Failure to submit all required items will necessitate additional processing and review time. For more information, visit the System-wide Collection System Permitting website: General — When submitting an application to the Municipal Permitting Unit, please use the following instructions as a checklist in order to ensure all required items are submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of requested additional information. The Applicant shall submit one original and one copy of the application and supporting documentation. The copy may be submitted in digital format. A. Cover Letter ® Submit a cover letter listing all items and attachments included in the permit application package B. No Application Fee Required ➢ No application fee is necessary. The permittee will be billed an annual fee upon issuance of the permit ➢ The appropriate annual fee for systemwide wastewater collection system permits may be found at: > Annual Non-Discharge Fees C. Any unauthorized content changes to this form shall result in the application package being returned. If necessary for clarity or due to space restrictions, attachments to the application may be made,as long as the attachments are numbered to correspond to the section and item to which they refer. ❑ If the Applicant Type in Section 1.3 is a Privately-Owned Public Utility, provide the Certificate of Public Convenience and Necessity(CPCN)from the North Carolina Utilities Commission demonstrating the Applicant is authorized to hold the utility franchise for the area to be served by the wastewater collection system,or ❑ Provide a letter from the North Carolina Utilities Commission's Water and Sewer Division Public Staff stating an application for a franchise has been received and that the service area is contiguous to an existing franchised area or that franchise approval is expected. ❑ If the Applicant Type in Section I.3 is a corporation or company, provide documentation if it is registered for business with the North Carolina Secretary of State. BOX 14068 ARCHDALE,NORTH CAROLINA 27263 4'ry CARS " PHONE: (336)431-9141 FAX: (336)431-9140 SEWER OVERFLOW RESPONSE PLAN Permit Number- WQCSD00312 The City of Archdale's pump stations,force mains, and sewer lines are operated and maintained by the Public Works Department.The Sewer Overflow Response Plan (SORP) is designed to ensure that every report of a confirmed sewage overflow is immediately dispatched so that the effects of the overflow can be minimized with respect to impacts to public health and adverse effects on beneficial uses and water quality of surface waters and customer service. The primary objectives of the SORP are to protect public health and the environment, satisfy regulatory agencies, waste discharge,and master plan permit conditions and action plan which address procedures for managing sewer overflows, and minimize risk of enforcement actions against the City of Archdale. Additional objectives of the SORP are as follows: • Provide appropriate customer service; • Protect collection system personnel; • Protect the collection system and • Protect private and public property beyond the collection system. OVERFLOW RESPONSE PROCEDURE The Overflow Response Procedure presents a strategy for the City of Archdale to mobilize labor, materials, tools and equipment to correct or repair any condition, which may cause or contribute to an unpermitted discharge.The plan considers a wide range of potential system failures that could create an overflow to surface waters, land or buildings. An overflow may be detected by system employees or by others.Generally,telephone calls from the public reporting possible sewer overflows are received during the day by telephone at Archdale's City Hall, Water/Sewer Department at 336-434-7341.The after-hour's emergency phone line is answered by Archdale's Police Department at 336-434-3134.They in turn contact Public Works to investigate the problem.Typical response time is less than one hour. Public Works crew or investigator confirms whether or not there is a sanitary sewer overflow (SSO). If it is,the appropriate measures will be taken. They will take all precautions to protect private property and natural resources. After the problem has been resolved via flushing lines, breaking up blockages, repairing lines or pumps etc. then appropriate cleaning measures will be taken. 1 Containment Procedure 1. As soon as the employees arrive on the site of the S.S.O. their priority will be to contain the spill as to not allow it to reach surface waters. If there is no danger of the S.S.O. reaching surface waters, contain the S.S.O.to as small as possible. 