Dear Mr. Hedrick:
The Division has reviewed your submittal of the No-Exposure Certification for Exclusion from NPDES Stormwater
Permitting form. Based on your submittal and signed certification of no exposure at the above referenced facility, the
Division is granting your conditional exclusion from permitting as provided.fo.r under 40 CFR 126.22(g), which is
incorporated by reference in North Carolina regulations. We are also hereby rescinding your current permit number
NCG060293.
Please note that by our acceptance of your no-exposure certification, you are obligated to maintain no-exposure
conditions at your facility. If conditions change such that your facility can no longer qualify for a no-exposure
exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no-
exposure exclusion expires in five years (February 26, 2014). At that time you must re-certify with the Division, or
obtain NPDES permit coverage for any stormwater discharges from your facility.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.
If you have any questions or need further information, please contact Robert Patterson at (919) 807-6375, or at

Jeff,
Thanks for the follow up sampling, particularly the information on the background pH of 5 for the last
rainfall event. The Winston Salem Regional Office agrees with you that it will be difficult for you to
fall within cut off concentrations for pH when area rainfall is below the expected range.
The Regional Office also notes that your original request for a No Exposure Certification NCNE0486
was submitted to the Stormwater Permitting Unit in July 2007 and recommended by the Winston Salem
Regional Office in October 2008. The Division apologizes for the delay in processing your request.
The Regional Office recognizes that the pH conditions that will bump you into a tiered response with
more frequent testing are out of your control. As a result the Regional Office will allow you to defer
further testing as required by your existing stormwater permit NCG060293 until the requested No
Exposure Certification can be issued or the Stormwater Permitting Unit in the Central Office requests
otherwise.

Rose,
As you know, ITW Texwipe has had consecutive pH failures for storm water

have our Lab perform some testing to help determine/eliminate the source (s) .
Yesterday I took a sample at storm drain (SD) #4 and the building down spout,

me to believe that our parking lot is not negatively impacting pH, as previously

requirements, due to acidic rain. Please advise me on any recommendations that
you
may have with the Tier Two requirements.

NOV-2007-PC-0779
ITW Texwpe

Kemersville, NC 27284
Permit No. NCGO60293
Forsyth County
Dear Ms Rose Pruitt:
This letter is in response to the Continuing Notice of Violation(NOV)that ITW Texwipe
(addressed above) received from the Winston-Salem Region Division of Water Quality
on January 4,2008. An extension request for the response to the NOV was granted by
NC Division of Water Quality for February 29, 2008.
Violation:
The SWP3 is incomplete and outdated. Failure to comply with the permit.
Response:
Attached is a complete and updated SWP3 for ITW Texwlpe. In the summer of 2006
ITW changed their permit coverage from General Permit No. NCG170000 permit to
General Permit No. NCGO60WO to reflect a more accurate SIC code. In'this transfer
process there was misunderstanding as to differ+encing requirements of time two permits.
ITW Texwipe now fully understands the requirements of the NCG0130000 permit and will
comply with all the requirements in the future.
Violation:
Failure to conduct analytical monitoring.
Response:
As mentioned above, ITW Texvripe transferred from a NCG170000 permit to a
NCGO60000. ITW Texwipe received coverage under the NCGO60000 permit on July 5,
2006. The first required period tot annual analytical monitoring was:July 2006—June
2007. ITW Texwlpe performed the required annual analytical monitoring within this
period on February 1,2007. The results of analytical monitoring performed on February
1,2007 are enclosed.
The next required annual analytical monitoring period was:July 2007—June 2008. The
NCG060000 permit was reissued with new requirements on November 1, 2007 before
this monitoring period ended; therefore sampling was not conducted for monitoring
period July 2007—June 2008. ITW Texwlpe will continue to conduct required analytical
sampling, which is required on a semi-annual basis per the reissued NCG060000 permit.
Violation:
Failure to conduct qualitative monitoring.
Response:
ITW Texwipe understands the requirements of the NCG060000 permit and will comply
with all the requirements in the future. To make up for the oversight, monitoring was
performed on January 10, 2008. The results are attached. In the future, ITW Texwipe
will perform qualitative monitoring on a semi-annual basis during the following periods:
April—June and September--November. The Storm Water Pollution Prevention
Committee Members and an updated Compliance calendar will aid in the completion of
the requirements in a timely manner.
It you have any questions or concerns in regards to this, please feel free to contact

