Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 000536 dated August 3, 2000, for the construction of Long Leaf Mall Renovations. This permit shall be effective from the date of issuance until August 3, 2010, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty(30)days following receipt of this permit. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built-upon surface. 2. During construction,erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel ofDWQ. The records will indicate the date,activity,name of person were taken. performing the work and what actions 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved}plans and specifications, and other supporting data. 7. Upon completion of construction,prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility,a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. S. If the stormwater system was used as an Erosion Control device,it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area. C. Further subdivision,acquisition,or sale of the project area.The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The Director may determine that other revisions to the project should require a modification to the permit. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 4 State Stormwater Management SN'stems Permit No. SW8 000536 12. Prior to the sale of any portion of the property,an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 13. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. 14. The runoff from all built-upon area on the project must be directed into the permitted stormwater control system. 15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit.Within the time frame specified in the notice,the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 16. The permittee shall notify the Division of any mailing address changes within 30 days. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee,documentation from the parties involved,and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. DEED RESTRICTIONS AND PROTECTIVE COVENANTS The following italicized deed restrictions and protective covenants are required to be recorded for all subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table listing each lot number,size and the allowable built-upon area for each lot must be provided as an attachment. 1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number as issued by the Division of Water Quality. These covenants may not be changed or deleted without the consent of the State. 2. No more than square feet of any lot shall be covered by structures or impervious materials. Impervious materials include asphalt,gravel, concrete, brick, stone,slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Swales shall not be filled in,piped, or altered except as necessary to provide driveway crossings. 4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. The mall portion of the shopping center is planned to be demolished and new retail shops are proposed to replace them. The existing site is 95.4% impervious. The renovations to the site actually reduce the imperviousness by 0.23 acres to 94.5% imperviousness. Landscape islands have been added throughout the parking lot to help break up the sea of pavement. The existing drainage system will continue to be utilized to convey the surface water runoff off of the site. The area at the southeast corner of the property will be regraded due to the requirements of the finished floor elevations. This resulted in regrading the parking lot. Two new drop inlets were added and one was relocated. Notes have been added to the plan indicating that the Contractor shall excavate the trench such that the clay layer that is present at 6+ feet deep shall be removed. The following is a response to your comments: 1) A note has been placed on Sheet C4 of the plans stating that no wetlands exist within the limits of construction. 2) Page 2 of 4 of the Storm Water Management Application Form has been revised to account for the infiltration system. 3) The infiltration system has been referenced in the narrative and in Section III Part 1 of the application. 4) A completed infiltration trench supplement is provided. 5) Two copies of Sheet C9a are being provided as separate sheets that show the drainage area for the infiltration system. The architect has been provided this information in order for them to design the drainage system for the roof. 6) The calculations and the permit application for the infiltration system have been changed to account for the 1.5-inch design storm. The infiltration system actually has been designed to infiltrate the runoff for more than the 1.5-inch storm. Please sec the attached calculations. 7) The weir height for the over flow weir has been changed to the same elevation as the top of the infiltration trench. The detail has also been modified. 8) A note has been placed on Sheet C2 under the"Grading and Drainage Notes"on note No. 10 stating that the underlying clay layer shall be removed and replaced with clean select fill material. 