FALSIFICATION (pg 11) City of Greensboro SIU PERMIT Standard Conditions(September 2018 Version) Page I 1. PROHIBITED DISCHARGE STANDARDS The permittee shall comply with the Prohibited Discharge Standards included as Article II, Section 1 of the City of Greensboro Sewer Use and Pretreatment Ordinance. 2. REPRESENTATIVE SAMPLING Samples and measurements taken as required in this permit shall be representative of the volume and nature of the monitored discharge. All samples shall be taken at the monitoring point(s) specified in the permit. Monitoring points shall not be changed without notification to, and written approval by, the City of Greensboro Industrial Waste Section. 3. DEFINITIONS a. A composite sample for monitoring requirements, is the collection of: i. A minimum of four grab samples collected, manually or mechanically, at equally spaced time intervals during the entire discharge period on the sampling day [Time Composite]; or ii. A minimum of four grab samples collected, manually or mechanically, and proportioned according to discharge flow during the entire discharge period on the sampling day [Flow Proportional Composite]; or iii. The Industrial Waste Section may allow the Permittee to collect multiple grabs during a 24-hour period which are composited prior to analysis as allowed under 40 CFR 403.12(g)(3) ["Grab Composite Sample" for cyanide, totals phenols, sulfides, volatile organics, and oil & grease]. b. A daily monitoring frequency shall mean each working day on which a regulated wastewater discharge occurs. c. A grab sample for monitoring requirements is a single "dip and take" sample collected at a representative time and point in the discharge stream. d. An instantaneous measurement, for monitoring requirements is a single reading, observation, or measurement. e. A calendar day is defined as the period from midnight of one day until midnight of the next day. However, for purposes of this permit, any consecutive 24-hour period that reasonably represents the calendar day may be used for sampling and flow measurement. This period shall be designated by the SILT and should not deviate by more than::L 30 minutes. The site-specific sampling period during this calendar day will be defined in Section IV of this permit. f. The monthly average is defined as the arithmetic average of all samples collected during a calendar month for a particular parameter. One sample can constitute a monthly average. The daily average is defined as the arithmetic average of all samples collected for a particular parameter during a calendar day. h. A slug load is any discharge at a flow rate and/or pollutant concentration (including oxygen demanding pollutants, BOD, etc)which has a reasonable potential to cause interference or pass-through or in any other way violates the POTW's regulations, local limits, or Industrial User Permit conditions. i. A continuous flow measurement is a measure of discharge flow from the facility which occurs continually without interruption throughout the operating hours of the facility. Flow shall be monitored continually except for infrequent times when there may be no flow or for infrequent maintenance activities on the flow device. Site-specific flow measurement requirements are outlined in Section IV of this permit. j. A bypass is the intentional diversion of wastestreams from any portion of a user's pretreatment process or pretreatment facility. 4. SAMPLING PROCEDURES AND APPROVED TEST METHODS All measurements, sampling, tests and analyses of the characteristics or properties of wastewaters conducted to determine compliance with this permit shall be performed in accordance with the procedures outlined in 40 CFR Part 136 unless specified otherwise in the monitoring conditions of this permit. All user self-monitoring data submitted for compliance determination shall be performed by a laboratory certified by the State of North Carolina Division of Water Quality to conduct wastewater analysis for the appropriate parameters, or by an on-site SIU laboratory approved by the City of Greensboro Industrial Waste Section for the appropriate parameters. It is the responsibility of the SIU to ensure that the laboratory used is certified or approved for each parameter reported under this permit. All test procedures must produce minimum detection and reporting levels that are at or below the limits contained in this permit. All data generated must be reported down to the minimum detection or lower reporting level of the procedure. Any matrix interferences that cause reporting levels higher than permit limits must be documented to prove that every effort has been made to obtain the minimum detection levels. The Industrial Waste Section reserves the right to invalidate data and require resampling for parameters with detection levels higher than permit limits. City of Greensboro SIU PERMIT Standard Conditions(September 2018 Version) Page 3 5. ADDITIONAL MONITORING a. If the permittee monitors any pollutant at the sampling location designated in the permit more frequently than required by the permit, using the approved analytical methods in 40 CFR Part 136, the results of such monitoring shall be submitted to the City of Greensboro Industrial Waste Section. b. The City of Greensboro Industrial Waste Section may require more frequent monitoring or the monitoring of other pollutants not required in this permit by oral or written notification. 