Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). There are the following changes in this final permit from your current permit: • The TRC footnote has been modified in accordance with our permitting strategy regarding 50 µg/ L accepted as being compliant with the permit. • In accordance with 15A NCAC 2B .0505(b) (1), a continuous/ recording flow measurement is required for both flow limits pages. • In accordance with 15A NCAC 2B .0505(c) (3) (C), composite samples are required for BOD, TSS, and ammonia nitrogen for both flow limits pages. • The Total Phosphorus Limit of 2.0 mg/ L was inadvertently left off the 0.75 MGD Limits page. This limit, required in the current Basin Plan for flows of 0.05 MGD or greater, has been added back to the pen -nit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). PHASED CONSTRUCTION CONDITION If this facility is built in phases, plans and specifications for the next phase shall be submitted when the flow to the existing units reaches 80% of the design capacity of the facilities on line. ENGINEERING ALTERNATIVES ANALYSIS The permittee is required to submit an engineering analysis showing no other alternative than to discharge wastewater, prior to expansion above 0.0416 MGD, in accordance with the Lake Wylie Management Plan. The Division has decided that the Harbor Estates W WTP, permitted for 0.0416 to 0.075 MGD is too small to be considered a major nutrient contributor, therefore the increased nutrient monitoring called for by the Basinwide Water Quality Plan is not required. Quarterly monitoring for TN and TP will remain in the permit. North Carolina SLUDGE MANAQSMENT PLAN for Aqua North Carolina, Inc. (Western Region -Denver) No sludge will be treated on any wastewater treatment plant site operated by Aqua North Carolina, Inc. Where practical, sludge removal from Aqua North Carolina West facilities will be transported via a contract hauler to another Aqua North Carolina West facility or the purpose of "seeding" a new or under -loaded plant when there is a need or such.
