Huff and Sutton: On September 21, 2007, the Division of Water Quality (DWQ) received your application dated September 14, 2007 to permanently impact 0.474 acres and temporarily impact 0.479 acres of wetlands for your proposed subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Justification (Avoidance and Minimization) In your previous application you showed all the road crossings within the subdivision as being bridged with the bulk of the impacts coming from the entrance road off NC Hwy 210. In this application some of these crossings within the proposed Subdivision are being proposed for fill. Please provide justification for this change. Mitigation You will be required by DWQ to place a deed notification/deed restriction on all the remaining wetlands on the project. Please provide a notarized copy of the draft deed notification or restrictive covenants (if required by the Corps) that, at a minimum, notify future lot owners that there are wetlands on the property, which are protected by the NC Division of Water Quality and the US Army Corps of Engineers. If you plan on preserving the remaining wetlands on the tract, please provide a notarized copy of the draft language that will accomplish preservation. Example language for the deed notification is available on our website httn://h2o.enr.state.nc.us/ncwetlands/certs.html. 3. NPDES General Stormwater Permit No. NCGOI0000 Monitoring Requirements Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required. Owner Change The Wilmington Regional Office of the DWQ received a letter on October 23, 2007 from Mr. Ralph Huff stating that he had sold the property to Wakefield Development Company, LLC. Due to this change of applicant a new application must be submitted to the 401 Wetlands Unit in Raleigh with the appropriate fees. Please provide a letter or a-mail requesting the withdrawal of this project. 5. Avoidance and Minimization Impacts to wetland labeled Wetland Impact # 1 shows the entrance road to the property, is there any way that the road alignment shift a little further North to avoid wetland impacts. Please explain. Impacts to wetlands labeled Wetland Impact #5 show the wetland impact outside of the Easement, is this a temporary impact or can this impact be minimized? Impacts associated with Wetland Crossing # 5 do not show a detail of the pipe outlet structure (i.e. will rip rap be needed at the pipe outlets to prevent erosion) and will these structure impact additional wetlands? Ralph Huff III Billy Sutton DWQ Project # 07 0298 Ver 2 October 25, 2007 Impacts associated with Wetland Crossing # 7 do not show a detail of the pipe outlet structure (i.e. will rip rap be needed at the pipe outlets to prevent erosion) and will these structure impact additional wetlands? In addition, the cross section of the proposed road crossing shows less impact on the west side (where no sidewalk is proposed) of the crossing than what is shown on the plan view. Please explain this inconsistency, minimize the impact or correct the drawings. Impacts to the bridge spans (#2, #3, #4 and #8) do not indicate if a temporary impact will be necessary on both sides of the spans for the construction of these spans. If this is not necessary, please provide a narrative on how this construction will be accomplished. 6. Amenity Ponds The proposed amenity ponds on the interior of the property cannot be allowed to drain/impact the adjacent wetlands. Please provide documentation that addresses this issue. Otherwise DWQ may require that monitoring wells be installed and yearly reports provided to DWQ for five years. You also will need to show whether these ponds have an outlet structure and provide their location and details. 7. Stormwater Ponds Please provide details of the outlet structures (i.e. level spreaders) for these ponds. Providing the location of the outlet structure and detailing that no additional wetland impacts will occur. 7. Overall Exhibit Map Please provide an overall map where all the lot numbers are legible. Please copy me on all information you provide to Bard Shaver. Please respond within three weeks of the date of this letter by sending this information to me in writing and 5 copies to Ian McMillan of the DWQ 401 Oversight and Express Office at 1650 Mail Service Center, Raleigh, NC 27699-1650. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
