SUBJECT: CAMA Dredge/Fill Permit Application for Town of Williamston's River
Landing II, Bertie / Martin County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 102 River
Drive adjacent to the Roanoke River in Williamston, NC Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as
amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.).
The applicant proposes to construct a 10' by 517' boardwalk with two 20' by 24' fishing platforms that
will tie into the existing Roanoke River and Moratoc Park boardwalks. The existing structures will be
removed, but piles will remain. The Roanoke River at this location is classified C by the Environmental
Management Commission, is designated an anadromous fish spawning area (AFSA) by the NCWRC, and
is designated critical habitat for Atlantic sturgeon by the National Marine Fisheries Service (NMFS).
The NCWRC has reviewed the proposal and is familiar with the project area and has commented on
previous, adjacent proposals (River Landing I, Tripp 23 May 2006 and NCWRC Williamston BAA. Tripp
18 September 2006). As with the previous projects, we do not believe the project will have significant
impacts to aquatic resources as long as a February 1 — September 30 in -water work moratorium is
included as a permit condition to protect the federally listed Atlantic sturgeon as well as other
anadromous fish species such as striped bass and blue back herring.
