PROJECT SUMMARY: The applicant proposes to construct a pier between two adjacent parcels extending 502 ft. below NHW with a gazebo, open platform, finger piers and three (3) boatlifts for a total of three (3) formalized slips along the AIWW in Sunset Beach. 9. NARRATIVE DESCRIPTION: The proposed project is located at 805 Shoreline Dr. W (lot 15) and the adjacent parcel ID 255LA01501 (lot 16) located in Sunset Beach, Brunswick County. Existing structures on the .91-acre parcels include a single-family residence at 805 Shoreline Drive W and a vacant lot at parcel ID 255LA01501. The south facing properties are located approximately 10' above normal high water (NHW) and is vegetated with typical coastal -plain tree species and landscaping ornamentals. The properties have a combined shoreline of approximately 122 linear feet of shoreline frontage along the southern edge and is stabilized with natural vegetation. The adjacent riparian parcel to the east is 801 Shoreline Dr. W which has a single-family home and existing docking facility currently under review (PA-1283). The adjacent riparian parcel to the west is 805 Shoreline Dr. W which has a single-family home and docking facility. To the north of the applicant's parcel is Shoreline Dr. W. No Section 404-type wetlands appear present within the project area. High marsh, primarily consisting of Black Needlerush (Juncus roemerianus) and Salt Meadow Cordgrass (Spartina patens), extends approximately 67' waterward of high ground and transitions to approximately 312' of Smooth Cordgrass (Spartina altemiflora). The width of the waterbody measures approximately 585' from marsh to marsh in the vicinity of the project area. The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROJECT DESCRIPTION: The applicant proposes to construct a pier between two adjacent parcels extending 502 ft. below NHW with a gazebo, open platform, finger piers and three (3) boatlifts for a total of three (3) formalized slips along the AIWW in Sunset Beach. The proposed 6' x 545' access pier would start on the high ground and extend south across approximately 70' of high marsh. From the NHW line, the access pier would continue south approximately 312' over a stand of Smooth Cord Grass (Spartina altemiflora). From the waterward edge of Coastal Wetlands, the access pier would extend approximately 166' into the AIWW before reaching the proposed 30' x 3' finger pier extending to the west, which would then turn 90 degrees into a proposed 3' x 22' finger pier. To the west of the proposed 3'x22' finger pier would be a proposed 15'x15' open boatlift (slip 1) and to the east of the proposed finger pier would be two proposed 13'x13' open boat lifts (slips 2 &3). At the terminal end of the pier a 20' x 9' gazebo and a 19' x 9' open platform to the east are proposed forming an ' L" head (see Sheets 2 and 3 of 4). The applicant states that extending the docking facility to the newly outer established pierhead line, as adjacent piers have already done and is currently Field Investigation Report: Kelley Frink DCM Major Permit Page 12 in review for the immediately adjacent property (801 Shoreline Drive), would allow access to navigable water depths throughout the tidal range and minimize soft -bottom impacts to the Primary Nursery Area (PNA). The proposed pier would extend approximately 190' into the AIWW, which is approximately 1/3 width of the waterbody. The property has approximately 122 linear feet of shoreline and the proposed design appears to remain within the applicant's area of riparian access as defined by the established eastern riparian line (State Permit No. 77-18) and the proposed revised riparian line to the west. There were no objections from the western riparian neighbor. The proposed docking facility would encroach into both adjacent 15 ft. riparian setbacks and waivers have been obtained by the applicant. The applicant's design extends waterward of the'/4 width limit but would meet the 1/3 width and would be approximately 20 ft. landward of the USACE Federal Channel Setback (See Sheet 3 of 4). The applicant proposes to extend to the pierhead line established between 709 Shoreline Dr. W (State Permit 922-18) and 811 Shoreline Dr. W (GP# 66385D), and the current proposed pier at 801 Shoreline Drive W. Water depths in the vicinity of the proposed boat lifts range from -1.1 ft. to --2.5 ft. at NLW. To reduce impacts to the soft bottom habitat the applicant proposed to install limit switched on both boatlifts at 18" (see Narrative). As proposed, the docking facility would extend approximately 190' from the edge of Coastal Wetlands to 32% of the waterbody width. 11. ANTICIPATED IMPACTS: The proposed docking facility would result in the shading of approximately 2,700 sq. ft. of Coastal Wetlands and the incorporation of approximately 1,390 sq. ft. of open Estuarine Waters and Public Trust Area. As proposed, the docking facility would be located in an area with water depths ranging from -1.1' NLW to -2.5' NLW within a Primary Nursery Area. The applicant has proposed to set limit switches to 18" above the substrate on the boatlifts to reduce soft bottom impacts. The proposal would be past the immediately adjacent pierhead line, but in line with outer piers along the same shoreline for similar use. The proposed development would be located within both adjacent 15' riparian corridor setbacks. The proposed docking facility would be constructed at the outer established pierhead line which is beyond the 1/4 waterbody width but at the 1/3 waterbody width and landward of the USACE Federal Channel Setback, the location would allow for increased water depths within the shallow bottom PNA. Minor increases in turbidity should be expected during piling installation. Lot 16 is an undeveloped lot that has been cleared and stabilized with grass. Existing Land Uses: Both lots are private residential