6. NONCOMPLIANCE a. Noncompliance with Permit Limits and Conditions The permittee shall report by telephone or email to the Industrial Waste Section [or POTW] within twenty-four(24)hours of receiving self-monitoring information or any other information that indicates that the facility is in non-compliance with any permit limitation or condition. The permittee shall repeat the sampling and analysis for the non- compliant parameter(s) and submit the results of the repeat analysis to the City of Greensboro Industrial Waste Section within 30 days after becoming aware of the violation. b. Noncompliance with Local Pollutant Allocations The permittee may conduct additional sampling and analyses for any Local Pollutant Allocation exceedance and the data will be used for compliance calculation purposes. The permittee shall conduct additional sampling and analyses as directed by the Industrial Waste Section on a case-by-case basis. 7. SIGNIFICANT NONCOMPLIANCE [SNC] The Federal Pretreatment Regulations [40 CFR Part 403.8(f)(2)(viii)] require that the City of Greensboro publish at least annually in a newspaper of general circulation that provides meaningful public notice within the jurisdiction served by the POTW, a list of industrial users which, at any time during the previous twelve (12) months, were in "significant noncompliance"with applicable pretreatment requirements. For the purposes of this provision, an SIU is in significant noncompliance [SNC] if its violation(s)meets one or more of the following criteria. Additionally, any violation by an Industrial User that meets the criteria in Parts (c), (d) or(h)shall also be SNC. a. Chronic violations of wastewater discharge limits, defined here as those in which sixty-six percent(66%) or more of all of the measurements taken for the same pollutant parameter(not including flow) during a six (6) month period exceed(by any magnitude) a numeric Pretreatment Standard or Requirement including instantaneous limits; City of Greensboro SIUPERMIT Standard Conditions(September 2018 Version) Page 4 b. Technical Review Criteria(TRC) Violations defined here as those in which thirty-three percent(33%) or more of all of the measurements taken for the same pollutant parameter during a six (6)month period equal or exceed the product of the numeric Pretreatment Standard or Requirement including instantaneous limits multiplied by the applicable TRC: (TRC = 1.4 for BOD, TSS, fats, oil and grease and 1.2 for all other pollutants except pH and flow). c. Any other violation of a Pretreatment Standard or Requirement(daily maximum, long-term average, instantaneous limit or narrative standard) that the Industrial Waste Section determines has caused alone, or in combination with other discharges, interference or pass-through (including endangering the health of POTW personnel or the general public); d. Any discharge of a pollutant that has caused imminent endangerment to human health, welfare, or to the environment or has resulted in the City's exercise of its emergency authority to halt or prevent such discharge; e. Failure to meet, within ninety(90) days after the schedule date, a compliance schedule milestone contained in a wastewater discharge permit or enforcement order for starting construction, completing construction or attaining final compliance; f. Failure to provide within forty-five (45) days after the due date, required reports, such as but not limited to, baseline monitoring reports, 90 day compliance reports, self-monitoring reports and reports on compliance with compliance schedules; g. Failure to accurately report noncompliance; or h. Any other violation or group of violations, which may include a violation of Best Management Practices, which the Industrial Waste Section determines will adversely affect the operation or implementation of the local pretreatment program. 8. For reports which are not mailed,postage prepaid, into a mail facility serviced by the United States Postal Service, the date of receipt of the report shall govern. Reports due on dates which fall on a Saturday, Sunday or legal holiday will be considered to be submitted on time if submitted on the next calendar day which is not a Saturday, Sunday or legal holiday. Reports submitted by e-mail will be accepted to meet report submittal dates. However an original signatory copy along with the required certification statement must follow within five (5) days of receipt of the e-mail copy. 9. MONITORING REPORTS AND SAMPLING REQUIREMENTS Self-monitoring reports shall be submitted as outlined in Section IV of this permit. For each measurement or sample taken to comply with this permit, the permittee shall record, maintain and make available to the City upon request: (a) the date, time and place of sampling (b) the person performing the sampling (c) the person (or laboratory)performing the analyses (d) the date analyses were performed (e) the results of all analyses A copy of the appropriate sample Chain-of-Custody document and a copy of the original laboratory report must accompany all self-monitoring reports. Self-monitoring samples required for this permit cannot be conducted simultaneously with POTW sampling events. Any self-monitoring samples (grab or composite) must be collected on a different calendar day from the POTW sampling event. Any sample aliquots obtained by the permittee from POTW sampling events shall be considered to be a"true split sample" and will be averaged for the POTW sample result if all QA/QC requirements are met. If no discharge occurs during a semi-annual reporting period(January 1-June 30 and July 1 —December 31), in which a sampling event was to have occurred, a letter documenting the "no discharge" status and the reasons for no discharge shall be submitted. 