This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. For changes to the previous permit, see the Draft Permit cover letter. The Division acknowledges your written comments on the draft, received on June 30. We offer the following corrections and responses to comments. 1. Revised the Supplement to Cover Sheet to reflect your corrections to facility components; 2. Updated map and text to reflect discharge to McCotter Canal, hence to Shop Branch [Stream segment 27-115-3], a tributary to Hancock Creek; 3. Corrected Longitude from 78 degrees to 76 degrees on map and in text; 4. Because your facility is among the least significant sources of nutrients to the Neuse River estuary, and is therefore least likely to receive Total Nitrogen (TN) or Total Phosphorus (TP) permit limits in the foreseeable future, the Division has reduced your monitoring requirements for these parameters from 1/Month to 1/Quarter. 5. Revised the draft permit flow limit, per your request, from 0.165 to 0.360 MGD; 6. Added footnote [see Section A. (1.) and (2.)] providing for a future request, to modify monitoring conditions for specific parameters, as warranted see Section A. (1.), Footnote 3]; 7. Deleted fluoride from the permit because, a) you do not add fluoride to drinking water, i.e. to filter -backwash water; and b) there is no saltwater instream standard or criteria for fluoride against which to evaluate future reasonable potential to exceed. 8. Corrected WET Testing requirement to reflect "composite" sampling, based on flow >0.030 MGD and discharge to "tidal saltwater, not modeled" (24-hour Acute Pass/Fail @ 90 %) in accordance with the WTP Guidance 2007. TRC - Because low-level TRC is currently difficult to quantify in a wastewater matrix, the Division shall consider all effluent TRC values reported below 50 µg/L to be "in compliance" with the permit. However, the Permittee shall continue to record and submit all values reported using North Carolina -certified field and lab test methods, even if these values fall below 50 µg/L. 3. Modifications - After one year, (12 samples minimum), the Permittee may petition the Division to reevaluate the monitoring requirements for a given parameter. If new data warrant, the Division may modify the permit and may consider this a minor permit modification. 4. For a given wastewater sample, TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively. 5. Whole Effluent Toxicity (WET) testing - Pass/Fail @ 90%, monitor only [Jan, Apr, Jul, Oct -Pem» ace's choice of species: fathead minnow; silverside minnow; mysid shrimp, See Section A. (2.)]. The Permittee shall collect and report only those samples that accurately represent the discharge. The Permittee shall discharge no floating solids or foam visible in other than trace amounts. Permit NCO078131 A. (2.) ACUTE TOXICITY - MONITORING ONLY (QUARTERLY) The Permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised-July,1992 or subsequent versions). Choice of Species: fathead minnow, silverside minnow, or mysid shrimp. Monitoring shall be performed -as a 24-hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90 % (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of January, April, July and October. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGUE. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. The Permittee shall submit test data that is complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the Perimittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. As requested we have reviewed the draft for both completeness and accuracy. We present our specific comments below. (1) Effluent Limitations and Monitoring Requirements The flow should be revised to 0.36 mgd (Based on the rated plant flow of 2.8 MGD times the historical peak monthly average backwash rate of 0.127 MGD per MGD of finished water). This is necessary to assure there is adequate discharge capacity as the existing water plant approaches the design capacity and may avoid a future permit modification. The City's decision to commit public resources and construct this water plant capacity was made well in advance of there being a flow limitation on the wastestream. For conductivity and salinity, often the conductivity is measured and converted to salinity. We suggest we measure both for one year (12 samples), evaluate the correlation and then if appropriate, use the conductivity measurements to also determine salinity. As recommended in the September 2007 guidance document "NPDES Permitting Strategies for Potable Water Treatment Plants" (Guidance Document), for the metals, we suggest the monthly monitoring proceed for one year, the data be evaluated and if appropriate, the sampling be reduced to quarterly. The quarterly sampling would focus on the worst month in the quarter. Also as recommended in the September 2007 Guidance Document, fluoride monitoring should only be implemented if a fluorinated finished water is used for backwashing the filters and softeners. Because the subject treatment plant does not add fluoride to the water, it appears the fluoride monitoring requirement is not necessary and hence we request it be deleted. For Whole Effluent Toxicity (WET) the sample should be a 24 hour composite to more accurately represent the daily discharge. This is also in accordance with the Guidance Document. Page 5 A. (2) Receiving -Stream Monitoring The comment on salinity and conductivity on page 4 also apply here, with one year's data being used to establish the correlation between conductivity and salinity