred from the Division of Water
Quality(DWQ)to the Division of Energy, Mineral and Land Resources(DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August I, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for issuance of the
permit.
On August 5, 2009,the Govemor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes,which was current and valid at any point between January 1, 2008, and December 31, 2010. The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to three (3)years from its current expiration date. On August 2, 2010,the Governor signed Session Law
2010-177, which granted an extra year for a total of four(4)years extension. Accordingly, the Division is
herewith notifying you that the subject permit is now effective from the date of issuance until July 11,
2021, which includes all available extensions.
On February 4,2016,the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected The Village at Cypress Bay, located in Brunswick County to determine
the status of compliance with the State Stormwater Management Permit Number SW8 070232. DEMLR
file review and site inspection revealed that the site is not in compliance with the terms and conditions of
this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached
to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Amend and record deed restrictions with the correct permit number referenced.
Please be advised that until you submit the required Name/Ownership Change Form to the Division and
receive approval from the Division to transfer the permit,you are required to comply with the terms,
conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina
Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation
and maintenance of the permitted stormwater system.

Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies,within 30 days or by March 5,2016, are considered
violations of the permit. if the requested information is not submitted to this office by the due date,then
DEMLR staff will re-inspect the site and may issue a Notice of Violation. Please also note that any
individual or entity found to be in noncompliance with the provisions of a stormwater management permit
or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21, including
the assessment of civil penalties of up to $25,000 per day.

Steve,
Thank you for taking the time with me yesterday to go over the checklist for
transferring of permits and identifying some of the most immediate items to be
addressed.
Please see attached checklist with associated required items with the intent
to; a) request an inspection; b) transfer the permit to the existing Owners
Association. I reviewed the file and did not see any past transfer regarding this
permit, so 1 DID NOT include the $40.00 transfer fee. If I am incorrect, 1 will be
happy to run a check over as to not slow down the process.
As we discussed, the Sister Community to the Village is Cypress Bay at
Maritime Shores Permit#SW8 060270 MOD,which may have been modified from
the original plans submitted by Cape Fear Engineering, but not noted in your file. I
am hopeful my new engineer will be able to utilize the existing recorded plats for
this small change as well as utilize the plans on file at your office as part of any
required revision. Jeff Petroff with Coastal Land Design is assisting us on getting
through the final permit transfer to the Owners Association. I will await your reply
about how to move ahead on that one.
Thanks again for your assistance and if possible, 1 would like to join
whomever will be reviewing the site to be sure I understand the process in its
entirety and immediately address any issues.

replaced with the following text which is adopted and enacted in lieu of

Cypress Bay at Maritime Shores Subdivision.
2. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the stormwater
management permit.
3. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
4. The covenants pertaining to storm water may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality.
5. Alteration of the drainage as shown on the approved plan may not take
place without the concurrence of the Division of Water Quality.
6. The maximum allowable built-upon area per lot is 4,400 square feet. This
allotted amount includes any built-upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front
lot line and the edge of the pavement. Built upon area includes, but is not
limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina
and parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools.
7. All runoff from the built-upon areas on the lot must drain into the permitted
system. This may be accomplished through a variety of means including
roof drain gutters which drain to street, grading the lot to drain toward the
street, or grading perimeter swales to collect the lot runoff and directing
them into a component of the stormwater system. Lots that will naturally
drain into the system are not required to provide these additional
measures.

Once obtained, DECLARANT shall transfer the above-described permit and the
responsibility for maintenance of the stormwater runoff system and facility to the
Association. The Association shall accept conveyance and transfer of such
permits and carry out and abide by the duties and obligations contained therein.
Article 8, Sec[ion_(e_e),Section_(ii), also includes the following text pertaining to the
Village at Cypress Bay NCDENR Stormwuter Permit HSW8 070232:
1. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 070232 as modified
and issued by the Division of Water Quality under NCA C 2H.1000 for the
Village at Cypress Bay.
2. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the stormwater
management permit.
3. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
4. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality.
