Subject: Nationwide 14 Permit Application Replace Bridge No. 86 and Bridge No. 87 on SR I 140 (Myers Chapel Road) over Hyatt Mill Creek in Clay County WBS Element No. 14SP.20221.1 and 14SP.20221.2 (DWR Minor Permit Fee 5240) Dear Ms. Beckwith: The No��th Carolina Department of Transportation (NCDOT) is proposing to replTce the subject bridges. The purpose of the project is to replace these deteriorated and fimctionally obsolete reinforced conerete struchires with reinforced concrete box culverts (RCBC). Bridge No. 86 �vill be replaced with a 2� 9' W s 10' H s 63' L RCBC on a 55° degree skew and 0.0% slope. Bridge No. 87 will be replaced �vith a 2@ l0' W x 1 I' H s 6Y L RCBC on a 125° degree skew �nd 0.9% slope. 1'he inlet and outlet of the high flow cells of the RCBCs will have 2-foot high sills and constructed benches in order to promote tlie low stream flows in the base flow cells. The b�se flow cells will not have baffles or sills because of the fl�t, or nearly flat, grades and because the cell widths are similar to the natural channel widths. As designed, the culverts should hold bedload material while also effectively transporting sediment and providing aquatic life passage. Traffic will be temporarily detoured off-site during construction. We wisli to permit and then constrnet botli crossings together since they are in close pro�imity of one another and the road will only need to be closed once. I am enclosing a PCN application, preliminaiy jurisdictional fonn, SHPO fonns, culvert avoida�ice ancl minimization fonns, Division of Mitigation Services mitigation acceptance letters, plan slieets showing the proposed work, a marked vicinity map, a USGS qiiad map, photographs, and other supporting project information. The North Carolina Natural lieritage Program lists 38 species for Clay Cowity that hlve federal status and that are knowu fi�om current or historical records. One species, the bald eagle (HrJineenis leucocephrrlus), retains special protectiou under the [3�Id and Golden Eagle Protection Act. The bog turtle (Glypteni��s malrlenbe�gii) is listed as threatened due to similarity of appearance to the noithei7� bog turtle. The sicklefin redhorse (rLoxos�o�ua sp. 2) is designated as a candidate species. Page 2 December 18, 2015 The green pitcher plant is only found in a couple of bogs and drainage features in Clay County. There are no wetlands near the bridges that could support this plant. The rock gnome lichen is usually found on rock faces at relatively high elevation, though it can be found at lower elevations on cliffs that receive seepage from overlying soil during wet periods and on damp rock faces in river gorges. The bridge sites are only about 1,800 feet iu elevatiou and not in a river goige. There are no rock faces near the project that could suppoit rock gnome lichen. NLEB �re laiown to roost in caves, mines, and struchu�es, including concrete bridges that retain l�eat. There are no caves visible near die briclges and the nearest underground mine is over 6 miles away accordiug ro USGS data. The e�isting bridges are concrete structw•es that might provide suitable roosts, but dw ing the field scoping and subsequent site visits, we did uot see any evidence that bats were nsing the bridges (i.e. staining or guano). We will confirm that bats are not using tl�e bridge shorHy before construction work begins. During summer, the NLEB is also known to roost in h�ees with sloughing bark. This project will likely require tlie removal of a few black cheriy, red maple, sycamore, black �valnut and yello�v poplar trees, though large meas of peeling bark or voids that would be ideal for bat roosts are not evident on these trees. Nevertheless, as prescribed by the US Fish aud Wildlife Se�vice in Clay Counry, any h�ee removal for construction will be avoided fi•om April 15 to October LS (�vinter elearing) due to poteutial [ndiana bat (�Ltyolrs sodnlis) roosting. This period will also provide protection for potential NLEB roosting. Witli this winter tree clearing, we recommend a"m�y affect, not lilce►y to adversely affecP' determination for NLEB and Indiana bat. Tlie project is limited in scope to the replacement of bridges with RCBC's on e�isting roadway alignments. Eirosion and sedimentation control measures will be implemented to minimize adverse effects of the work on aquatic habitats. Habitats for listed species are lacking at the project sites �nd none of these species were observed dtu�ing field visits. Por these reasons and those discussed above, we recommend tl�at a determination of"no effecY' on listed species apply to this project (except for NLEB and Indiana bat). This project was reviewed by NCDOT's Hum�n Environment Unit from 2011 to 2013 for potential effects to liistoricaf architecture and arcl�aeology. Surveys for historical architecture and archaeology were conducted at Bridge No. 86 with determinatious of"no preliistoric or historic properties resources present/affected". A smvey of l�istorical architechu�e was conducted at Bridge No 87 with a detennination of "no historic properties present or affected", wliile a survey for archeology was not required at tliat bridge (see attached forms). NCDOT best management praetices �vill be used to minimize and conh'ol erosion aud sedimentation on these sites. Tl�e construction foreman will review all erosion control measures daily to ensw'e erosion and sedimentation are being controlled effectively. If the devices are not functioning as inteuded, they �vill be replaced immediately with better devices. Lnpacts to Waters of the United States Hyatt Mill Creek (DWQ Class: C) is shown on the USGS topographic map as a perennial strearo. Tlie chanuel is �vell defined with a substrate of gravel, sTnd, and silt. The stream l�as sufficient Flow to suppoi1 fisli and other aquatic life. Hyatt Mill Creek Flows appro�imately 0.18 mile from Bridge No. 86, tl�e lo�ver bridge, to tl�e Hi�vassee River. The Hiwassee River meets tlte definition of a Traditional Navigable Water. For these reasons, we believe Hyatt Mill Creek is a Relatively Bridge Nos. 86 and 87 - Clay Co. The bridges are being replaced with reinforced concrete box culverts (RCBC's) on existing locations. Sills will be added to lhe high flow cells of the culverts to help maintain natural low flow channel depths and widths in the base flow cells and to help ensure aquatic life passage. 1 b. This review did document the location of six [6] prehistoric archaeological sites sihiated nearby, �etween Chatuge Dam Road and [he Hiwassee Rivcr, nm�[h o( [he current project area. Recorded by Western Carolina University under conh�act with the NC Division ofArchives anA Histoiy (Dorwin 1975), the nearby sites consisted of multiple cultw al oceupations, typically ranging (rom Archaic to Late Woodland in antiquity. Due to factors of erosion and other dislurbance, only one site (31 CYh2) was recommended fm� excavation and data recovery because of unmodified groimd surfaces and intact sh•atigraphy. Because of a pronomiced and endw�ing prehis[a�ic occupational element in die immediate area east of Chatuge Lake, a moderate ro high potential exsists fm• the recove�y of prehis[oric artifactual material in the vicinity of the Qridge No. 87 replacement area. Historic sh ucture locations reveal patterns of settlement and occupancy across a landscape. These impm�tant resources, and the archaeological deposits often affiliated with them, aid in disclosing muted his[ories and fm�gotten details of past lives. Examinatlon of National Register of Historic Places (NRHP), State Study Listed (SL), Locally Designated (LD), Determined Eligiblc (DE), and Surveyed Site (SS) properties employing resow�ces available on the NCSHPO website concluded that nmie of the aUove designated properties were located within or directly proximal to the APG. Topographic, historic, and USDA soil survey maps (RIu1), aerial photographs, and historical/archaeological reference materials were inspec[ed to appraise environmental, cultural, and other factors that may have led to or resulted in past om�pa[ion within the project limits. This wm•k also assisted in assessing the level of modern, agriculhu�al, hydrological, and other erosive-type disturbances which may have previously desh'oyed or dismantled unknown archaeological deposits or feahn es within and sm iroimding the APG.