9) A report prepared by a soil scientist is provided indicating that the seasonal high water table is 8+ feet deep in the infiltration area. The purpose of the borings was to observe soil characteristics that can be indicative of the position of the seasonal high water table(SHWT)within the soil profile. These can include soil colors of chroma 2 or less and/or the presence of specific soil layers such as a spodic (13h)horizon. The borings were made to a depth of about I I feet. The borings were designated HA-1 through HA-3. Extensive alteration of the site through construction and drainage appears to have influenced the natural hydrology of the area. Indicators of soil saturation, however, can remain, even when the soil profile is no longer saturated. Soil characteristics observed in the boreholes made for this study suggest that the SHWT originally was located at a depth of about 62 in. (HA-1), 60 in. (HA-2), and 55 in. (HA-3)below the Assam d orieinal ground surface (see following table). There are indicators that the area around boring HA-1 has about 18 inches of fill, and that the area around boring HA-3 was cut about 40 inches. These are the depths to an apparent$h horizon and/or grey mottles in the argillic (Bt) horizon. We did not observe free water in any of the three borings at the time that they were made. Soil moistpre was higher above the organic hardpan layers (Bh) and the finer textured soil layers(Bt). These observation seem to indicate that, as mentioned previously, extensive alteration of the area of the site through construction and drainage improvements has lowered the water table. Based on the observations that we made on the subject site, it is our opinion that the present SHWT is probably located at a depth of 8+feet below the ground surface. The southeast corner of the existing mall will be demolished and some pavement will be removed and the parking lot regraded. However, due to existing underground utilities such as water and gas that are in the area, the infiltration system could not be placed in the area that was regraded. The infiltration system had to_be placed in the existing parking lot in front of the proposed Home Place and Pets Plus stores. The owner will utilize the"payment in lieu"of option to meet the City of Wilmington's storm water requirements. In addition to the "payment in lieu"of option, an infiltration system has been designed to infiltrate the 1.5-inch runoff from±2.34 acres. The infiltration system will provide an emergency outlet for the 50-year storm event. A copy of a soils and infiltration report has been provided as an attachment. The infiltration report states that the existing soils will infiltrate an average rate of 1.9 x 10"'cmZ/sec(29 in/hr) for sands underlying a clay layer that is to be removed. The surface runoff for the infiltration system will be collected in drop inlets and dispersed into infiltration pipes. The drop inlets will be designed to have a 2-foot settling pool in the bottom of the inlets. These settling pools will allow for additional storm water treatment and sediment settling prior to entering the infiltration piping. The overflow from the system in higher frequency storms will outlet into the existing drainage system on the property and will be conveyed to Watson's Branch, a tributary of Hewlett's Creek. To meet the requirements of Section [.1003 (d)(3)(B)] to the maximum extent practicable,±.390 LF of perforated pipe for infiltration has been added in the parking lot that can infiltrate the 1.5-inch runoff from ±2.34 acres of drainage area. This area was chosen for the infiltration system because there are no existing utilities in close proximity, the soils are good and the existing elevations in the parking lot allowed runoff to enter the infiltration system in a manner that did not require regrading of the parking lot. The infiltration system was designed to meet and exceed the State's requirements. The first segment of the infiltration system infiltrates runoff from±0.84 acres. The first segment has 150 L.F. of 24-inch ADS perforated pipe with No. 57 washed stone. This part of the infiltration system can infiltrate runoff from the 1.5-inch storm (4,300 cf plus an additional 5,150 cf of storm water runoff). The second segment of the infiltration system infiltrates runoff from± 1.5 acres. There is±280 L.F. of 24- inch ADS perforated pipe with No. 57 washed stone.This part of the system can infiltrate runoff from the 1.5-inch storm plus an additional 9,940 cf of storm water runoff. The purpose of the borings was to observe soil characteristics that can be indicative of the position of the seasonal high water table(SHWT)within the soil profile, These can include soil colors of ehrorna,2 or less and/or the presence of specific soil layers such as a spodic(Bh)horizon. The borings were mad4 to a depth of about 11 feet. The borings were designated HA-1 through HA-3. Extensive alteration of the site through construction and drainage appears to have influenced the natural hydrology of the area. Indicators of soil saturation,however,can remain, even when the soil profile is no longer saturated. Soil characteristics observed in the boreholes made for this study suggest that the SHWT originally was located at a depth of about 62 in. (HA-1),60 in. (HA-21 and 55 in. (HA-3)below the aeainne 1 original gmiwel sums(see following table). Thera are indicators that the area around boring HA 1 has about 18 inches of fill,and that the area around boring HA-3 was cut about 40 inches- These are the depths to an apparent Bh horizon and/or grey mottles in the argiiflc (Bt)horizon. While the SHWT is likely deeper than the soil morphological characteristics indicate, it is probable that percolating water is`perched"(episaturation)at these depths for a short period during wet periods. We did not observe flee water in any of the three borings at the time that they were made. Soil moisture was higher above the organic hardpan layers(Bh) and the finer textured soil layers (Bt). These observation seem to indicate that, as mentioned previously, extensive alteration pf the area of the site through construction and drainage improvements has lowered the water table. Based on the observations that we made on the subject site, it is our opinion that the present SHWT is probably located at a depth of 8+feet below the ground sutfisee. Delineate all wetlands on site, disturbed or undisturbed, or note on the plans that none exist. 