A response to the request for additional information has not been provided and the application (DWR
Project #20240449) remains in complete in accordance with 15A NCAC 02H .0502. DWR will
continue to place the project on -hold until a response is received, and review can continue.
DWR understands the USACE has withdrawn the application. Pursuant to 40 CFR Part 121.6., DWR
is required to respond to a 401 application within the established federal Reasonable Period of Time,
180 days from receipt of the application. The federal reasonable period of time for DWR to review the
application will end on September 14, 2024. Please feel free to call or email me if you have any
additional questions.

As we discussed in the meeting, I require a couple of things. This project currently is incomplete until
we can determine all the impact both direct and indirect.
1. 1 need an overview of where the impacts are on the property. It is hard to determine the
location of the permit area in comparison to the overall site.
2. Since this appears to be a phased development and there is an opened ended road to the
North, we would need to see at least a conceptual drawing and of the overall project and
future areas that are going to using the same utilities and the permitted crossing. If the
northern area is to be constructed using separate utilities and access that are not associated
with the is crossing, then we could potentially look at it as its own separate single and
complete project. Keep in mind that future phased impact will be cumulative.
3. The road headed to the west on the north side of the project is open ended and detail will be
need on where that road is planned to go and if any impacts are associated with that road. As
shown in the conceptual map it will lead to another wetland crossing. This would need to be
looked at as well. If you wan to dead head the road you may do so but any change in the
future and extending that road will take on cumulative impacts form the proposed
development.
4. Please provide me details on why the grading is needed on the SW corner is needed and the
slope of this impact. We typically would like to see no more than 3:1 slope but would a
retaining wall be able to be used to avoid/reduce these impacts. Additionally, why is the
grading starting so far from the lot pad.
S. There are two open ended roads to the south that would need reasoning why they are they
way they are and how they are not leading to future development to the south and will not be
future crossings.
6. There are words showing a stormwater pond to the south. Please provide some detail on how
this will not be impacting wetlands.
Please Provide me with updated plans and comment addressing these issues by May 3, 2024. If you