10. SEWER USE ORDINANCE COMPLIANCE The permittee shall read and retain this permit and a current copy of the City of Greensboro Sewer Use and Pretreatment Ordinance. Compliance with the Sewer Use Ordinance is also a condition of this permit. Permit conditions and limitations shall govern in any contradictions. DUTY TO COMPLY All discharges and activities authorized and/or required herein shall be in compliance with the terms and conditions of this permit. Any permit noncompliance constitutes a violation of the City of Greensboro Sewer Use and Pretreatment Ordinance and is grounds for possible enforcement action, including revocation of this permit. Revocation of this permit will require disposal of the process wastewater in some manner other than discharge into the sanitary sewer at the expense of the permittee. 12. TRANSFERABILITY This permit is NOT transferable and shall not be reassigned or transferred or sold to a new owner, new user, different premises or a new or changed operation without written approval of the City of Greensboro Industrial Waste Section. In the case of new ownership, a request for SIU Permit transfer/name change must be submitted within thirty(30) days of acquisition of the facility. 13. DUTY TO MITIGATE —PREVENTION OF ADVERSE IMPACT The permittee shall take all reasonable steps to minimize or prevent any discharge in violation of this permit that has a reasonable likelihood of adversely affecting human health, the POTW, the waters receiving the POTW's discharge, or the environment. It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity to maintain compliance with the conditions of the permit. 14. PERMIT RENEWAL The permittee is responsible for filing an application for reissuance of this permit at least 90 (ninety) days prior to its expiration. 15. SEVERABILITY The provisions of this permit are severable and, if any provision of this permit or the application of any provision of this permit to any circumstance is held invalid, the application of such provision to other circumstances and the remainder of this permit shall not be affected. 16. FEDERAL AND/OR STATE LAWS Nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance. Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties established in any applicable Federal and/or State law or regulation. FACILITIES OPERATION AND BYPASS The permittee shall at all times maintain in good working order and operate as efficiently as possible, all control facilities or pretreatment systems installed or used by the permittee to achieve compliance with the terms and conditions of this permit. Bypass of the treatment facilities is prohibited and the Industrial Waste Section may take enforcement action against a permittee for bypass, unless the bypass was approved in advance by the City of Greensboro Industrial Waste Section. 18. REMOVED SUBSTANCES Solids, sludge, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be disposed of in a manner so as to prevent any pollutant from such materials from entering the sanitary sewer system. Manifests or other records shall be maintained by the facility to document proper disposal of removed substances. The permittee is responsible for assuring its compliance with any requirements regarding the generation, treatment, storage and/or disposal of"Hazardous Waste" as defined under the Federal Resource Conservation and Recovery Act [RCRA]. 19. UPSET CONDITIONS An "upset" means an exceptional incident in which there is an unintentional and temporary noncompliance with the effluent limitations of this permit because of factors beyond the reasonable control of the permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed or inadequate treatment facilities, lack of preventative maintenance or careless or improper operation. An upset may constitute an affirmative defense for action brought for the noncompliance. The permittee has the burden of proof to provide evidence and demonstrate that none of the factors specifically listed above were responsible for the noncompliance. 20. DILUTION PROHIBITION The permittee shall not increase the use of potable process water or in any other way attempt to dilute the discharge as a partial or complete substitute for adequate treatment to achieve compliance with the limitations contained in this permit. [An exception can be made, with prior written approval of the Industrial Waste Section, for wastewaters that meet every ordinance,permit and allocation limitation except pH.] 21. REPORTS OF CHANGED CONDITIONS The permittee shall give notice to the City of Greensboro Industrial Waste Section 60 days prior to any plant expansion,plant closure, significant production increase (± 20%), or decrease (± 20%), or process modification which has the potential to result in new or substantially increased or decreased discharges or a change in the nature of the discharge. AUTHORIZATION TO CONSTRUCT PRETREATMENT FACILITY No construction of pretreatment facilities or additions/modifications to existing pretreatment facilities, shall begin until Final Plans and Specifications have been submitted to the City of Greensboro Industrial Waste Section and written approval and an Authorization to Construct [A to C] have been issued. Sampling and monitoring equipment(samplers, flow meters, flow measurement devices, in-line pH meters, sampling structures, etc.) are considered part of pretreatment facilities. An Authorization to Construct [A to C] issued by the City of Greensboro is not to be construed as an"approval" of the permittee's choice of processes or a guarantee the system will produce the desired results. An Authorization to Construct is only meant to give approval of the construction of a system for pretreatment purposes. 