2. Please provide the required information in Section III Part 6 of the application regarding the drainage area to the infiltration system. Label one column as the overall site, and the other as the infiltration system. 3. Please reference the infiltration system in the narrative and in Section III Part 1 of the application, the stormwater system summary. 4. Please provide a completed infiltration trench supplement. 5. Please delineate the drainage area to the infiltration system. 6. Please either use a design storm of 1.5", or provide the results of a chlorides test taken at a point in the receiving stream that is at least '/ mile from the proposed discharge point, as the crow flies, after at least 3 days without rain. If the chlorides level is less than 500 ppm, then you will be allowed to use the I" design storm. 7. If the weir height is set at the elevation of the top of the pipe, then you lose the storage volume in the 6" of trench located above the pipe. To take full advantage of the storage available, please set the weir elevation at the top of the trench, or revise your storage calculations. 8. Please either note on the plans that you will be undercutting the clay layer as noted in the soils report or recalculate the flowrate in the system using the coefficient of permeability, k, of .0019 cm2/sec, as indicated in the soils report for the soils above the clay layer. 9. The existing site is 25.17 acres. The current amount of imperviousness on the property is 24.02 acres. The renovations reduce the amount of impervious area by 0.23 acres. (LAW), is pleased to submit this report of our subsurface exploration and hydraulic conductivity testing for your proposed Long Leaf Mall Expansion in Wilmington, North Carolina. Our Services were provided in general accordance with LAW Work Authorization dated April 11, 2000. The purpose of this work was to determine the drainage characteristics of the soils in the proposed infiltration trench. The assessment of site environmental conditions or the presence of contaminants in the soil, rock, surface water or ground water of the site was beyond the scope of this exploration. This report presents a review of the information provided to us, a discussion of the subsurface conditions. and our test results. PROJECT INFORMATION General project information was provided by Mr. Young and Mr. Mark Hargrove in telephone conversations on April 10 and April 14, 2000. We were provided a site sketch indicating the location of the proposed infiltration trench. A subsurface infiltration trench is planned in the area of the existing parking area to infiltrate stonnwater from an approximately 2-acre drainage area. A 24 to 36 inch diameter concrete pipe will be installed in the trench at a depth of 5 to 6 feet below existing grade. FIELD EXPLORATION Two hand auger borings were explored to depths of approximately 10 to 15 feet below existing grades in the proposed trench location. The boring locations were selected and located in the field by LAW personnel by taping distances and estimating right angles from existing site features. These locations should be considered accurate only to the degree implied by the methods used. The approximate locations of the borings are shown on Drawing No. I attached. Test boring records showing visual descriptions of the soil strata encountered are also attached. Tests were run at approximately 6.5 and 7.8 feet below present grade. The evaluation and recommendations presented in this report were developed from our interpretation of the general subsurface conditions at the site based on information obtained from the soil borings. The stratification lines indicated on the boring records represent the approximate boundaries between soil types. The transitions may be more gradual in situ. Variations in soil conditions can also occur between soil boring locations. SUBSURFACE CONDITIONS The hand auger borings performed generally revealed approximately 1.5 to 1.75 inches of asphalt and six inches of aggregate base course. Underlying the stone base course, sands with variable amounts of silt, were encountered to approximately 6 feet. At approximately 6 to 7.5 feet, clays were encountered with variable amounts of fine sand. Underlying the clays, clean sands were encountered to boring termination depth. Groundwater was not encountered in hand auger borings. INFILTRATION TESTING The depths of permeameter testing were 6.5 and 7.8 feet below present grade as discussed with Mr. Hargrove. The test run at 6.5 feet represents the sands overlying a clay layer and the test performed at 7.8 feet represent sands underlying a clay layer. Test results indicate hydraulic conductivity values of 1.9x10-' cm2/sec for the sands overlying the clay layer and approximately 1.9x102 cm2/sec for the sands underlying the clay layer. The test results for the deeper sands are approximate due to the depth below grade and the rapid infiltration limiting the allowable static head height. The test results indicate good drainage characteristics of the in place sands; however, the clay layer encountered from approximately 6 to 7.5 feet will impact infiltration in the proposed area. As discussed with Mr. Hargrove, the clay material encountered may be overexcavated and replaced with sand or stone fill during trench construction. We are available to discuss our results with you and to provide additional studies or services necessary to complete the project.
