Thorpe, PhD, Manager Planning and Environmental Branch North Carolina Department of Transportation 1548 Mail Service Center Raleigh, North Carolina, 27699-1548 Re: Permit Application for proposed Wake Forest Bypass in Wake County DWQ No. 010550, TIP No. R-2809 Dear Dr. Thorpe: The Division of Water Quality has reviewed your submittal fora 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: • At station -L- 38+24.5/39+44.5, the contractor cleared the protected Neuse Riparian Buffer beyond the permitted impact area. This is in violation of the Buffer Certification issued on October 22, 2003. DWQ will contact DOT to set up a site visit to determine the extent of the impacts as well as to develop a planting and revegetation plan. • At station -Y3- 10+84R/11+OSR, according to NC DOT, Lowe's has filled in a portion of a stream, thereby negating the buffer impacts NC DOT would incur at that site. DWQ never performed a stream verification or buffer verification for NC DOT at this site. DWQ requests that a site visit be made with NC DOT to assess the situation to determine what impacts, if any, NC DOT will incur at this site. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
