PROJECT SUMMARY: The applicant proposes to install an eight (8) slip docking facility and conduct maintenance excavation. Robert C G Exum Revocable Trust, Page 2 9. PROJECT DESCRIPTION: The project site is located at 2504 Shandy Lane, adjacent to Bradley Creek, in Wilmington, New Hanover County. The property consists of a 2-acre parcel that is situated on land that is approximately 12 feet above normal high water (NHW) and is vegetated with native grass, shrubs, and native hardwoods. The upland portion transitions to a steep bank before reaching coastal wetland vegetation. There are sparse groupings of Bulrush (Scirpus spp.) before reaching a solid span of Smooth Cordgrass (Spartina alternifolora). North of the stretch of Smooth Cordgrass exists a shallow open -water bay that extends approximately 100' wide with water depths shallower than approximately -6" Normal Low Water (NLW) based on DCM field observations. The deepest portion of the shallow bay appears to be on the eastern side of the riparian corridor. North of the bay, a span of Smooth Cordgrass exists before reaching the open waters of Bradley Creek. The applicant provided an aerial photo however, it appears to have too dark of a contrast when scanned. DCM has provided a similar aerial to show the extent of coastal wetland and the shallow bay (See DCM Provided Aerial). The property is bordered by the cast and west by single family residences, the single-family residence to the west is currently under construction. The property to the east has a docking facility with an authorized dredge footprint that is used as a community facility for the 4-house subdivision authorized in 2008 through State Permit 486-02. The property to the west is a single- family residence under construction with no docking facility. The property two parcels to the west has a community docking facility with an authorized dredge footprint authorized in 2002 through State Permit #49-02 and expanded in 2010 through State Permit #94-10. The shoreline length of the subject property is approximately 216'. The Wilmington -New Hanover County Land Use Plan classifies the area as Resource Protection. The waters in this location are classified as SC# by the Division of Water Resources. The area where the docking facility is proposed IS designated as a Primary Nursery Area (PNA) by the Division of Marine Fisheries but the area where the maintenance excavation is proposed IS NOT designated as PNA. The area appears that it is CLOSED to the taking of shellfish. It is DCM's understanding that the past interpretation of the PNA boundary by the Division of Marine Fisheries (DMF) for the southern side of Bradley Creek was that the PNA boundary was an extrapolated line between the landward side of the community pier at the end of Bradley Drive and extended to the landward side of the facility at 2501 Shandy Lane. It is DCM's understanding that this interpretation has changed and the PNA boundary now begins at the NHW mark of the south side of Bradley Creek and ends at the southern edge of the maintained channel of Bradley Creek. (See attached DCM provided aerial from the DCM Web Viewer labeled "PNA Boundary") 10. PROPOSED PROJECT: The applicant proposes to install an eight (8) slip docking facility and conduct maintenance excavation. According to application materials the property would be subdivided, and the two waterfront lots would share the joint docking facility with four slips for each residence. A 512' long by 6' wide pier would span to the open waters of Bradley Creek and terminate at a 16' wide by 16' long gazebo. Two 8' long by 5' wide "golf cart turn around" would exist on either side of the pier just Iandward of the gazebo. Waterward of the gazebo would be an 8' long by 16' wide fixed "sundeck". A gangway would extend east from the "sundeck" and lead to an 80' long by 6' wide floating dock. A second gangway would also extend to the west from the "sundeck" and lead to a second 80' long by 6' wide floating dock, The floating docks would be installed at the existing pier headline of the southern side of Bradley Creek. The applicant has provided a full-sized survey labeled Sheet 1 of I which depicts the pier headline created by the residential docking facility at 303 Bradley Drive and the residential docking facility at 2501 Shandy Lane. (See full sized drawing labeled Sheet 1 of 1 and Sheet 2 of 10) A proposed 20' span elevated approximately 10' above NHW would be constructed approximately 185' from the beginning of the pier to allow public trust access. The water depths in the proposed area of the span are approximately -2" NLW per DCM observations and this span lines up in the deepest portion of the bay and would be consistent with the existing bridged areas on the piers to the east and west to allow for navigation during higher tide cycles. (Sheet 4 and 7 of 10) Robert C G Exum Revocable Trust, Page 3 According to water depth information provided in the application, water depths in the area of the proposed floating docks range from -1.7' NLW on the landward side of the proposed floating docks to -2.3' NLW on the landward side. DCM verified water depths on 12/21/23 at 9:15am. The applicant also proposes maintenance excavation in an area measuring 213' by 20' to a final depth