C. 28801-5006 SUBJECT: Pipe repair and rock ladder construction, Hwy 182, Lincoln County Dear Mr. Lund: The North Carolina Department of Transportation proposes to repair a section of disconnected pipe and construct a rock ladder on Hwy 182 in Lincoln County. A four-foot section of the existing 46-foot long, 66" RCP will be reconnected. The existing pipe is perched ~ 3 feet and a scourhole has formed at the existing pipe outlet; therefore, NCDOT proposes to embed rock in the existing scourhole and construct a rock ladder at the end of the repaired end section. The armored scourhole will provide energy dissipation to prevent further stream destabilization and the rock ladder will facilitate some aquatic passage.. Due to the existing site conditions, NCDOT requests a waiver from the Regional Condition 2(b)(e) permit depth specification, for the construction of this project. Temporary cofferdams and bypass pumping will be utilized to manage the stream during pipe installation. Upon project completion, the channel disturbed by the staging area and temporary cofferdams will be restored to pre-project conditions and the surrounding area seeded and stabilized. The scope of the work will result in a 18 feet of permanent impacts for the construction of the rock ladder/armored scourhole to the unnamed tributary to Mill Creek, which is classified as a WS-II HQW watershed by the Division of Water Quality. Hwy 182 is a rural/urban arterial; however, the project is not located within '/2 mile of any critical watershed area; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. This office has conducted a GIS and field survey for the project for historical sites and threatened/endangered species sites. No sites listed on the National Register of Historic Places are located in the vicinity of the project nor did there appear to be any eligible structures. The federally listed species for Lincoln County (USFWS listed dated May 10, 2007) include Michaux's sumac (Rhus michauxii) and the dwarf-flowered heartleaf (Hexastylis nan~ora). Natural Heritage Program records document the nearest Michaux's sumac location approximately 26 miles southeast (in Mecklenburg County) of the proposed project area. There are no known sites of Michaux's sumac in Lincoln County. The sumac is typically found in sandy or rocky, open woods and appears to survive best in areas with some disturbance, such as artificially or naturally maintained clearings. Michaux's sumac was not observed in the project area nor did there appear to be suitable habitat. Natural Heritage Program records document the nearest dwarf-flowered heartleaf location approximately 1.1 miles south of the Hwy 182 Page 2 November l6, 2007 nronosed nroiect area. The heartleaf is usually found on dry to moist ravine slopes (usually north facing and of the oak-hickory-pine forest type) and in boggy areas near springheads. There is no suitable habitat within the proposed project area and no species were observed. NCDOT is recommending a finding of "no effect" for T&E species and historical structures. Explain the purpose of the proposed work: The purpose of the proposed work is to repair a broken wipe section and construct a rock ladder. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. A rock ladder will be constructed to facilitate some aauatic passace and the existing scourhole will be armored to provide ener~v dissipation and to prevent further stream destabilization. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 5 of 8 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
