PROJECT SUMMARY: The applicant is proposing to extend an existing fixed access pier 30' further waterward and reconfigure and replace a floating dock, increasing from one (1) existing boat slip to a total of two (2) proposed boat slips, extending a total of 510 ft. below NHW along Eastern Channel. 9. NARRATIVE DESCRIPTION: The project site is located at Lot 10, Kings Lynn Drive (Parcel No. 233NA014), adjacent to Eastern Channel, in Oak Island NC, Brunswick County. The site is approximately 1.16 acres, and the undeveloped upland portion of the lot is vegetated primarily with ornamental and native grasses, and native shrubs. From the upland boundary, moving northward across the property, the elevation lowers and transitions to upper salt marsh. The upper salt marsh areas contain a mix of Coastal Wetlands species, including Saltmeadow Cordgrass (Spartina patens), Sea Lavender (Limonium platyphyllum), Spiked Grass (Distichlis spicata), and Glasswort (Salicornia spp.) Normal High Water (NHW) comes across through the property curving from east to west. From the western edge of the property, an upland peninsula extends outward to the north, and turns to the east, forming a hummock of upland and shrub vegetation, which is encircled by NHW. Below NHW, the low elevation salt marsh is dominated by Smooth Cordgrass (Spartina alterniflora). The project site has approximately 109 ft. of shoreline frontage along the Eastern Channel. There is currently a private one slip docking facility, which was authorized via CAMA General Permit 34265 D on 7/9/2003. The existing facility consists of a private fixed access pier (435' x 4'), fixed covered gazebo (16' x I I'), gangway, and floating dock (14' x 10'). At the time the facility was permitted and constructed, it extended to open water to provide access for boating. According to the applicant, in the years post construction, sedimentation and accretion processes have led to a waterward expansion of coastal wetlands, and the floating dock currently sites on the mud at low tide. The applicant is seeking a CAMA Major Permit to extend the current docking facility out to open water, and reconfigure the existing floating dock. The waters of the AIWW are classified SA by the Division of Water Resources. This area IS NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and it is OPEN to the harvest of shellfish. 10. PROJECT DESCRIPTION: The applicant is proposing to extend an existing fixed access pier 30' further waterward and reconfigure and replace a floating dock, increasing from one (1) existing boat slip to a total of two (2) proposed boat slips, extending a total of 510 ft. below NHW along Eastern Channel. According to the applicant, the proposal consists of extending the existing fixed access pier an additional 30' waterward from the northern edge of the current fixed gazebo (the extension would be greater than 400' from NHW, which is why the applicant is seeking a CAMA Major Permit for this development). From the edge of the proposed fixed pier extension, the applicant is proposing to install a gangway, which would provide access to a floating dock (20' x 10)', oriented perpendicular to the shoreline. The west side of the proposed floating dock would serve as slip 91, and the east side of the proposed dock would serve as slip 92. With the Field Investigation Report: Janice Hamby DCM Major Permit Page 13 proposed extension, the proposed floating dock would be located in water depths ranging from -2.0' on the landward side to -5.0' @ NLW on the waterward side. DCM site visit confirmed these estimated water depths. The project area is bordered by Eastern Channel to the north, Kings Lynn Dr. to the south, a residential property with docking facility to the west and a vacant lot to the east. According to the application, the applicant has proposed riparian lines based on prior DCM permitting and consultation with DCM Staff. The western Riparian line was established via CAMA Major Permit 965-18 during a proposal for the neighboring property, and it was considered an extension of deeded parcel lines out to open water. The Eastern Riparian line was proposed to DCM for review by the applicant's agent, in consideration with a concurrent CAMA Major Permit application under review for Lot 9A, the eastern adjacent riparian property. As proposed, the docking facility extension would be located within the applicant's riparian corridor, would be in alignment with adjacent docking facilities and would not encroach into either 15' adjacent riparian corridor setback. The proposed docking facility would extend 51' beyond the edge of marsh, and would be located landward of the 1/4 of the width of the waterbody, which measures approximately 275' across. 