Atlas Environmental completed a stream and wetland delineation on January 30, 2024. A preliminary jurisdictional determination was submitted to the U.S. Army Corps of Engineers on January 18, 2024. The preliminary jurisdictional determination delineation concurrence was issued on February 21, 2024. There are a total of four streams and six wetlands within the review area. The purpose of this project is for the construction of a residential development. There will be 142 single family lots, infrastructure roads and utilities, and three SCM. The development will require three permanent unavoidable impact to Waters of the United States. Impact S1 consists of 141 linear feet (-0.0109 acre) of perennial stream impact of CH 200 for the installation of a culvert for a road crossing. Impacts S2 consists of 109 linear feet (-0.0087 acres) of perennial stream impact of CH 100 for the installation of a culvert for a road crossing. Impact W1 consists of 0.04 acres of fill for grading for a road crossing and installation of a culvert. No mitigation will be required for this project as stream impacts are less than 0.02 acre. The site has been designed and engineered to avoid and minimize impacts to the greatest extent possible. Approximately 79% of wetlands are being avoided and preserved. Approximately 91 % of the streams are being avoided and preserved. Additionally, the perennial streams have been placed in a 50-foot buffer. There is a no FEMA floodplain on site. Atlas submitted a report of findings to the North Carolina Department of Natural and Cultural Resources on January 26, 2024. The State Historic Preservation Office (SHPO) provided their comment letter on February 29, 2024 and assigned ER-24-0332 as the their project number. SHPO does not have any comment related to development of the project site. Atlas has not submitted a report of findings to the United States Fish and Wildlife Service (FWS). Atlas Environmental staff was onsite January 03, 2024 and assessed the presence of four streams and six wetlands. All wetlands are abutting wetlands. CH 100 was observed as perennial throughout the entire Eastern reach of the review area and flows onsite for approximately 1351 linear feet (0.130 acre). CH 100 flows onsite along the Northern portion of the review area and generally flows South and then offsite along the Eastern boundary. CH 200 was observed as perennial for approximately 898 linear feet (0.088 acre). CH 200 flows onsite along the Western portion of the review area and generally flows in an Eastern direction until it is a confluence with CH 100. CH 300 flows as intermittent briefly before becoming perennial, totaling approximately 526 linear feet (0.028 acre). CH 300 originates onsite along the Southern boundary of the review area and flows offsite along the Eastern boundary. CH 400 flows onsite along the Southern boundary of the review area. CH 400 flows for approximately 233 linear feet (0.005 acre) and flows north until its confluence with CH 300. WL 1000 (0.130 acre) and WL 1100 (0.002 acre) abuts CH 100, WL 2000 (0.006 acre) and WL 2100 (0.053 acre) abuts CH 2O0, WL 3000 (0.001 acre) and WL 3100 (0.01 acre) abuts CH 300. WL 1000 is a forested wetland. WL 1100, WL 2000, WL 2100, WL 3000, and WL 3100 are shrub -scrub wetlands. Enclosed are the necessary jurisdictional determination documents and additional information.
