It can, and I can reach out to our central office to adjust it if an individual certification is still needed based on #2. This will also lower the fee, so please wait to pay it until it's adjusted (we can't issue refunds). 2. The PCN may no longer be required by DEQ. Please review the thresholds of General Certification 4245 (attached) now that the project is complete, and if none were exceeded, then it can be your approval. If this is the case, please let me know that you'd like to withdraw the project and I can pass that email along to our central office. Joey and Mitchell, Our team is wrapping up work (it went quicker than expected) and this project turned out to be only 130 feet of streambank stabilization. I submitted the "after -the -fact" PCN online last Friday. Afew quick questions regarding the PCN: 1. Can this email serve to amend the PCN (DEQ and ACE) for this distance change from 175 ft to 130 ft? 2. Is a PCN still required by DEQ since it is below the 150 ft threshold of installed RIP RAP mentioned below. If not, let me know what actions I need to take if any. If still yes, then I will proceed with the $767 fee payment. 3. Based on Mitchell's statements below, it appears the PCN is still required by USACE. Let me know if incorrect. Hi Brendan, We rely on the Corps to determine when emergency work with after -the -fact permitting is appropriate, so after -the -fact notification would be appropriate for this project if the conditions Mitchell mentioned are true. Measures should be taken during work to prevent an exceedance of water quality standards, such as following the conditions listed in General Certification 4245 for bank stabilization activities (attached). It looks like this project will require an Individual Certification if 150 feet or more of riprap will be installed, so we'll also need a copy of the PCN. It is located in Enka at the Buncombe County Sports Park along Hominy Creek. The sewer line handles much of the serviced properties in the western part of Buncombe County. Is DE agreeable to an after the fact notification for this emergency streambank stabilization? The streambank restoration via RIP/RAP w/fabric could be approximately 150-250 ft in length. Hello Mike, Thank you for emailing this information. Nationwide permit 13 is the applicable NWP for this project. Per regional conduction 4, this proposed bank stabilization work will require authorization as it is located within 0.5 mile of Hominy Creek. The Corp would accept an after -the -fact PCN for NWP 13 for this MSD bank stabilization project if there is a risk of imminent bank failure that requires and immediate action to stabilize this bank and prevent failure of the line. We have a 27" interceptor sewer line located in this stream bank that is being threatened by the erosion. MSD needs to take timely action to protect this sewer. Attached is a map and a few current photos of the subject area. As discussed I would like to possibly meet you at this site to discuss the measures we need to take.
