Oil and grease samples shall be skimmed from the surface of a quiescent (calm water) zone. 3. • Acute Toxicity (Fathead Minnow), 24-hour P/F at 90%, annually. See Special Condition A. (2.). Toxicity test sample shall be collected concurrently with samples for monitoring requirements. There shall be no discharge of floating solids or foam visible in other than trace amounts. There shall be no direct discharge of tank solids, tank bottom water, or the rag layer. There shall be no direct discharge of tank (or pipe) contents following hydrostatic testing unless benzene concentration is less than 1.19 µg/L and toluene concentration is less than 11 µg/L. A. (2) ACUTE TOXICITY MONITORING (ANNUAL) The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A. Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annual toxicity test must be performed by June 30. Should there be no discharge of flow from the facility during the six month period January 1-June 30, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county and in the comments section indicate "No Flow for January 1-June 30, {calendar yearb" The report must be signed and submitted to the Environmental Sciences Section at the address noted below. If no discharge event occurs from January 1-June 30, vet a discharge event occurs from July 1- December 31, then the facility must perform toxicity monitoring and report the data as noted below. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-: opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The storage area and loading area stormwater, water softener wastewater, and boiler blowdown and condensate are collected in a 1,000,000 gallon retention pond. The outfall discharges into an unnamed tributary into the East Fork Deep River, a class WS IV* stream, in the Cape Fear River Basin. The * classification designate this stream as part of the Randleman Lake Critical Supply Watershed and requires rules 15A NCAC 2B .0248,. .0249, .0250, and .0251 be applied. The receiving stream is impaired for fecal coliform and turbidity. There is no treatment process associated with the retention pond operation or other pond influent. A manual valve is used to control the release from the pond to the permitted outfall. Based on an established value setting with a defined flow rate and known discharge time, the total volume for each discharge event is calculate and reported. The facility uses an internal SOP to manage pond level and pond sampling. The existing 1,000,000 gallon retention pond was expanded in 2006 from 400,000 gallons. While expanding the pond, the pond's outfall piping configuration was revamped. Associated Asphalt LLC took ownership in April 2004. Prior to 2004 there had been several ownership changes. This facility had previously stored ammonium sulfate and aviation fuel. A distillation operation was initially part of the original facility and was shut down prior to 2000. The original facility included two designated outfalls. Earlier permits included limits and Fact Sheet NPDES NC00 74241 Page 1 of 3 monitoring as a result of the distillation process. A waste load allocation was performed in 1991. The prior and existing permit conditions and limits were modified to reflect the 2005 SOP for Bulk Storage Terminals and the Cape Fear Basin strategies for Deep River. As part of the last renewal in 2006, the ethylbenzene and MTBE monitoring were reduced to quarterly. Also, the EPA Method 623 monitoring requirement was removed. COMPLIANCE Since 2007 there were 13 monitoring frequency violations and one TSS limit violations. No fines have been assessed to date. PERMITTING STRATEGY Reasonable Potential Analysis (RPA) The Division conducted EPA -recommended analyses to determine the reasonable potential for total phenols, based on DMR data from March 2009 to May 2011. Results suggest no reasonable potential. Data Review DMRs were reviewed for the period of March 2009 to May 2011. The facility passed the 4 toxicity tests conducted during the current permit cycle began in 2007. Will continue annual acute toxicity testing. Other Evaluations The estimated portion of water softener wastewater in the discharge, on an event bases is less than 5%, on a monthly average bases is less than 1%. There are other process wastewater streams associated with this discharge. The 2005 Petroleum Bulk Storage Permitting Strategy will continue to be applied. Monthly monitoring for conductivity and pH with a limit range of 6.0 S.0 to 9.0 S.0 will be added to better define the effluent characteristics and meet expected surface water quality standards The available methods stated in A.(1) footnote for calculating the reported discharge flow was amended to include the method historically accepted by the Division for this facility. Quarterly turbidity monitoring was added to collect data for future evaluation and address the receiving stream impairment for turbidity. The Division statement about stream impairment was included in both the draft and final permit cover letters. SUMMARY OF PROPOSED CHANGES In keeping with Division policies the following will be incorporated into the permit: • Added monthly pH monitoring with limit range. • Added monthly conductivity. • Added quarterly turbidity monitoring. A brief rationale for the inclusion of these contaminants can be found in Appendix A. Other toxicants were not included because they were either not detected or rarely detected in the effluent data surveyed. However, if a pollutant specific problem is detected in the receiving stream, effluent or source water then a mcautoring requirement may be added for that parameter. Likewise, if data indicate that a pollutant is not present in the facility's discharge, that parameter may be dropped from the requirements. Limits should be added if the facility shows reasonable potential to exceed water quality standards for toxicants.
