Compliance Schedule Extension Request
Dear Ms.Young,
Covation Biomaterials LLC ("CovationBio") owns and operates the Kinston Site for the production of
Sorona@ pellets. The Division of Energy, Mineral, and Land Resources ("DEMLR") issued CovationBio
National Pollutant Discharge Elimination System ("NPDES") Stormwater Permit No. NCS000608 which
became effective on November 1, 2023. Permit Condition I.1.a provides a compliance schedule for
facilities with first-time permit coverage under the Stormwater Program. This is the Kinston Site's first-
time coverage under the Stormwater Program. Condition I.1.a states that"[s]econdary containment,as
specified in B-8 of[the] permit,shall be accomplished within 12 months of the effective date of the initial
permit issuance."
CovationBio submits this letter to request an additional 4 months to the original 12-month schedule.
Requesting a 16-month compliance timeframe, from the effective date of the permit, is a reasonable
request given the existing Kinston Site conditions, the size of the tanks, and the extensive design work
required to comply with the secondary containment requirements. Engineering design work has begun,
and this additional time can be dedicated to construction completion. As stated in 15A NCAC 02H
.0114(b)(3), this one-time extension of time by 4 months will not require public notice and other
procedural requirements.
