materials from the industrial facility or site identified in this document(except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to annually self re-certify No Exposure and, if requested, submit this re-certification to
DWQ or the operator of the local municipal separate storm sewer system (MS4) into which the facility discharges (where
applicable). I understand that I must allow the North Carolina Division of Water Quality, or MS4 operator where the
discharge is into the local MS4, to perform inspections to confirm the condition of no exposure and to make such inspection
reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of
law that this document and all attachments were prepared under my direction or supervision in accordance with a system
designed to assure that qualified personnel properly gathered and evaluated the information provided. Based on my
inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the
information, the information provided is to the best of my knowledge and belief true, accurate and complete. I am aware
that there are significant penalties for providing false information, including the possibility of fine and imprisonment for
knowing violations.

The Division has reviewed your submittal of the application for No Exposure Certification requesting exclusion from
NPDES stormwater permitting for the Ball Metal Beverage Container plant in Reidsville, NC. Based on your submittal of a
signed certification of no exposure, the site visit conducted by Sue White on March 20, 2014, the Division is granting
conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North
Carolina regulations.
Please note that by our acceptance of your No Exposure Certification, Ball Metal Beverage Container is obligated to
maintain no exposure conditions at this facility. If conditions change such that the facility no longer qualifies for the no
exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for any stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as unpermitted discharge.
Ball Corporation must recertify the no exposure status annually using the included form. Any"yes" answer would require
that you obtain NPDES permit coverage for stormwater discharge from the facility. The annual self-recertification form
does not need to be submitted to DEMLR, unless requested. Please note that this conditional exclusion from
permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter(with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DEMLR must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed,provided those containers are not deteriorated and do not leak. "Sealed"means
banded or otherwise secured and with locked or non-operational taps or valves;adequately maintained
vehicles used in material handling;and final products, other than products that-would be mobilized in
stormwater discharges(e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting is available on a facility-wide basis only—not for individual

Here's my interpretation of the Tier One and Tier Two permit conditions found on Part II Page 7 of 10.
Under the Tier One it says "for any parameter at any outfall"
Under the Tier Two it says"for any specific parameter at a specific discharge outfall.
I interpret the word specific to refer to any previous parameter benchmark value that we were above.
We were above the bench mark for Zn only during the first sampling and above the bench mark for Cu only on the
second sampling.

Since we do not have two consecutive results for the same parameter above the benchmark value we are still Tier One.
Forward this to our SW inspector and have him confirm my interpretation.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality(DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007(or as subsequently amended).
The following information is included with your permit package:

• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report(DMR)Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six(6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1,2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year(or,if applicable,
report"No Flow," as outlined in Part III,Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.

(DWQ) conducted a compliance evaluation inspection at the subject facility on 3 April 2012. Your assistance
and cooperation during the inspection was greatly appreciated. An inspection checklist is attached for your
records and the inspection findings are summarized below.
The facility is located at 1900 Barnes Street, Reidsville, Rockingham County, North Carolina.
Stormwater related to industrial activity is discharged to an unnamed tributary to Little Troublesome Creek,
which is currently classified as Class C, nutrient-sensitive waters in the Cape Fear River Basin.
Documentation and Monitoring Review
The Stormwater Pollution Prevention Plan (SP3) is complete and well implemented. Required
documentation was present and the plan is being reviewed and updated annually. The missing
latitudes/longitudes for the stormwater.discharge outfalls mentioned in the last inspection'report have been
added to the maps in the SP3.
The site has three stormwater outfall discharges. Due to Ball's representative outfall status, the required
analytical and qualitative monitoring is being conducted at Outfall 002 only. Analytical and qualitative was
complete and comprehensive.
Site Review
The site was very clean and extremely well maintained. Industrial activity at the facility is minimal. No
problems were identified at any of the outfalls.

During the site inspection you and Mr. Thomas discussed the ability of the Ball facility to be certified as
no exposure. Based on Mr. Thomas observations the only area of concern is the above ground storage tank at
the facility. At present it does not have secondary containment and the connection area is not covered. Adding
'those two structures to that tank would meet.the conditions of no exposure certification. In addition, I am
including an application for no exposure certification. The application includes a checklist of the additional
requirements for no exposure certification.
We greatly appreciate your efforts to develop and implement an effective stormwater pollution
prevention plan. Please continue your efforts to help safeguard the waters of our State.

Stormwater related to industrial activity is discharged to an unnamed tributary to Little

the Cape Fear River basin. The receiving stream information in the current permit is
incorrect. The current permit shows the receiving stream to be an unnamed tributary to
Troublesome Creek. Please ensure this information is updated when you -submit, renewal
paperwork during the next permit renewal cycle.
Documentation & Monitoring Review
3. The Stormwater Pollution Prevention Plan (SP3) is complete and well implemented. Only slight
discrepancies were noted, such as the lack of latitudes/longitudes for each stormwater discharge
outfali (SDO) and the annotation of annual reviews of the SP3. Despite these discrepancies, the
SDOs were easy to find and the right-of-ways to them were well maintained. The SP3 is also
obviously well maintained and implemented. Please read through the permit again to ensure all
details are covered under the SP3.
4. The site has three SDOs. Ball was granted representative outfall status (ROS) via a letter from
this office dated 7 August 2006. You had a copy of this letter on file and Mr. Boone requested a
copy of it to ensure we had it in our records. In accordance with the ROS, the required analytical

Your facility is currently covered for stornnwater discharge under General Permit NCG030000. This permit expires
on August 31,2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued. your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of-your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4,2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to$10.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of"storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of"no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater&General
Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stornlwater,html
If the subject stormwater discharge to waters of the state has been terminated. please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottorn of the form. You will be notified when the
rescission process has been completed.

is reissued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the

The following information is included with your permit package:
a A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
. A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
