Thank you for your help throughout this process. Do you require any additional documentation or submittals to
complete the revision of the original permit? I am working with the Town of Highlands to complete their permitting
requirements for the project and they require 401/404 approval of the project prior to issuing a Land Disturbing Permit.

I have reviewed the proposed changes to the Highlands Basha Pond Repair project.
The Division of Water Resources does not object to the proposed changes.
The revised cold water release structure must meet the surface water quality temperature standard for class C waters
(15A NCAC 02B.0211).

Tim,
Please see the attached revised plans for the Highlands Basha Pond Repair project. The two major changes to the design
are the revised cold water return structure and the replacement of the concrete spillway with an erosion control matted
spillway. The revised cold water return structure has been design to carry the average daily flows, (approximately 5 cfs,
based on local flow data from Stream Stats) using the two 12" pvc inlets and up to a 2 -year storm through the open
top. The 12" pvc inlets will still draw water from the same elevation as the previous design. The emergency spillway
will utilize P550 permanent matting, as manufactured by North American Green. The spillway has been designed to
discharge a 100 -year storm.

The impacts will remain the same as the original design. The only other change, besides the ones described in my
original email, was the change in total acres of disturbance, which went up to 0.97 acres from the original 0.88: This was
however, the result ofthe area from the construction entrance to the project area not being included in the original
total acreage, and not because of the changes to the design. Please let me know if you have any other questions or
comments and I will look forward to hearing back from everyone regarding these modifications.
