Thomas WTP NPDES Permit NCO079821 Forsyth County Dear Mr. Saunders: Dee Freeman Secretary Title 15A of the North Carolina Administrative Code, Subchapter 02B, Section .0506 enumerates specific reporting requirements applicable to holders of NPDES permits issued by the State of North Carolina. As stated by 15A NCAC 02B .0506(a)(1)(E), permittees must continue to submit monthly discharge monitoring reports (DMRs) to the Division of Water Quality, even when there is no discharge from the facility during the reporting period. The Director of the Division of Water Quality may waive this requirement during extended periods of no discharge. I have reviewed your correspondence dated November 25, 2008, which states the subject facility is not being operated and therefore is not producing a wastewater discharge. You indicated the plant was taken out of service on September 15, 2008 for renovations until December 31, 2011 and would like the requirement for submittal of monitoring reports suspended. After reviewing your letter and considering the recommendations of the staff in the Winston- Salem Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective September 15, 2008. Please be advised if and when a discharge resumes, the discharge must be monitored as per the terms of the NPDES permit and other applicable rules or statutes. Thomas WTP DMR Submittal Waiver February 2, 2009 Also be advised that while requirements for operator visitation, monitoring and reporting are being waived during the period of no discharge, the permittee is still required to pay the Annual Administering and Compliance Monitoring Fee that is associated with this and all NPDES permits. The Thomas WTP was taken out of service on September 15, 2008 for renovations. We would like to keep this permit active; however, we are currently not producing wastewater at this facility and will not have a discharge until the plant renovations are completed in 2011. Once the construction is completed and we resume discharging at this point we will notify your office and start submitting a DMR.
