The Wilmington Regional Office received a complete modification to the Stormwater
Management Permit Application for First Baptist Church of Jacksonville on November 17,
2005. Staff review of the plans and specifications has determined that the project, as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. .. ,1 a-
We are forwarding Permit No. SW8 000414 Modification dated January 17, 2006, for the
construction of First Baptist Church of Jacksonville.
This permit shall be effective from the date of issuance until January 17, 2016, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

handle the runoff from 11,500 ftz of impervious area. Pond #2 has been designed to
handle the runoff from 389,120 ft2 of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
4. The tract will be limited to the amount of built-upon area indicated in Section 1-6 on
page 3 of this permit, and per approved plans.
5. Permanent seeding for the ponds is approved as Bermuda and Fescue, and rnay not
be altered without first notifying the Division and receiving approval.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built-upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch
basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.

5. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
c. The falling water from the fountain must be centered in the pond, away from
the shoreline.
d. The maximum horsepower for a fountain in this pond is fountain HP
horsepower.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting
data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
8. If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
G. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition, or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval was sought or for which a CAMA Major permit
was issued.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The Director may determine that other revisions to the project should require a
modification to the permit.
11. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
12. Prior to the sale of any portion of the property, an access/maintenance easement to
the stormwater facilities shall be granted in favor of the permittee if access to the
stormwater facilities will be restricted by the sale of any portion of the property.
13. The permittee is responsible for verifying that the proposed built-upon area does not
exceed the allowable built-upon area.
14. The runoff from all built-upon area on the project must be directed into the appropriate
permitted stormwater control system.

15. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
16. The permittee shall notify the Division of any name, ownership, or mailing address
changes within 30 days.
III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity unless and until approved by the
Director. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the
Division of Water Quality accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be appropriate. The approval
of this request will be considered on its merits and may or may not be approved. The
permittee is responsible for compliance with all permit conditions until such time as
the transfer is submitted and approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems. .
5. The permittee grants DENR Staff permission to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.

The Wilmington Regional Office received a Stormwater Management Permit Application for
First Baptist Church of Jacksonville on August 17, 2005. A preliminary review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
t/ 1. This is a modification to a previously permitted project, and the plans will replace
those previously approved, therefore, the plans should reflect all of the previously
permitted information for the unchanged portions of the project, not just the new
parking lot. Please revise the plans to include Pond 1 details, dimensions and
grading for the entire site.
J 2. Please submit a revised drainage area map delineating the previously approved
Pond 1 drainage.area and the new 13.77 acre Pond 2 drainage area.
J 3. Please revise page 2 of the application, per enclosure. As previously indicated,
this application will replace the previously approved one therefore, it will need to
list the built-upon area as indicated for Pond 2. Additionally, the calculations
appear to include a future allotment of 100,000 ft2 of built-upon area, but the
application does not reflect this.
4. Please provide additional calculations for Pond 2 including a table of elevations,
areas, incremental volumes and accumulated volumes in the pond and forebay.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to November 18, 2005, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
- extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the
permit.

I received your email-thank you very much. I also received the "Plan of Action"
letter from Dave Newsom with Crystal Coast Engineering, who has been subcontracted
by John Pierce & Assoc. to address the items in the NOV. He anticipates submittal
of the modification by August 26, 2005, and upon approval of the modification, to
construct the improvements within 4 months. -If possible, I would like to have the
improvements constructed sooner than 4 months from the date the permit is issued. I
think 60 days is more than ample time, especially since you already know the scope
of the work that will be involved. Bid solicitation should already be well
underway. Mr. Newsom is well-versed in the stormwater plan requirements, so the
plans he prepares will most likely be more than adequate for the purpose of
soliciting bids.

assist with the permit modifications required to bring the referenced project into
compliance. We are in receipt of your Notice of Violation dated July 25, 2005 for this
site. In response to that Notice, we provide the following responses:
1. Please accept the following as the 'Plan of Action" requested in the Notice of
Violation.
Plan of Action
a) Prior to 8/10/05, permittee has retained John L. Pierce & Associates to
provide necessary surveys. On this date, John L. Pierce & Associates
has subcontracted Crystal Coast Engineering, PA to assist with the
required design and permit modifications.
b) Prepare and submit revised Stormwater Plan and Stormwater Permit
Modification to DWQ by 8/26/05.
c) Upon approval by DWQ of Stormwater Permit Modification, construct
required improvements to existing stormwater treatment facilities within
four(4) months.
d) Upon completion of construction of required improvements, submit
required Engineer's Certification within 45 days.