Ms Clark
I will only reluctantly grant ITW Texwipe an extension of the deadline until February 29, 2008 as they
have had notice of the January deadline since January 9. I found very little improvement in the last
revision. It seemed to be a compilation of ISO info cut and pasted from another company (KNC?) or a
generic template. The Permit is very specific in it's requirements and I will not accept anything less.
Paraphrasing the permit is not considered the same as providing the requested info. Please consult the
permit and the guidance documents referenced in the previous Notices of Violation. The previous SP3
versions I have reviewed from this facility indicate that no one has done so yet.

Dear Mr. .Hedrick:
I have reviewed the recent submission of your revised Storinwater Pollution Prevention Plan
(SP3) and monitoring data. I regret to inform you that I have found very little improvement to
the original SP3 document. Attached please find another checklist identifying the missing
information. Your SP3 appears to be a generic template with very little information specific to
your site. I strongly urge you to read your permit and consult the guidance document for
specifics in developing your plan.
Copies of the NCG060000 general permit documents can be accessed from the following
web page: http://h2o.enr.state.nc.us/su/Foniis Documents.htm#StormwaterGP
A guidance document to assist you in developing Stormwater Pollution Prevention Plans
for Stormwater Runoff at Industrial Activities is available at the Division website.
http:/lh2o.enr.state.ne.Lis/su/Manuals Factsheets.htm 1
Additionally. I reviewed the analytical monitoring data you submitted and feel it necessary to
remind you that you are responsible for monitoring a specific set of parameters for each of your
outfalls(those should also be clearly identified bn your site map).
I have seen no Qualitative monitoring data for your facility too date. I have attached a sample
form to assist you. Each outfall should be evaluated separately and only requires visual
observations by the inspector not a laboratory.
While I think that your site may possibly qualify for No-Exposure Certification, I would be
reluctant to recommend your application until I see relevant and complete monitoring data as
required by your current permit.

NO EXPOSURE CERTIFICATION
National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit
based on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notice that your facility does not require permit
authorization for its stormwater discharges associated with industrial activity in the State of North
Carolina because it qualifies for a no exposure exclusion. A condition of no exposure at an industrial
facility means all industrial materials and activities are protected by a storm resistant shelter(with some
exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff.
Industrial materials or activities include, but are not limited to: material handling equipment or ac irgs,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste
a, / z t►L!
products. Material handling activities include the storage,loading and unloading, transportation fir, {
conveyance of any raw material,intermediate product,final product or waste product. A stone tant i;
shelter is not required for the following industrial materials and activities:drums, barrels, tanks ref r
similar containers that are tightly sealed, provided those containers are not deteriorated and d j#/leek~'
"Sealed"means banded or otherwise secured and with locked or non-operational taps or valv _
adequately maintained vehicles used in material handling; and final products, other than prod at
would be mobilized in stormwater discharges(e.g.,rack salt). l t.:'J 1
A No Exposure Certification must be provided for each facility qualifying for the no exposure exc! sru on ZZ
In addition, the exclusion from NPDES permitting is available on a facility-wide basis onlr--not for
individual outfalls. if any industrial activities or materials are, or will be, exposed to precipitation, the
facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure
Certification form, you certify that a condition of no exposure exists at this facility or site and are
obligated to comply with the terms and conditions of 40 CFR 122.26(g).
You are required to reapply for the No Exposure Exclusion once eves five (5) years.
