While the standard usually employed by DCM is for an applicant to provide "a deed or other
instrument under which they claim title" for the property where development is proposed as part of a
complete CAMA permit application (or in this case, in the riparian area of the "island tip" at issue),
this letter from you as Carteret County's (the applicant's) attorney describing your stated opinion that
title "is likely owned in whole by the State of North Carolina" can serve as a substitute in this case as
far as DCM's processing of the application. As Mr. Bodnar at DCM is copied on this email, I'm
advising him to move forward with the pending CAMA major permit application based on your legal
opinion that the island tip is owned by the State. You may still need to seek permission (in some
form) from the State Property Office (I'm copying in Tim Walton, Director) to place the proposed
breakwater structure in the State's riparian area.
Thank you for providing this information about the ownership of the "island tip" at issue to me and my
clients at DCM.