NARRATIVE
First Baptist Church of Jacksonville
The First Baptist Church of Jacksonville recently installed additional parking at their site
on Gumbranch Road. As this additional parking area did drain to the existing
Stormwater Pond (Pond 2), they did not realize that a permit modification was required.
Upon receipt of a Notice of Violation from DWQ, the Church authorized John Pierce &
Associates to prepare the required Stormwater Permit modification.
Upon reviewing the original calculations for Pond No. 2, it was discovered that the
existing pond contains inadequate capacity to accommodate the additional built-upon
area. As a result, it will be necessary to enlarge the existing pond and to install a new
outlet structure. The new pond will be adequately sized to accommodate the new parking
area as well as a proposed playground shelter on the westerly periphery of the site.
A combination of swales and berms are proposed to divert all stormwater emantating
from the new parking surfaces to Pond 2. Stormwater emanating from the playground
shelter will sheet flow in an easterly direction over the existing curb and to Pond 2.

On July 21 , 2005, Wilmington Regional Office personnel performed a Compliance Inspection
of the subject project, located at 1925 Gum Branch Road in Jacksonville, Onslow County,
North Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 000414, issued to you on September 5, 2001.
The project has been found in violation of Stormwater Permit Number SW8 000414 , issued
pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section 1.4- The tract has exceeded it's permitted amount of built-upon area. An
additional unpermitted gravel parking area has been added. Gravel is considered
to be a built-upon surface.
2. Section 11.6- The facilities have not been constructed per the approved plans. An
additional unpermitted gravel parking area has been added.
3. Section 11.3- The facilities have not been maintained in a manner to ensure
optimum efficiency. Both of the orifices in the ponds were clogged.
4. Section I1.15- Failure to provide a written response when notified by the Division
that the permitted site did not meet one of the requirements of the permit. You
were notified on March 30, 2005, that the additional gravel parking area would
require a modification to the permit. To date, no response to that letter has been
received.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to
correct the violations and a time frame for completion of those actions, on or
before August 25, 2005.
2. Apply for a permit modification to account for the increased built-upon area
draining to Pond #2.

3. Clear the clogged orifices so that the required 1" volume is available in the
permitted systems.
Failure to provide the 'Plan of Action" by August 25, 2005, or to correct the violations by
the date designated in the 'Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Onslow County Building Inspector, this Office is requesting
that the Building Inspector consider withholding building permits and Certificates of
Occupancy for this project until this matter is satisfactorily resolved.

Dear Dr. Turner:
On March 2, 2005, the Wilmington Regional Office of the Division of Water Quality received a
copy of a revised Erosion and Sedimentation Control (E&SC) plan from the City of Jacksonville
for the paving of a gravel area located within the subject project. Per Section 11.9(d) of the
stormwater management permit issued to you on September 5, 2001, a modification is
required for redesign of or addition to the approved amount of built-upon area. Based on the
E&SC plan, a gravel parking area approximately 45' wide by 560' long is shown along the
southwestern parking bay. Additionally, other minor layout changes have been made without
benefit of approval from the Division.
Either a Stormwater Permit Application Package including 2 sets of plans, completed
application form, fee, and supporting documentation, or a written response regarding the
status of this project and the expected submittal date must be received in this Office no later .
than April 30, 2005. Any construction on the subject site, prior to receipt of the required permit
modification, and/or failing to respond to this request by the due date will constitute violations
of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office to
include a fine of up to $10,000 per day per violation.

REMARKS: I have been told that the area highlighted on the attached map was graveled as an auxiliary
parking area it is less than one acre and more than two years since their disturbance so I don't think
there is an erosion control issue. Our Zoning Inspectors will probably make them pave the area in
accordance with our zoning code.