of -6' NLW. The proposed excavation footprint is located within the channel portion of Bradley Creek which has historically been maintained by Bradley Creek Boatominium, Inc. via State Permit #106-75. The permit which was originally issued to Bradley Creek 66 Marina, Inc. on 7/24/1975 for the excavation to a depth of-6' MLW and has been modified and renewed several times since. State Permit #106-7S is set to expire on 12/31/2025. Current water depths in the area of the proposed dredge footprint range from -2.3' NLW on the landward side to -4.5' on the waterward side. (See 3 of 10). The applicant does not propose any excavation landward of the edge of Bradley Creek Channel due to the understanding that this is where DMF has determined the PNA boundary to begin. The proposed excavation footprint would begin approximately 6' waterward from the edge of the proposed docking facility. The narrative states that larger vessels will be tied to the waterward side of the facility. The spoil material would be taken to the Shore Acres Company spoil island that is commonly used for private spoil material. The application includes a signed disposal agreement. The proposed facility would extend approximately 530' below NHW. The proposed facility would extend approximately 75' into a waterbody that measures approximately 483' across and would not encroach into the maintained channel of Bradley Creek nor exceed the pier headline created by residential facilities along the southern side of Bradley Creek. The proposed dredge footprint would fall within the maintained Bradley Creek channel that is not deemed PNA. The adjacent facilities have previously authorized dredge footprints surrounding their docking facilities in areas that are now deemed PNA. The application includes certified mail notification of the adjacent riparian property owner to the west and UPS proof of delivery notification to the property owner to the east. The agent has also included an email in which the other slip owners were sent an email with the application drawings and an Adjacent Riparian Notification form. NOTE: At this time, DCM is unsure if the proposed development is consistent with City of Wilmington's ordinances. 11. ANTICIPATED IMPACTS: The proposed docking facility would incorporate approximately 4,514 sq. ft. of Public Trust Area and Estuarine Waters and shade approximately 2,214 sq. ft. of coastal wetlands. The structures would not encroach into either 15' riparian corridor setback. As proposed, the docking facility would not encroach into the maintained channel of Bradley Creek nor exceed the pierhead line. The proposed structures would extend approximately 75' into the waterbody, in an area that measures approximately 483' across. The proposed structures would accommodate up to eight (8) vessels at this location within current water depths of approximately -1.7' to -2.3. The proposed excavation would disturb approximately 4,260 sq. ft. of shallow bottom substrate. The applicant has proposed a bridged portion of the fixed pier similar to the facilities to the east and west to not restrict public trust access. Shoreline length — +/- 213 ft. x 8 sq. ft. = 1,704 sq. ft. allowable per DCM Proposed: Fixed pier- (505' x 6') = 3,072 sq. ft. (access credit, not counted) Fixed platform- 2 x (5' x 8') = 80 sq. ft. We are proposing to construct a shared 6' x546� stationary pier along with a shared 16' x 16' gazebo, an 8' x 16' sundeck and (2) 5' x 8' golf cart turn arounds (1 per each residence). Constructing a shared pier instead of (2) individual piers to access deep water results in several benefits, first of which is a reduced tootprint in an outstanding resource area. This reduced footprint helps to preserve the natural environment on site and limits any damage / disturbance of the area. The natural view is also protected with one less structure. A shared pier also reduces the risk of storm damage by removing another separate structure from the equation. An additional benefit to the owners is a cost reduction in the original construction. We have proposed a slightly longer stationary pier than the neighboring properties and have aligned the floating docks to run parallel and just outside the limits of Bradley Creek Channel (as per drawings). The proposed design will allow the proposed floating docks to be installed in adequate water depths. Due to agency determinations dredging is no longer being permitted similar to the adjacent docking structures. The current proposed design takes this into account providing good water for docking structures. We are proposing (2) 6' x 80' floating docks (1 for each property). This will provide (4) slips for each residence. Larger vessels will be moored to the Bradley Creek side of the docks and smaller run-abouts will moor on the backside of the docks where the water is shallower. We are also proposing a minor dredge in the already permitted Bradley Creek Dredge Channel to allow for the permitted —6' MLW (as per drawings). Standard marine construction practices will be utilized to construct the pier and dock. Dredging to be bucket to barge. Spoil will be hauled to an approved site and unloaded onto high ground. An excavator mounted on a 24' x 50' barge will be utilized for said construction / dredge.
