This letter transmits a Notice of Violation and assessment of civil penalty in the amount of$1,855.67($1,747.50 civil
penalty+$108.17 enforcement costs) against Buckeye S E Terminals LP.
This assessment is based upon the following facts: a review has been conducted of the Discharge Monitoring Report
(DMR) submitted by Buckeye S E Terminals LP for the month of December 2023. This review has shown the subject
facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit No.
NCO052311. The violations, which occurred in December 2023, are surmmarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that Buckeye S E Tenminals LP violated the tenors, conditions
or requirements of NPDES WW Permit No. NCO05231 I and G.S. 143-215.1(a)(6) in the manner and extent shown in
Attachment A. In accordance with the maximums established by G.S. 143-215.6A(a)(2),a civil penalty may be assessed
against any person who violates the terms, conditions or requirements of a permit required by G.S. 143-215.1(a).

Based upon the above findings of fact and conclusions of law,and in accordance with authority provided by the
Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources, 1, Michael
Hall, Regional Supervisor, Raleigh Regional Office hereby make the following civil penalty assessment against Buckeye
S E Terminals LP:
l 747.50 1 of L violations of G.S. 143-215.1(a)(6) and Permit No. NCO052311, by discharging waste water
into the waters of the State in violation of the Permit Monthly Average for Benzene

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and
Conclusions of Law and the factors set forth at G.S. 143B-282.l(b),which are:
(1) The degree and extent of harm to the natural resources of the State,to the public health,or to private property
resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which the Environmental
Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.
Within thirty(30)days of receipt of this notice, you must do one of the following:
(1) Submit payment of the penalty,OR
(2) Submit a written request for remission,OR
(3) Submit a written request for an administrative hearing
Option 1: Submit payment of the penalty:
Payment should be made directly to the order of the Department of Environmental Quality(do not inchide waiver
form). Payment of the penalty will not foreclose further enforcement action for any continuing or new violation(s).

Option 2: Submit a written request for remission or mitigation including a detailed justification for such
request:
Please be aware that a request for remission is limited to consideration of the five factors listed below as they may
relate to the reasonableness of the amount of the civil penalty assessed. Requesting remission is not the proper
procedure for contesting whether the violation(s)occurred or the accuracy of any of the factual statements contained in
the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing,
such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and
agreement that no factual or legal issues are in dispute. Please prepare a detailed statement that establishes why you
believe the civil penalty should be remitted,and submit it to the Division of Water Resources at the address listed below.
In determining whether a remission request will be approved, the following factors shall be considered:
(1) whether one or more of the civil penalty assessment factors in NCGS 14313-282.1(b) was wrongfully
applied to the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage resulting from the violation;
(3) whether the violation was inadvertent or a result of an accident;
(4) whether the violator had been assessed civil penalties for any previous violations; or
(5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial actions.
Please note that all evidence presented in support of your request for remission must be submitted in writing. The
Director of the Division of Water Resources will review your evidence and inform you of his decision in the matter of
your remission request. The response will provide details regarding the case status, directions for payment,and
provision for further appeal of the penalty to the Environmental Management Commission's Committee on Civil Penalty
Remissions(Committee). Please be advised that the Committee cannot consider information that was not part of the
original remission request considered by the Director. Therefore, it is very important that you prepare a complete and
thorough statement in support of your request for remission.
In order to request remission, you must complete and submit the enclosed"Request for Remission of Civil Penalties,
Waiver of Ripht_to an Administrative Hearing,and Stipulation of Facts" form within thirty(30)days of receipt of this
notice. The Division of Water Resources also requests that you complete and submit the enclosed"Justification for
Remission Request."

If you wish to contest any statement in the attached assessment document you must file a petition for an administrative
hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the petition with
the Office of Administrative Hearings within thirty(30)days of receipt of this notice. A petition is considered filed
when it is received in the Office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m.,except for official state
holidays. The petition may be filed by facsimile(fax)or electronic mail by an attached file(with restrictions) - provided

1) The degree and extent of harm to the natural resources of the State, to the public health,or to private
property resulting from the violation;
No documented damage to the environment, public health, or private property. However, discharging effluent exceeding
permit limits increases risk of adverse impacts to waters of the state.
2) The duration and gravity of the violation;
Benzene exceeded 2,681.5% over the monthly average limit on December 19, 2023
3) The effect on ground or surface water quantity or quality or on air quality;
The receiving stream for the authorized effluent discharge is an unnamed tributary to Mill Creek, classified as WS-IV; NSW
in the Neuse River Basin.The effects on water quantity or quality because of the permit limit exceedances include
increased risk to impact waters of the state.
4) The cost of rectifying the damage;
The cost of rectifying the damage was not documented.
5) The amount of money saved by noncompliance;
It is not believed that any money was saved by these violations. Any money saved by noncompliance is de-minimis.
6) Whether the violation was committed willfully or intentionally;
It is not believed that the violation was committed willfully or intentionally.

Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly,we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15,2007 (or as subsequently amended).
The final permit includes the following significant changes from the existing permit:
➢ A Monthly Average Limit of 1.I9 µg/L has been added for the Benzene parameter.The analysis for the
past 4 %years of Discharge Monitoring Report data for this facility showed a reasonable potential to
exceed the water quality standard for Benzene.
➢ Added flow rational equation [see Footnote 2 and Condition A. (2.)] to clarify how to calculate flow
based on total rainfall per unit area draining to the outfall using the Rational Method.
➢ Changed Oil and Grease(00556)parameter code to Oil and Grease,EPA Method 1664 [SGT-HEM]
(00552).
➢ Added units of measurement to the table [Section A. (1.)]
➢ Updated the WET testing condition,
➢ Regulatory citations have been added.
If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable
to you,you have the right to an adjudicatory hearing upon written request within thirty(30)days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes,and filed with the Office of Administrative Hearings(6714 Mail Service Center,
Raleigh,North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

1. The Permittee shall discharge no floating solids or foam.
2. The Permittee shall discharge no tank solids,tank bottom water,or tank rag layer.
3. Hydrostatic Tank Testing:The Permittee shall discharge no tank solids,no tank bottom-water,no tank rag-
layer;no tank[or pipe] contents,unless Benzene concentration tests less than 1.19 µg/L and Toluene
concentration tests less than 11 µg/L.

Petroleum Bulk Storage
The permittee shall conduct quarterly acute toxicity tests using protocols defined as definitive in E.P.A.
Document EPA/600/4-90/027 entitled"Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow(Pimephales promelas)24-hour
static test.Effluent samples for self-monitoring purposes must be obtained below all waste treatment. The tests
will be performed on a discharge event during each quarter(January-March,April-June,July-September,
October-December).
Should there be no discharge of flow from the facility during a quarter in which toxicity monitoring is required,
the pernuttee will complete the information located at the top of the aquatic toxicity(AT)test form indicating the
facility name,permit number,pipe number,county,and the month/year of the report with the notation of"No
Flow"in the comment area of the form.The report shall be submitted to the Environmental Sciences Section at
the address cited below.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests,as well as all dose/response data.Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream,this permit may be re-opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document,such as minimum control
organism survival and appropriate environmental controls,shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month of
the initial monitoring.
A.(4.) ELECTRONIC REPORTING-DISCHARGE MONITORING REPORTS
[NCGS 143-215.1 (b)]
Proposed federal regulations require electronic submittal of all discharge monitoring reports(DMRs)
and specify that,if a state does not establish a system to receive such submittals,then Permittees must
submit DMRs electronically to the Environmental Protection Agency(EPA). The Division intends to
adopt and implement these regulations in 2013.
NOTE: This special condition supplements or supersedes the following sections within Part 11 of this
permit(Standard Conditions for NPDES Permits):
• Section B.(11.) Signatory Requirements
• Section D.(2.) Reporting
• Section D.(6.) Records Retention
• Section E.(5.) Monitoring Reports
1. Reporting 18upersedes Part II,Section D.(2.)and Section E.(5.)(a)l
Beginning no later than 90 days from the effective date of this permit,the Permittee shall begin
reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report(eDMR)internet application.
Monitoring results obtained during the previous month(s)shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross-Media Electronic Reporting Regulation

(CROMERR),Permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing,and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a Penniee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband
access,then a temporary waiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1,2, 3)or
alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty(60)days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid
for twelve(12) months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the Permittee re-applies for and is granted a new temporary
waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility,on the last day of the month following the
commencement of discharge.
2. Si2natory Requirements Su lements Part M Section B. 11. and supersedes Section B. 11. d
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II,
Section B. (11.)(a) or by a duly authorized representative of that person as described in Part I1,
Section B. (i 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions,the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make
the following certification [40 CFR 122.22], NO OTHER STATEMENTS OF CERTIFICATION
WILL BE ACCEPTED:

direction or supervision in accordance with a system designed to assure that qualified personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the information,
the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I
am aware that there are significant penalties for submitting false information, including the
possibility offtnes and imprisonment for knowing violations."
3. Records Retention [Supplements Part H,Section D.(6)1
The Permittee shall retain records of ail Discharge Monitoring Reports,including eDM .submissions. These
records or copies shall be maintained for a period of at least 3 years from the date of the report. This period
may be extended by request of the Director at any time[40 CFR 122.41].