lots. Existing Wastewater Treatment/Disposal: Municipal Solid Waste/Fish Offal/Trash Disposal: Municipal Use and Daily Operations of the Project When Complete Proposed Development Purpose: The purpose of the proposed docking facility is to gain access to the AIWW for recreational activities. Buildings/Facilities/U nits/Structures: There are no upland facilities proposed. Use & Daily Operations: The applicant intends to use the proposed docking facility for private recreational use including boating, fishing, and entertainment. Construction Methodology & Equipment: Marine -grade pilings will be installed using a water jet pump system or vibratory hammer. Standard electrical power tools will be used for the construction of the docking facility. All equipment will be stored on site. Development Activities Narrative Specifics: The applicant proposes to construct a shared 3-slip docking facility at the est. pierhead line on the AIWW in Sunset Beach. The docking facility will consist of a 6'x545' fixed pier, 9'x19' open platform, 9'x20' gazebo, 3'x22' finger pier, 3'x30 finger pier, (2) 13'x13' boatlifts, and a 15'x15' boatlift. The project is located in waters classified SA:HQW by DWR and are designated PNA by DMF. This section of AIWW is closed to the harvest of shellfish. The applicant's shared parcels have approx. 122ft. of combined shoreline at NHW and the waterbody width is approx. 585' from marsh to marsh. Application Narrative: Tidal Creek Permitting has been retained bythe property owners of 805 Shoreline Dr W and Lot 16, Samuel & Kelley Frink (herein referred to as the "Applicant"), to secure a NC Division of Coastal Management CAMA Major Permit, for a private 4-slip docking facility that is proposed to extend greater than 400 linear feet waterward of the Normal High -Water line along the AIWW in Sunset Beach. As proposed, the applicant intends to construct a 6' x 545' fixed pier, originating from the shared property line between 805 Shoreline & Lot 16, extending south towards the AIWW. The first 67' of the proposed fixed pier would cross over high -marsh coastal wetlands including black needlerush, spike grass, and smooth cordgrass. The next 312' of the fixed pier would extend from NHW, over low -marsh coastal wetlands composed of a dense swath of smooth cordgrass. The remaining 166' of fixed pier would extend over open water and lead into a proposed 20'x9' gazebo (180 sq ft) and a proposed 19'x9' open platform (171 sq ft) to the east of the gazebo. At the landward edge of the proposed gazebo, a proposed 3'x30' finger pier (90 sq ft) would extend west and then turn 90 degrees into a proposed 3'x22' finger pier (66 sq ft) that would extend out to the established pierhead line between 811 Shoreline Dr W (GP #66385) and 709 Shoreline Dr W (Major #22-18). To the west of the proposed 3'x22' finger pier would be a proposed 15'x15' open boatlift (slip 1) and to the east of the proposed finger pier would be two proposed 13'x13' open boat lifts (slips 2 &3). Water depths on the landward edge of the proposed boatlifts range from -1.1' NLW to-1.6' NLW and the waterward edge of the proposed lifts showed -2.5' NLW during the low tide visit on 2/26/24 at 3:45pm. As proposed, the docking facility would extend approximately 19' waterward of the immediately adjacent pierhead line between 719 and 807 Shoreline Dr W, to reach deeper water at the established pierhead line between 709 and 811 Shoreline Dr W. The waterward end of the proposed docking facility would terminate approximately 5' landward of the 1/3 waterbody width (195') and approximately 20' landward of the USACE Federal Channel Setback. The proposed docking facility would exceed the 1/4 width but not the 1/3 width, extending approximately 190' waterward of the edge of coastal wetlands to 32% of the waterbody (585' total waterbody width). The proposed eastern riparian corridor line is a continuation of using the deeded parcel line out to the open water of the AIWW, as documented in Major Permit #77-18. The proposed western riparian corridor line is a revision of the surveyed riparian line for 807 Shoreline Dr, found in GP#25203. As proposed, adjusting the western riparian line would shift the riparian line 10' to the west, to give the applicant a riparian corridor width of approx. 62' linear ft. at the established pierhead line. The revised western riparian line was discussed with DCM on 3/8/24 and with the adjacent property owner, Martha Schofield of 807 Shoreline Dr W, on 3/11/24, with no objections from either party. The proposed docking facility would encroach into both adjacent 15' riparian setbacks. The western edge of the proposed docking facilitywould be located approximate ly46' away from the existing docking facility at 807 Shoreline Dr W. The eastern edge of the proposed docking facility would be located approximately20' away from the proposed docking facility at 801 Shoreline Dr W which is also currently under review (PA-1283). Sunset Beach, North Carolina. On August 11, 1999, Jerry Parker issued a permit for a covered boat lift beside my existing dock structure. Because of the many hurricanes in particular "Floyd" we were unable to complete the covered portion before the permit expired. We managed to get the lift and pilings installed for the cover. Since it was winter we felt the best course of action was to wait until summer to finish the roof over the lift. Sometime in the fall of 1999,1 spoke with you and you said that you would probably need to make a site visit in order to grant another permit to finish the installation. Please let me know if I will need to get my neighbors to sign another riparian notification form. Both of my neighbors have done this for the dock and then the lift and covering. I am enclosing a copy of their permission. Please let me know if a site visit is necessary and if so, set a time that I can meet you there.
