Mr. Smith,
The City of Wilson received a revised submission for an erosion control plan from Herring —
Sutton &Associates for the construction of the Barton Place project on October 18, 2023 for the
disturbance of approximately 5.3 acres.
Herring — Sutton & Associates has addressed all outstanding comments. Thus, the plan is
approved. This plan approval shall expire three years following the date of approval, if no land-
disturbing activity has been undertaken, as required by 15A NCAC 4B .0129.
This approval was based partially on the accuracy of the information provided in the Financial
Responsibility Form. You are requested to file an amended form if there is any change in the
information included on the form.
The City of Wilson has been granted delegated authority from the North Carolina Division of
Energy, Mineral and Land Resources to regulated land disturbing activities subject to the
Sedimentation Pollution Control Act of 1973. This Act is performance oriented, requiring
protection of existing natural resources and adjoining properties. If the approved sedimentation
and erosion control plan is inadequate to meet the requirements of the Act, this office may
require revisions to the plan and implementation of the revisions to insure compliance with the
Act. Acceptance and approval of this plan is conditioned upon your compliance with all Federal,
State, and City of Wilson's ordinances as applicable to this land disturbing activity.
Please be aware that this letter gives the notice required by G.S. 113A-61.1(a) of our right of
periodic inspections to insure compliance with the approved plan.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the
NCG010000 Construction Stormwater General Permit. This form shall be submitted prior to the
commencement of any land disturbing activity on this project. The NOI form may be accessed at
deq.nc.gov/ncg01. Please direct all questions about the NOI form to NC DEQ.
After you submit a complete and correct NOI Form, a COC will be emailed to you within three
business days. Title 15A NCAC 4B .0118(a) and the NCG01 permit require that the following
documentation be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviations/revisions;
2. The NCG01 permit and COC; and
3. Records of all required inspections made during the previous 30 days.
The General Contractor or delegated agent is required to set up an erosion control pre-
construction meeting (before construction begins) with the City Staff. Please contact myself
(252-296-3434) to schedule the pre-construction meeting. A minimum of 72 hours' notice is
required