2. Containment shall be accomplished in any number of ways including, but not limited to the construction of; ditches, ponds, or dams. The sewage contained in these containment areas shall be pumped back into the sewer system or transported by a pumper truck. If a need arises where a pump station or sewer lines needs to be diverted or down for a period of time,we will make arrangements for a pump to divert sewer around the problem or have contractor pump out the site(s) and remove waste. Some clean-up procedures consist of; • Where practical,thoroughly flush the area and clean of any sewage or wash down water. • Solids and debris are to be flushed, swept, raked, picked-up, and transported for proper disposal. • Secure the overflow to prevent contact by members of the public until the site has been cleaned. • Where appropriate, disinfect and deodorize the overflow site. Equipment that would be accessible is a pumping truck, mini excavator,water jet flusher, portable pump, line camera,tripod, harness, gas detector, lime, sand, shovels, rakes, and rubber gloves. We also have a few contractors plus an engineering firm and have funds in our budget that we can use for these events. The Public Works Director or Operator will assess the problem and determine if any other measures need to be taken to help reduce the chances of it happening again. After clean-up the Public Works Director or appointed designee is to report spills by phone to a person (no voicemails) at DWQ at 336-776-9800 8:O0am-5:OOpm.After hours, and weekends, call the Division of Emergency Management at 1-800-858-0368 or(919)733-3300 (24-hour number). Within 5 business days the Public Works Director or appointed designee must fill out a CS-SSO report for the Division of Water Quality and our records.The report should be filled in completely and accurately as possible. The report is to be entered in the NC BIMS system electronically. If the form can't be done electronically it must be mailed to 450 West Hanes Mill Rd, Suite 300 Winston-Salem, NC 27105. MEDIA NOTIFICATION PROCEDURE When an overflow has been confirmed and is a threat to public health,take the following actions, if necessary, to notify the media: • Sewer investigator or response crew verifies overflow and reports back to the Director of Public Works. • In the event of a discharge of 1,000 gallons or more of untreated wastewater to the surface waters of the State, issue a press release to all print and electronic news media that provide general 2 coverage in the county where the discharge occurred, setting out the details of the discharge. In the event of a discharge of 15,000 gallons or more of untreated wastewater to the surface waters of the State, publish a notice of the discharge in a newspaper having general circulation in the county in which the discharge occurs and, in each county, downstream from the point of discharge that is significantly affected by the discharge. Both media press release and public notice must be done within 24 hours of reported discharge. • The Director of Public Works or designee informs the City Manager.The City Manager shall be the "first-line" response to the media for any overflow. • The City Manager will send out the press release and/or the public notice to the media. Objective of plan: Normal level of service 2. Criteria for invoking plan: Severe Storms,Heavy rains and Power Outages to one or more lift stations 3.Life of Plan:Until electricity is restored,and flows have peaked. 4.Roles,responsibilities,and authority: The Public Works Director will be in charge of operating this contingency plan. He/She will assign workers in the department as needed.If additional personnel are needed, he/she will have the authority to use personnel starting with the water/wastewater department,and the street department. If the Public Works Director is unavailable,the ORC will assume the responsibilities outlined in this plan. 5.Procedures for invoking contingency mode: The Public Works Director will assign employees to monitor the system in an emergency until it is clear that there are no problems with the operations of the system. We have 10 pump stations. All pump stations have SCADA that is monitored by the City of Archdale.All of the lift stations have battery back up on the alarm systems. One pump station is equipped with a SCADA system that is monitored by the City of High Point. If an employee discovers a problem,he/she will notify the Public Works Director immediately and describe the nature of the problem(e.g.no electricity to one or all lift stations). The Public Works Director will determine if additional employees are needed and, if so,will notify other employees to report to duty. He/she will assign all emergency responsibilities. 