Dear Mr. Coyne:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any
development approval issued by the former Division of Water Quality under Article 21 of Chapter
143 of the General Statutes, which was current and valid at any point between January 1, 2008,
and December 31, 2010. The law extended the effective period of any stormwater permit that was
set to expire during this time frame to three (3) years from its current expiration date. On August 2,
2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four
(4) years extension. Accordingly, this permit shall now be effective from the date of issuance until
March 17, 2024, which includes all available extensions.
The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for Louise Wells Cameron Art Museum on August 3, 2015. In addition, this site was
inspected on October 13, 2015. As noted in the enclosed inspection report, the site is currently in
compliance with the terms and conditions of the state stormwater permit. Staff review of the plans
and specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding
Permit No. SW8 000226 MOD dated October 14, 2015 for the construction, operation and
maintenance of the BMP's and built-upon areas associated with the subject project. In addition,
we are forwarding you an approved copy of the revised plan sheet titled "Addendum - Drainage &
Impervious Area" for your files. This drawing shows the drainage area removed and drainage area
added to the Cameron Art Museum wet pond. Please add the attached plan to the previously
approved plan set.
This permit shall!be subject to the conditions and limitations as specified therein. Please pay
special attention to the conditions listed in this permit regarding the Operation and Maintenance of
the BMP(s), recordation of deed restrictions, procedures for changing ownership, transferring the
permit, and renewing the permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system, to record deed restrictions, to transfer the
permit, or to renew the permit, will result in future compliance problems.
The following modifications are included and covered by this permit:
The drainage area and impervious area have been adjusted for the wet detention pond due to the
Multi-Use Path project and The Forks at Gallery Park project. It has been shown that the wet pond
can handle the additional drainage area and impervious area without any physical changes. The
built-upon area (BUA) has been reallocated accordingly. During the time between approval of the
permit and now, a low density project called 17" Street/ Museum Drive Multi-Use Path was
permitted (SW8 080904) for the City of Wilmington. The Multi-Use Path project removed the
sidewalk along the south side of Museum Drive, which drained to the wet pond, and replaced it
with the multi-use path. Also, a high density project called The Forks at Gallery Park was permitted
(SW8 140417), which removed a portion of the multi-use path and replaced it with sidewalk along
Museum Drive and added a street connection (Leader Circle) with Museum Drive. The project also
added Lot 37 (4,650 sf BUA) at the southern corner of Museum Drive & Charles Paine Drive and
added Lot 36 (1,000 sf BUA) at the northern corner of this intersection.

Note that the remainder of BUA on Lot 36 (3,650 sf), along with the northern portion of Museum
Drive, will drain to Independence Regional Pond (SW8 951208).

right to request an adjudicatory hearing by filing a written petition with the Office of Administrative
Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Energy, Mineral and
Land Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until March 17, 2024, and shall
be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.7 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 188,912 square feet of
impervious area.
3. A vegetated filter is not required for the wet detention pond as it has been
designed for a 90% TSS removal efficiency.
4. The tract will be limited to the amount of built-upon area indicated in Section 1.7
on page 3 of this permit, and per approved plans. The built-upon area for the
future development is limited to 11,040 square feet.
5. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

6. The runoff from all built-upon area within the permitted drainage area(s) of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built-upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re-vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DEMLR. The records will indicate the date,
activity, name of person performing the work and what actions were taken.

5. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is 1/8 horsepower.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a.stormwater treatment device,
and prior to occupancy of the facility.
9. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built-upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. Prior to the construction of any permitted future areas shown on the approved
plans, the permittee shall submit final site layout and grading plans to the
Division for approval.
12. A copy of the approved plans and specifications shall be maintained on file by
the permittee at all times. At the time the permit is transferred to a new owner,
the permittee shall forward the approved plans to the new owner.

