This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following conditions listed in the DRAFT permit have remained in this FINAL permit: • Addition of a summer effluent limit for ammonia, with a 2/Month monitoring frequency. • Addition of a winter effluent monthly monitoring requirement for ammonia. • Monitoring frequency for TRC was changed from Weekly to 2/Week based on state regulations (15 A NCAC 2B.0500) for a Class I facility. • Addition of quarterly monitoring for total nitrogen and total phosphorus, so that a nutrient management strategy for the Yadkin River Basin can be developed during the next permit cycle. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. Facility discharges to an unnamed trib to Warrior Creek (WS-IV), which then discharges to Kerr Scott Reservoir. Warrior Creek is not listed in the 1998 303(d) list. Kerr Scott Reservoir was determined to be oligotrophic and fully supporting its designated uses (Basin Plan 1998). Previous permit included secondary limits for BOD/TSS, and no monitoring for ammonia. IWC calculation indicates potential for NH3 toxicity during summer; therefore, an ammonia limit of 12.7 mg-N/1 is proposed for summer season, with monitoring -only during winter. WSRegion- the permittee has the option of the NH3 limit or a quarterly chronic toxicity test. Please discuss with permittee, and indicate whether any compliance schedule will be needed. Unfortunately, there is no NH3 data to evaluate their potential for compliance. If they opt for a toxicity test, they might have to add dechlor to pass test since daily max TRC concentrations have been as high as 3.5 mg/l. Nutrient monitoring (TN,TP) is proposed on quarterly basis, so that a nutrient management strategy for the entire Yadkin Basin can be developed during the next permitting cycle. DMR data for 11/96-10/97 showed no monthly average or daily max violations. In 1998, no violations were noted. Monthly BOD is averaging from 3-11 mg/l, and TSS is averaging 3-7 mg/l. TRC daily max concentrations are high (up to 3.5 mg/1). Although there is no TRC limit, the calculated allowable effluent level is 0.27 mg/l, therefore WSRegion might want to discuss the chlorine overdosing with permittee. Monthly flow averages 0.002 MGD (0.003 limit). No instream monitoring required. Winston-Salem Region conducted a Compliance Sampling Inspection in January 1997 and reported the two surface sand filters appeared well -maintained and no problems were noted. Last WLA was conducted in 1988.
