Director CERTIFIED MAIL#: 7022 0410 0000 7794 0609 RETURN RECEIPT REQUESTED Duane Wingo Utilities Director Stanly County Utilities 1000 N First Street, Suite 12 Albemarle, NC 28001 Dear Mr. Wingo: NORTH CAROLINA Environmental Quality April 4, 2024 SUBJECT: Notice of Violation Failure to submit 2023 PAR Stanly County Utilities NPDES Permit No. NCO043532 Stanly County Tracking No. NOV-2024-PC-0229 The Division has not received the Pretreatment Annual Report (PAR) from Stanly County Utilities/West Stanly WWTP for the reporting period of January through December 2023. The PAR was due March 1, 2024. This letter is being issued as a Notice of Violation (NOV) due to Stanly County Utilities' failure to submit the 2023 PAR by March 1, 2024, which is a violation of North Carolina General Statute (G.S.) 143-215.1, 15A North Carolina Administrative Code (NCAC) 2H .0908 (b), and the subject NPDES Permit. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation per day, may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1 In order to come back into compliance with the requirements of the Pretreatment Program, Stanly County Utilities must submit a completed 2023 PAR by May 10, 2024. The PAR must be completed in accordance with 15A NCAC 2H .0908(b) requirements and guidelines set forth in the Comprehensive Guidance for North Carolina Pretreatment Programs. In addition, guidance documents pertaining to Comprehensive Guide, Headworks Analysis, Annual Report (including forms), etc. can be found on the Division's website at https://www.deq.nc.gov/about/divisions/water- resources/permittin municipal-npdes-pretreatment-and-collection-system/pretreatment. Stanly County Utilities must ensure to include the following in the PAR: Narrative, Program Performance Summary (PPS) form, Industrial Data Summary Form (IDSF) for all Significant Industrial Users (SIUs), Significant Non -Compliance Report (SNCR) form, Pretreatment Program Info Database (PPID) form (obtained from Division), copies of Public Notices for SLUs or Industrial Users in SNC (if applicable) and any other relevant pretreatment information including Allocation Tables (AT), North Carolina Department of Environmental Quality I Division of Water Resources ` Mooresville Regional Office 1 610 East Center Avenue, Suite 301 1 Mooresville, North Carolina 28115 704.6631699 Consent Orders, etc. Please note that all future PARs are required to be submitted to the Division by March 1 of each year for activities conducted for two six-month periods, January 1 through June 30 and July 1 through December 31 of the previous year. Please submit (via email) the completed 2023 PAR to Mr. Keyes McGee at keyes.mcgeendeq.nc. og_v and Mr. Wes Bell at wes.bellkdeq.nc.gov. It has also been determined that the Division has not received a copy of the signed Sewer Use Ordinance and a draft copy of the Monitoring Plan (Short -Term Monitoring Plan) for review and approval. This Office is also requesting a written response be submitted within ten (10) days of letter receipt that addresses all actions being taken to return to compliance with all pretreatment requirements.