13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change Form signed by both parties, to
the Division of Energy, Mineral and Land Resources, accompanied by the
supporting documentation as listed on page 2 of the form. The approval of this
request will be considered on its merits and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Energy, Mineral
and Land Resources, in accordance with North Carolina General Statute 143-
215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re-
issuance or termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The permittee shall notify the Division of any name, ownership or mailing address
changes at least 30 days prior to making such changes.
11. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

Stormwater Narrative
The stormwater permit (SW8 000226) for the Louise Wells Cameron Art Museum is
being modified to adjust the drainage area and impervious area draining to the permitted
wet pond.
During the time between the approval of the permit and now, a low density project called
17`h Street/Museum Drive Multi-Use Path was permitted (SW8 080904) for the City of
Wilmington. The Multi-Use Path project removed the sidewalk along the south side of
Museum Drive, which drained to the wet pond, and replaced it with the Multi-Use Path.
Since the Multi-Use Path project is low density it was permitted/planned to drain away
from Museum Drive. The Multi-Use Path project also added a pedestrian crossing on
Museum Drive. The permit for the Louise Wells Cameron Art Museum was not
modified to reflect the changes as a result of the Multi-Use Path project.
Also, a high density project called The Forks at Gallery Park was permitted (Permit #
2014023 & SW8 140417). The Forks at Gallery Park removed a portion of the Multi-Use
Path and replaced it with sidewalk along Museum Drive, and added a street connection
(Leader Circle) with Museum Drive. The project also added a pedestrian crossing on
Museum Drive, added Lot 37 (4,650 sf BUA) at the southern comer of the intersection of
Museum Drive & Charles Paine Drive, and added Lot 36 at the eastern comer of the
intersection of Museum Drive & Charles Paine Drive. Lot 36 (4,650 sf of BUA) is
permitted (SW8 140417) to drain to the Independence Regional Pond, but 1,000 sf of
BUA will be allocated in the Museum Pond for any driveway and/or sidewalk on Lot 36
that might drain to the pond.
Therefore, we are modifying the stormwater permit for the Louise Wells Cameron Art
Museum to adjust the drainage area and impervious area of the wet pond due to the
Multi-Use Path& The Forks at Gallery Park projects.
In the calculations &permit for the wet pond for the Louise Wells Cameron Art Museum
project, all areas were listed as on-site. We are moving impervious areas from the streets
and sidewalk categories to the off-site category where the impervious areas are off-site.
The pond was designed & permitted for the 1" event. The drainage area and impervious
area above the permitted amount is designed for the 1.5" event.
A plan sheet titled "Addendum—Drainage & Impervious Area" shows the drainage area
removed and drainage area added to the Louise Wells Cameron Art Museum wet pond
drainage area.

What you have summarized below sounds correct. Also, you will likely need deed restrictions on those offsite lots/areas
to limit the offsite BUA within the drainage area to the Cameron Art Museum pond.
The only caution I would have would be to double check the Cameron Art Museum permit to make sure all the BUA has
been accounted for. Specifically, I don't recall if the added building for the pottery studio has been permitted. The
other advice I would offer is to consider maxing out the pond with future BUA for the museum. As you know, any
additional BUA above the permitted level would be considered at 1.5".

area and its associated BUA would be off-site. The Museum permit would be modified to add the off-site drainage area
and the off-site BUA to the wet pond. Only this added area (not the entire pond drainage area) would be required to be
designed at 1.5" (i.e. permitted required volume +calculated required volume at 1.5" for just the additional area = total
new required volume). The new required (permitted +additional) volume and surface area are less than the permitted
design volume and surface area of the pond. Also, based on the January 20, 2010 letter from David Hollis of Hanover
Design Services that is in the NCDENR file for the Museum pond, the new required volume and surface area are less than
the asbuilt volume and surface area of the pond. No changes to the wet pond would be required. We would submit a
stormwater modification application package with wet pond supplement for the Museum pond and a stormwater
modification application package with off-site supplement for the off-site area we would be draining to the Museum
pond.
Is the above correct? Also, especially need confirmation that the wet pond would not have to be modified to meet
current wet pond design standards (veg. shelf location, calculation of permanent pool depth, etc.) due to this change.

As long as no additional BUA is proposed, then the original design would remain the same. If additional BUA was
desired,then just the increase would need to be designed at 1.5".
The modification/transfer can be submitted simultaneously but the order in which they are accepted depends on the
signatures and what responsibilities the new owners want to take on. Typically we require the permittee to bring the
site into compliance prior to the transfer. That would likely require the modification to come in first before the
transfer. However, if the new owners are willing to accept responsibility for addressing any non-compliance issues and
are willing to put that in writing, then the permit can be transferred to them and then modified.