23. ACCIDENTAL DISCHARGES The permittee shall provide protection from accidental discharges of prohibited materials or other substances regulated by this permit. The permittee shall notify the City of Greensboro Industrial Waste Section immediately(within 2 hours of becoming aware of the event) of all discharges that could cause problems to the POTW including any slug loadings as defined by 40 CFR 403.5(b). A written follow-up report shall be submitted within five (5)business days, unless waived by the Industrial Waste Section. 24. AVAILABILITY OF RECORDS AND REPORTS The permittee shall retain records of all monitoring information, including all calibration and maintenance records as well as copies of reporting and information used to complete the application for this permit for at least three (3) years. All records that pertain to matters that are subject to any type of enforcement action shall be retained and preserved by the permittee until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired. Any user who is submitting information or a wastewater discharge permit/document application to the Industrial Waste Section may assert a confidentiality claim covering the information by placing on or attaching to the information at the time it is submitted to the IWS, a stamped or typed legend employing language such as "Trade Secret", "Proprietary" or "Company Confidential". Allegedly confidential portions of otherwise non-confidential documents should be clearly identified by the user and may be submitted separately to facilitate handling by the IWS. Except for data determined to be confidential under the Sewer Use and Pretreatment Ordinance, all reports prepared in accordance with terms of this permit shall be available for public inspection. Effluent data shall not be considered confidential. City of Greensboro SIUPERMIT Standard Conditions(September 2018 Version) Page 9 25. DUTY TO PROVIDE INFORMATION The permittee shall furnish to the Industrial Waste Section, within a reasonable time, any information which the City of Greensboro may request to determine whether cause exists for modifying, revoking and reissuing, or terminating this permit or to determine compliance with this permit. 26. SIGNATORY REQUIREMENTS All reports and information submitted pursuant to the requirements of this permit must be signed and certified by a ranking official or duly authorized designee of the permittee designated as the Signatory Official. [See Article I, Section 4 (49.) of the Greensboro Sewer Use and Pretreatment Ordinance for definition of"Signatory Official".] 27. PENALTIES The City of Greensboro Sewer Use Ordinance provides that any person who violates a permit condition is subject to a civil penalty not to exceed$25,000 dollars per day per violation. 28. RIGHT OF ENTRY The City of Greensboro shall have the right to enter the premises of any user to determine whether the user is complying with all requirements of this Ordinance and any wastewater discharge permit/document issued hereunder. Users shall allow the Industrial Waste Section ready access to all parts of the premises for the purposes of inspection, sampling, records examination and copying and the performance of any additional duties. The City of Greensboro Industrial Waste Section hereby defines any user who fails to admit City personnel for said purposes as being in Significant Noncompliance with pretreatment requirements. The permittee shall also allow right of entry to the staff of the Regional Administrator of the U. S. Environmental Protection Agency, the State of North Carolina Department of Environment and Natural Resources and/or their authorized representatives,upon the presentation of official credentials. 29. PERMIT MODIFICATION, REVOCATION, TERMINATION This permit may be modified, or alternatively, revoked and reissued at any time in order to: (a) comply with current Federal Categorical Pretreatment Standards (b) protect the receiving POTW from interference,pass-through, sludge disposal problems or exceedance of its design capacity (c) ensure compliance with the NPDES permit of the receiving POTW This permit may be terminated for cause in accordance with the requirements of the City of Greensboro Sewer Use and Pretreatment Ordinance. City of Greensboro SIUPERMIT Standard Conditions(September 2018 Version) Page 10 30. BOD/CBOD REOPENER In the event that influent monitoring of the City of Greensboro T. Z. Osborne POTW indicates that the POTW has reached seventy-five (75)percent of the Maximum Allowable Headworks Loading [MAHL] for Biochemical Oxygen Demand (BOD) or Carbonaceous Biochemical Oxygen Demand(CBOD), this permit may be reopened and BOD or CBOD limits may be imposed at that time. 31. PROPERTY RIGHTS This permit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal right, nor any infringement of Federal, State or local laws or regulations. 32. FALSIFICATION Any person who knowingly makes any false statement,representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this wastewater discharge permit, or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under this permit shall be in Significant Noncompliance (SNC)with pretreatment requirements.
