Dear Ms. Chapman:
On behalf of the Town of Cary, please find enclosed, two (2) copies of the following
items regarding the above referenced project for your review.

This project was originally permitted in February 2007 as DWQ Project # 2007-0017
providing authorization to impact some Zone 2 buffer areas associated with the project.
Construction began ~on the project earlier this year and it is nearly complete. More
specifically, all structures are installed and the only remaining work is the site items (e.g.,
concrete pad, asphalt drive, minor grading, etc.). Recently it was discovered through a
Town quality control check that the pump station site was located within a riparian buffer
that encroaches onto the southern portion of the site.
Given the space constraints of the site as explained in the variance request form, the
options for eliminating/minimizing the buffer impacts are limited. Although some
disturbance has already been done to Zone 1 of the buffer, worked has since been
stopped. All proposed work in this zone has been eliminated and this area will be
restored to original grade with riparian plantings. In Zone 2, we have eliminated some of
the proposed impervious areas (e.g., driveway and stone ground cover) within the pump
station site to keep these areas to a minimum but some impervious around the pump
station structures still remains.
We have provided two (2) site plan options with this variance request. Both present an
option for tying the proposed grade to the existing grade before entering into Zone 1.
Option no. 1 includes the use of a retaining wall along the Zone 1 boundary to
120 North Boylan Avenue accomplish this. The use of the wall would allow a 2:1 slope to be established, which can

approximately 70 sq. ft. of impervious area in Zone 2. Option no. 2 eliminates the wall
but creates slopes of approximately 1.4:1, which would need to be stabilized (e.g., rip-

as it assumes the retaining wall option. We request that Division of Water Quality
evaluate both options and determine which would best support the variance request.
We have applied to the NCEEP for an In-Lieu payment for the impervious amount in
Zone 2 and hope to receive this approval in the very near future. Upon receipt we will
forward the approval letter to you.
As indicated above, this project is currently under construction. Thus, an expeditious
review would be greatly appreciated so that we might avoid any delay claims from the
contractor. We look forward to your response. In the meantime, if you should have any

Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat
map or site plan) to accurately delineate the boundaries of the land to be utilized in carrying
out the activity, the location and dimension of any disturbance in the riparian buffers
associated with the activity, and the extent of riparian buffers on the land. Include the area
of buffer impact in ftZ.]:
Construction of a new wastewater pumping station and force main to serve the Terrington
subdivision and upstream drainage basin. The total buffer impact to Zone 2 only will be 2 550 sf
including grading and impervious cover._ The_total impervious area will be 375 sf. Note. that no,,

State reasons why this plan for the proposed activity cannot be practically accomplished,
reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers:
The pump station is surrounded by environmental features on all sides (i e. buffers wetland,
and a stormwater BMP . There is no other location on-site that would eliminate the disturbance.
Note that some reductions of proposed improvements have occurred They are: 1)the asphalt
drive has been shortened to avoid the buffer, 2) the stone groundcover within the site has been
eliminated within the buffer.

3. Description of any best management practices to be used to control impacts associated with
the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow,
re-planting vegetation or enhancement of existing vegetation, etc.):
The buffer outside the proposed fence will be replanted with riparian plantings to ensure re-
establishment of the buffer. All stormwater will enter the buffer diffused (i.e. ,sheet flow). Note that
all runoff from impervious surfaces will drain into a new dry detention basin before being discharged
into an existing ditch. Additionally, a nitrogen off-set payment has already been made to the NCEEP
for the entire site (including the impervious surfaces within the buffer).
4. Please provide an explanation of the following:
(1) The practical difficulties or hardships that would result from the strict application of this
Rule.
B strict a lication of this rule the um station would have to be relocated to another site down-
stream onto land that is not owned by the Town or within the Town limits. The Swift Creek Land
Mana ement Plan recludes the Town from extendin an further south downstream than the site
where the pump station is located. Additionally all the infrastructure at the site (already constructed)
would have to be relocated. This would be extremely time Consuming and costly.
(2) How these difficulties or hardships result from conditions that are unique to the property
involved.
With environmental features on all 4 sides of the site, there is limited space to locate a pump
station. The hardships described above are a result of this limited space. Note that we have been
able to avoid disturbance to other features, except exempt buffer impacts with the force main and
_impacts in the wetlands for the force main approved under Nationwide 12. _ _
The space required for the pump station and the limited site has made the buffer impact necessary.
(3) If economic hardship is the major consideration, then include a specific explanation of the
economic hardships and the proportion of the hardship to the entire value of the project.
Economic hardship resulting from a relocation is a major consideration. The total project cost is
approximately $900,000. The relocation would affect approximately 73% of this cost. Most of this
cost has already been paid to the contractor for portions of the station that have already been built.

Therefore, relocation_would result in a repayment of a large portion of dollars that have already been
paid. Additionally, a new site would have to be acquired, project redesign cost incurred, and permits modified.

easements, that the easements will run with the land, that the easements cannot be changed or

Bioretention Inspection and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.
Important inspection and maintenance procedures:
- Immediately after the bioretention cell is established, the plants will be watered
twice weekly if needed until the plants become established (commonly six
weeks).
- Snow, mulch or any other material will NEVER be piled on the surface of the
bioretention cell
- Heavy equipment will NEVER be driven over the bioretention cell.
- Special care will be taken to prevent sediment from entering the bioretention cell.
- Once a year, a soil test of the soil media will be conducted.
After the bioretention cell is established, I will inspect it once a month and within 24
hours after every storm event greater than 1.0 inches (or 1.5 inches if in a Coastal
County). Records of inspection and maintenance will be kept in a known set location
and will be available upon request.

be repaired immediately.

A soils report that is based upon an actual field investigation, soil borings, and infiltration tests. The
results of the soils report must be verified in the field by DWQ, by completing & submitting the soils
investigation request form. County soil maps are not an acceptable source of soils information. All
elevations shall be in feet mean sea level (fmsl). Results of soils tests of both the planting soil and the in
situ soil must include:
-Soil permeability,
- Soil composition (% sand, % fines, % organic), and
- P-index.
A detailed planting plan (1" = 20' or larger) prepared by a qualified individual showing:
- A variety of suitable species,
-Sizes, spacing and locations of plantings,
-Total quantity of each type of plant specified,
- A planting detail,
-The source nursery for the plants, and
-Fertilizer and watering requirements to establish vegetation.

6. An assurance that the installed system will meet design specifications upon initial operation once the `

A BMP must be installed to treat this loading that allows for a reduction of at least 30%.
A bioretention basin is the BMP of choice which per the state BMP manual is credited for
a 35% removal of TN. Nitrogen load after BMP treatment is 5.31 lbs/ac/yr.
Note that an offset payment has already been made to the NCEEP for the N-loading over
the entire site. This was a separate permitting process in accordance with the Neuse
Stormwater Rules.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NCEEP will be approved.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of
the issued 404 Permit1401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the
applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permits} an invoice
will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized
work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and
policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the
ollowin table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies
require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional
mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1948.
