Director Roger Melvin Toney Lumber Co Inc PO Box 447 Louisburg, NC 27549-0447 NORTH CAROLINA Environmental Quality May 17, 2024 SUBJECT: COMPLIANCE EVALUATION INSPECTION REPORT & NOTICE OF VIOLATION Tracking Number: NOV-2024-PC-0309 NPDES Permit No. NCO089010 Louisburg Lumber Mill Franklin County Dear Mr. Melvin: On April 17, 2024, Division of Water Resources (DWR) Raleigh Regional Office (RRO) staff Jesse Barnes conducted a routine compliance evaluation inspection at the Louisburg Lumber Mill in reference to NPDES permit NC0089010. Facility staff Roger Melvin and Mike Senter were present during the inspection. A review of records, data, structures, operations, and maintenance was completed. This review reflected noncompliance with the subject permit. The determined permit violation(s), item(s) of concern, and other observations are listed below. Inspection findings are detailed in the attached Water Compliance Inspection Report. Permit Violation(s) Part I, Section A. (1.) of the subject permit requires weekly flow to be monitored and reported as an instantaneous measurement of effluent flow. Currently, flow is monitored and reported as a totalized calculation based on influent flow from the public water supply utility. An effluent flow measurement device must be installed, calibrated, and maintained as described in Part II, Section D. (3.) of the subject permit. tem(s) of Concern 2. As of the date of this letter, DWR has not received an application to renew the subject permit. The subject permit and its authorization to discharge will expire at midnight on September 30, 2024. The permit renewal application is past due as of March 31, 2024. 3. Effluent settleable solids data has been reported in mL/L on recent DMRs but should be reported in mg/L in accordance with the requirements of the subject permit. 4. On -site staff indicated that facility ownership information is not accurately reflected in DWRs records. Please complete and submit the attached Change of Ownership Form with up-to-date information. 5. On -site staff expressed the need to register new users for eDMR since the facility has changed ownership. Please complete and submit the attached eDMR Registration Form to designate users. Other Observations The Louisburg Lumber Mill is located at 309 Bunn Rd in Louisburg, Franklin County, NC. Version 3.0 of NPDES permit NCO089010 became effective April 1, 2020, and will expire at midnight on September 30, 2024. See Item 2, above. The permitted facility is a lumber wet -decking operation generating runoff from wet -decking and stormwater. The facility was as described in the subject permit. The October 2023 discharge monitoring report (DMR), associated laboratory reports, and chains of custody, were reviewed for completeness, transcription accuracy, and permit compliance. All reviewed records and reports appeared to be complete and compliant during the inspection with no errors found. See Item 3, above. All parameters, field and non -field, are performed by contracted lab Meritech Inc, certified lab # 165. The facility utilizes BMPs and retention to facilitate compliance with the subject permit. There are no conventional wastewater treatment components. Runoff from wet -decking and stormwater collects in a ditch. The facility maintains wetland vegetation in the ditch for nutrient removal. Several waddles are present along the ditch to catch excess debris. Runoff eventually collects in a pool dammed by a steel notched weir, which functions as the effluent outfall into the receiving stream, UT to the Tar River. The pool aids in treatment by acting as a facultative lagoon, providing additional biochemical treatment and solids settling. Discharge typically only occurs when wet -decking is active in warmer months, from spring through early fall. Effluent sampling is conducted by collecting grab samples with a dipper from the effluent weir. Effluent discharge during the inspection appeared to be clear with no visible foam or debris. The runoff collection ditch and BMPS appeared to be functioning properly with no obvious indications of excessive nutrients, solids, debris, or other pollutants. Please respond to this notice, in writing via email or letter to this office, within 30 business days of receipt. The response should address each violation (1) listed above by providing details of planned corrective actions along with estimated completion dates for each violation. Failure to make corrective actions to achieve compliance with the subject permit within a reasonable time may result in further enforcement actions. Please be aware that DWR may take enforcement action against any individual who fails to comply with the requirements of all applicable permits, regulations, and/or statutes. Pursuant to NC General Statute (NCGS) 143- 215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit, or applicable regulations, issued pursuant to G.S. 143-215.1.
