The Division issued NPDES permit NCO083348 to the Town of Smithfield on September 3, 2003. The
Division has received your September 27, 2005 proposal for permit modification at the subject facility. In your
letter, you requested the instream monitoring for Turbidity be removed from the permit
In accordance with your permit modification request and our review, the Division is forwarding herewith a
modification to the subject permit. Enclosed please find the modified permit page. This page should be inserted into
your permit and the old one discarded. This permit modification is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this permit is not transferable. This permit does not affect the legal requirement to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division of
Land Resources, Coastal Area Management Act or any other Federal or Local government permit that may be
required.

A. (1) EFFLUENT MUTATIONS AND MONITORING REQUIREMENTS
During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is
authorized to discharge filter backwash from outfall 001. Such discharges shall be limited and monitored by
the Permittee as specified below:

1. Upstream = at least 50 feet upstream from the outfall. Downstream = at least 50 feet downstream from the
outfall.
2. Limit takes effect April 1, 2005. Until the limit takes effect, the permittee shall monitor TRC (with no
effluent limit).
3. See A. (2) for Total Nitrogen monitoring and reporting requirements.
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

SUBJECT: REQUEST FOR MONITORING WAIVER
Dear Mr. Vinzani,

I am writing this letter to request a waiver for the weekly upstream and downstream monitoring as
required in our current NPDES Permit #NC0083348. Our current permit requirement states that "The
discharge from this facility shall not cause turbidity in the receiving stream to exceed 50 NTU. Since
January 2001 there have only been four violations of the turbidity requirements. Each time, the
increase in stream turbidity was due to heavy rainfall and not due to the effluent turbidity, which has
remained consistently low. The Smithfield Water Treatment Plant has sufficient data that has shown
during the past five years and prior that the discharge turbidity levels have not caused a negative impact
on the turbidity levels in Buffalo Creek. If you have any questions regarding this request, please contact