and if conductivity will be used to also measure salinity. This would allow all measurements to be collected in the field. Thank you for considering our comments. After the inclusion of the comments in the draft permit, we respectfully request an opportunity to review the changes. Of course we are available for a meeting to resolve any concerns. We look forward to working with you and your staff toward developing a permit that is both fair to Havelock and environmentally protective. The permittee operates a Water Treatment Plant (WTP) designed to produce potable water at a maximum rate of 2.8 million gallons per day (MGD), generating 0.900 to 0.100 MGD of filter backwash wastewater. This facility utilizes ion -exchange technology and manganese -based "green -sand" filters. This system also utilizes water softeners. Filter backwash wastewater is collected in a settling basin where the supernate discharges to surface waters of the state. Verifying Existing Stream Conditions. This facility discharges to McCotter Canal and hence to Hancock Creek [27-115], a Class C-SW; NSW waterbody within the Neuse River Basin. Based on the permittee's treatment technology, the Division does not anticipate that this potable water process will generate significant quantities of nutrients. Fact Sheet Renewal -- NPDES Permit NCO087726 Page 1 PERMITTING APPROACH Site Facility Map has been revised and Outfall 001 location has been updated. Ion Exchange and Greensand Filter Systems. The Division herein prescribes limits and monitoring deemed appropriate for ion exchange, water -softening, and manganese "greensand" treatment processes according to recent NPDES guidance for water treatment plants (revised September 2007). This facility shall therefore monitor flow (limit at 0.165 MGD), Total Suspended Solids (TSS), Total Iron, Total Manganese. The Division will also add Ammonia Nitrogen (NHA Chloride, Total Copper, Total Lead, and Total Zinc as contaminants of concern (COCs) due to their presence as target filtrates. Fluoride will also be added to establish a database for future monitoring adjustments. In addition, others parameters are specifically required for nutrient -sensitive waters (NSW) within the Neuse River Basin. This renewal includes updated nitrogen and phosphorous requirements (see permit Section A. (L). Although Total Residual Chlorine (TRC) is limited at 13 µg/L (SC waters), the Division has added a footnote stating that, because of present difficulties in quantifying low-level TRC in a wastewater matrix, values reported below 50 ug/L will be deemed "in compliance" with the permit. Whole Effluent Toxicity (WET). This Ion -exchange system discharges to saltwater (Sc) influenced by ocean tides and has not been modeled, therefore WET testing is required (Acute 24-hour Pass/Fail @ 90 %), according to the 2007 WTP Policy. Residual Solids Management Plan. The Permittee's removes residual solids from the WTP and transports them to the Havelock W WTP where sludge is dried. Sludge is then loaded and transported for disposal to the Tuscarora Landfill in Craven County. This facility has undergone some improvements/expansion since last permit renewal. The expansion consisted of an increase in the maximum output of the plant to 2.8 MGD, and daily output of 1.28 MGD. A ten -inch well, with the capabilities of delivering up to 1000 gpm, was added for a total of four wells. Three more filters and two more softeners were added to the treatment line, and during this time the method of disinfection was changed to chloramines, from free chlorine. Also during this time, the City decommissioned its oldest treatment plant (Lynnwayne). Lynnwayne was decommissioned due to the extensive repairs needed to the facility, so the Webb plant was expanded to shoulder the City's water demand. The backwash flow has been averaging 96,000-100,000 gallons per day. A copy of our sludge management plan is enclosed. Water from the Castle Haynes aquifer is pumped up from our wells to aeration basins, where the cascades down through gnItm, thus remov" - any hydrogen sulfide that may be in there. Then pumps take it from the basin, while being injected with potassium permanganate to the 6 filters, the water, then goes through the gmeasand f0ters and catches the iron , now soluble form. The water then leaves the filters and goes to the ion exchange softeners that remove the calcium and maganesivan. After the softners the water is blended With filter water to achieve the proper hardness, then is injected with zinc orthophosphate for corrosion control, then with hypochlorite bleach, then finally with ammonia to form chlorornines. After the chemical injecI ts the water goes to a 1.0 MG storage tank, then pumped to the system. S. The water used for backwash is. wed water consiting of chlorominated water. The other part of the wasteevater is from our softeners, which uses filtered water and a brine solution for recharging the soitsaers. The water is discharged to our waste holding basin, where it is held ior the proper settling time to achieve good, clear effiuent. 9. Annually, or when the sludge level in the backwash catch basin reaches a level of two feet, a vacuum truck is used to remove the sludge and transport it to the Havelock WWTP, where it is deposited in a dump pan. Once in the pan the sludge is allowed time to settle and the clear water is drained to the -head of the WWTP. When the sludge is dry enough to pass a paint filter test it is loaded and transported to the Tuscarora Land Fill in Craven County.