This scenario opens up the door for many other questions and considerations. But the simple answer is that it is
unlikely that just a plan revision will cut it. Who is the permittee? Are they still a part of this development? If
the project has been subdivided beyond the original permit, then a modification is needed to ID and limit the
amount of built upon area allocated to each lot. And since each lot has part of the wet pond omit, then both lot
owners will likely have to be listed as co-permittees with each being listed on the permit as well as both signing
the application and the O&M.

A site (1.50 acres) that is located in a business/office/industrial park has a state stormwater permit. A wet pond
on the 1.50 acre site treats runoff from this site only. The only development shown on the site when it was
permitted was on half the site (car wash). Future BUA allotment for the site was provided. The site has since
been subdivided into two lots (1 with the car wash & 1 that is undeveloped). Each lot has part of the wet pond on
it.
Could we submit a plan revision form and an addendum plan sheet showing a proposed site development on the
undeveloped subdivided lot using most of the future BUA allocation?

On November 15, 2010, the Division received a request for a Plan Revision to add an aeration
system to the pond permitted under the subject permit. I have attached a 2003 Division memo
titled Fountains in Stormwater.Extended Wet Detention Ponds which discusses using both
fountains and aeration systems. As you will read in the report, the Division understands the
potential positive qualities of fountains but does not support using aeration systems. Permitted
wet ponds are designed to settle out solids in ponds before they are discharged to streams, and
the addition of equipment such as fountains or aerators disrupts this process. Your permit
allows a fountain using a 1/8hp pump based on your pond's volume. Please see Section II(5) of
the permit text for further guidance in selecting and placing the fountain pump. This pump size
will offer a balance between the positive qualities of having a fountain while still allowing the
pond to function as it was designed.

After doing some research and consulting with Bill Hunt of NCSU, I am ready to make the following recommendation in
regards to allowing the use of decorative fountains in stormwater ponds. I am basing my recommendations on the fact
that certain benefits may be realized by the addition of such devices. First, surface disturbance of the pond can increase
dissolved oxygen levels in the pond and enhance biological activity that can be beneficial in removing some pollutants of
concem. Second, gentle mixing of the water column may aid in flocculation of certain pollutants as well as allow for
contact with the anoxic zone of the pond's bottom encouraging de-nitrification. Third, disturbing the surface of the pond
can discourage mosquito breeding.
After researching different products designed for use in ponds, I discovered a variety of aeration and fountain type
systems. I do not recommend the use of the aeration systems that work like fish tank bubble stone as they would create
too much disturbance. I do recommend surface fountains that draw water from less than 2 feet. Some of the surface
fountains simply float on top of the water and have the intake, pump and fountain nozzle all in one unit. These clearly
draw water at the surface. Others make use of a separated nozzle, pump, and/or intake connected by tubing. If these are
to be used they must draw their water from the surface in the deepest part of the pond.Also, I recommend that the failing
water from the fountain be centered in the pond and away from the shore line.
In regards to sizing the pump, it seemed appropriate to compare the energy input to the pond volume using a velocity
gradient that would encourage flocculation in water treatment applications. The assumption is that if small enough amount
of energy input was used that re-suspension would not be an issue. Further, if the amount of energy added by the
fountain was comparable to that needed to encourage flocculation of fecal ccliform, for instance, then it may even prove to
be a benefit. As a final check, I also determined the detention time based on pumping rates to further show that too much
mixing would not occur. The shortest detention times were in the order of two days.
Based on the above, here is the proposed schedule of maximum pump power(hp) vs. minimum pond volume(cubic feet).