11. ANTICIPATED IMPACTS: The proposed docking facility would incorporate 380 SF of Estuarine Waters and Public Trust Area, but would represent an increase of 240 SF beyond what is already existing at the facility. The proposed docking facility extension would be located landward of the 1/4 width and in alignment with adjacent docking facilities. This area is not designated as Primary Nursery Area, and the proposed docking facility would be located in water depths of approximately -2.0' to - 5.0' @ NLW according to the applicant. Minor increases in turbidity should be expected during construction. Existing Land Uses: Private residential use Existing Wastewater Treatment/Disposal: Solid Waste/Fish Offal/Trash Disposal: Use and Daily Operations of the Project When Complete Proposed Development Purpose: The purpose of the proposed docking facility is to gain access to the Eastern Channel for recreational activities. Buildings/Facilities/Units/Structures: n/a Use & Daily Operations: The applicant intends to use the proposed docking facility for private recreational use including boating, fishing, and entertainment. Construction Methodology & Equipment: Marine -grade pilings will be installed using a vibratory hammer. Standard electrical power tools will be used for the construction of the docking facility. All equipment will be stored on site during construction. Development Activities Narrative Specifics: The applicant proposes to extend the existing docking facility out to deep water along the Eastern Channel in Oak Island. The docking facility extension will consist of removing the existing floating dock and installing an access pier and float at the waterward end of the gazebo. The project is located in waters classified SA:HQW by DWR and are not designated as PNA by DMF. This section of the Eastern Channel is open to the harvest of shellfish. The applicant's parcel has 109 ft. of shoreline and the waterbody width in the vicinity of the project area is approx. 400' from marsh to marsh. Application Narrative: Tidal Creek Permitting has been retained by the property owner, Janice Hamby, (herein referred to as the "Applicant"), to secure a NC Division of Coastal Management CAMA Major Permit, for a private 2-slip docking facility extension proposed to extend greater than 400 linear feet waterward of the Normal High Water line, along the Eastern Channel in Oak Island. The purpose of the docking facility extension is to access deep water for recreational activities. The existing 1-slip docking facility was issued under GP# 34265 on 7/9/2003 and extended to open water at the time of issuance. Years of sedimentation has accreted along the shoreline and the existing floating dock now sits above NLW, surrounded by oysters and patches of Smooth Cordgrass. The applicant intends to remove the existing 10'x14' floating dock and gangway and install a proposed 30'x6' access pier, extending north from the waterward edge of the existing 11'x16' gazebo. The access pier would lead down a gangway to a proposed 20'x10' floating dock, oriented perpendicular to the shoreline. Adjusted water depths collected on 3/7/24 at 11:10am show water depths at the landward edge of the proposed floating dock are -2.0' NLW and dropped down below -5.0+' NLW at the waterward edge of the proposed floating dock. The waterward end of the proposed docking facility would extend approx. 51' beyond the edge of coastal wetlands to approx. 12% of the waterbody width (waterbody width =—400ft), remaining landward of the 1/4 waterbody width. The riparian lines were established under GP #34265 however no riparian lines were shown on the proposed work plat or the issued General Permit. It appears the applicant intended for the riparian lines to run as an extension of the deeded parcel lines, out to open water. Major Permit #65-18 was later issued at the adjacent property, 6622 Kings Lynn Dr, to extend their existing docking facility out to deep water. The work plat for this application confirms that the angle of the shared riparian line between Lot 10 and 6622 Kings Line Dr was an extension of the shared property line, out to deep water. The eastern riparian line, as an extension of the parcel line, was reviewed by DCM on 2/26/24 and submitted to DCM on a separate Major Permit application for Lot 9A, Kings Lynn Dr (PA-1306). The proposed docking facility would not encroach into either adjacent 15' riparian setback. The western edge of the proposed docking facility would be located approximately 62' away from the western riparian line. The eastern edge of the proposed docking facility would be located approximately 25' away from the eastern riparian line.