Proposal:
To install an aeration system for the retention pond. Monies to be used to
purchase and install aeration system. The system would increase the water
circulation of the pond thereby improving the water quality, providing a pleasing
pond vista, conducive to plant and animal life.
The Cameron Art Museum pond area has been landscaped and aquatic plants
have been installed, but further enhancement is desired for the pond because not
only is it an integral part of the Museum activities and events, it is highly visible
from 17th St. and Independence Blvd. It would provide a shining example for
Wilmington, of how retention ponds can be more than just a water runoff
containment system.
Pond aeration achieves the following:
Dissolved oxygen increases to healthy levels
Stagnation is replaced by a convection current
Thermal and Oxygen Stratification are eliminated
Biological processes start to reduce the muck layer
Nutrient balance is achieved
Reductions in algae and weed growth
Odors are eliminated as an exchange of gasses occurs
No longer a breeding ground for Mosquito's and Midge Fly's
Fish habitat is restored
Aeration naturally creates a balanced and healthy pond ecosystem.

Dear Christine:
In response to your inspection of the stormwater facilities at the above site on November 16, 1
would like to inform you of the results of our investigation, and respond to your individual
concerns as follows:
I. Investigation of the "additional drainage area" you identified indicates that it was reported
by Mr. Larry Sneeden, PE, in the calculations although he perhaps erroneously called all
contributing areas `°onsite". His delineation clearly included about 100 additional feet of
Museum Drive and about 130 additional feet of Charles Paine and showed the portion of
the Museum tract closest to Independence falling that way and not draining to the pond.
He reported a drainage area of 9.4 acres. As-built data indicates a high point break in
Museum Drive at about 40 feet and the same in Charles Paine at about 100 feet, less than
reported. My delineation of the drainage area on-site and including Museum Drive and
Charles Paine actually came out to 9.0 acres, but I don't see any need to modify Mr.
Sneeden's original figure.
2. Your concerns about additional built-upon area would be valid, as BUA not identified on
the original plan can be observed such as the ornamental gravel path around the pond,
without an actual as-built accounting. We identified every bit of BUA on the attached
"Impervious and Other Area Tabulations", Sheet 2 of 2 (as part of the overall "Existing
Conditions Survey"), and found that in fact the Museum is well under the permitted
amounts — I will summarize the results shortly.
3. Please refer to No. 2 above and the following tabulation summary.
4. The forebay was identified as proper, along with depths and surface areas, and 1 will
include those results as part of the tabulation summary.
5. The water level was within a few inches of normal on the day of survey and the orifice
appeared to be functioning properly.

As you can see by the actual tabulation of as-built impervious surfaces, including gravel paths,
ornamental bridges, signs, vaults, statues, sculptures, benches, and utilities pedestals, the
Museum is actually 11,040 sf shy of their permit totals.
I don't believe that is in the interests of the State to "initiate penalties" or require any
modifications or addendums to this perfectly valid permit. In my professional opinion, the site as
built is completely compliant with the terms and conditions of permit SW8 000226 as I have read
and understood it.
I would also opine that if the Museum elects to install a few more sculptures, as long as their
total surface area does not exceed 10,000 sf or so (which is very unlikely) that DENR should not
really have to require alterations or modifications to the permit. Thanks for your understanding in
this matter.

Mr. McKoy,
Kelly told me you had stopped by to see me last week regarding three outdoor exhibits at the Art Museum and were
wondering how they would impact the museum's permit. She may have told you that any temporary structure that is
considered to be an impervious surface needs to be incorporated into the permit. Impervious surfaces are considered
to include, but are not limited to, structures, asphalt, concrete,gravel, brick, stone, slate, and coquina, but does not
include raised, open wood decking, or the water surface of swimming pools. For structures, we use the drip line to
determine the amount of impervious area. Also, the exception to considering gravel as an impervious surface is when it
is used in landscaping in place of mulch.
I took a look at the three conceptual diagrams. It is hard to tell the scale or what exactly is proposed with the big
shoe/foot exhibit. However, I discussed it with my supervisor who agreed that it would likely be considered an
impervious area. From the drawings, it appears that the Haint Blue structure utilizes open slatted decking of sorts,
which would not be considered impervious and would not impact the permit. The third structure, the Switchtower
4022, appears to include a fiberglass roof, which would be considered an impervious surface.
If the museum is planning on having these outdoor temporary exhibits often, it may be beneficial to go ahead and /
designate a certain amount of impervious area to use for these exhibits as necessary. This would require the permit to
be modified. However after the permit is modified, each time the exhibits changed, a plan revision describing the
change would be needed (no charge in the regular SW permitting review process).