6.Procedures for operating in contingency mode *Portable generator-The city has one portable generator that can operate five of the lift stations.Based on the storage in the lines and the wet well of the lift station,the Public Works Director will assign employees to transport and hook up the portable generator to the lift stations. If more than one of the lift stations is not working,the Public Works Director will establish a schedule to rotate the generator between lift stations. If necessary,the Public Works Director will try to obtain an additional generator through rental or mutual-aid agreement. We have 6 lift stations that have onsite generators. *Lift Station Pump Bypass—Four lift stations are equipped with valves and quick connections that could be used if pump and/or power failure. Employees would connect a hydraulic pump between the wet well and the quick connections in dry well on the force main,therefore bypassing the pumps * Vacuum Truck-If the generators are not able to handle the flow,the city will pump sewage out of the lift stations with the vacuum truck. We have two contractors that have pump trucks that will be called upon if generators fail or we can't restore power to right away. * Water restrictions-If a city-wide or region wide power outage lasts more than two days,the city will consider restricting community water usage(this is to reduce flow of wastewater through the system). 7.Resources plan for operating in contingency mode * Personnel—2 public works employees and more if needed * Vacuum truck by contractor * Hydraulic pump and two trash pumps for lift station pump bypasses * Portable generator * Trucks to transport or tow generator 8.Criteria for returning to normal operation mode: Electricity restored to all lift stations and flow returns to normal to wastewater plant. 9.Procedures for returning to normal operating mode * Disconnect any portable generators that are connected to lift stations. * Disconnect any pumps and hoses that are connected to lift stations. * Clean up any overflows that might have occurred. 10.Post contingency plan: The Public Works Director will meet with personnel who assisted in operating this plan in an emergency to determine how the plan performed. If necessary,changes will be made for any future events. WITNESSETH: WHEREAS,both Archdale and Trinity are authorized by North Carolina General Statutes 160A,Article 16,and North Carolina General Statutes 153A,Article 15,to construct,operate and maintain sewer systems,including but not limited to collection and transportation lines,pump stations and treatment facilities; and, WHEREAS,it is the intent of both of these municipalities to utilize this public service through this agreement for the enhancement of the quality of life of the citizens of these communities; and, WHEREAS,Trinity agrees to buy from Archdale and Archdale agrees to sell and deliver to Trinity limited wastewater treatment and transmission services within a specified area; and, WHEREAS,Trinity agrees to buy wastewater services from Archdale for a limited,residential area for the purpose of qualifying for a North Carolina Community Development Block Grant(CDBG)for installing a public sewer system to service a • targeted residential housing area; NOW THER EFORE, RE i} , in consideration of the terms, conditions, and covenants hereinafter set forth, it is agreed between the parties hereto as follows: 1. General: Subject to the terms,provisions, and conditions of this agreement, Archdale agrees to transport and dispose of sewage discharged by Trinity at the Discharge Point(s)as hereinafter set forth. This agreement shall be effective from and after July 16,2002,and shall continue and remain in full force and effect from this day forward until such time that Trinity has the capability of serving this area through its own wastewater collection and treatment system,or until a 25 year period has elapsed,whichever shall first occur. 2. Wastewater: The characteristics of the wastewater delivered at the Discharge Point(s)shall meet the conditions of Archdale's pretreatment program and sewer use ordinance and shall be limited to domestic waste only. Archdale shall have the right to sample al wastewater subject to this Agreement. 3.Lead Agency: Trinity shall serve as lead agency for the projects constructed on Trinity's side of the Discharge Point(s). Archdale shall serve as lead agency for projects constructed on Archdale's side of the Discharge Point(s). The Discharge Point(s)shall be considered the meter vault(s). 4. Metering: Trinity shall furnish and install the metering facility with devices of standard type approved by Archdale. The metering facility shall be sized for accurate measuring of all wastewater to be discharged into Archdale's system under this Agreement. Archdale will operate,adjust, and maintain such measuring equipment as the equipment relates to the sole measuring function and bill Trinity directly for Archdale's maintenance cost. Such meters and other measuring equipment shall become and remain the property of Archdale as defined in this Agreement. Trinity shall have access to such metering equipment at reasonable times for inspection and examination; but the reading, calibration, and adjustment thereof shall be done only by employees or agents of Archdale. All readings of meters shall be entered upon proper books of record in the offices of the City of Archdale. Upon written request, Trinity shall have access to said book in the office of Archdale during reasonable business hours. Not more than three times in each year of operation,Archdale shall calibrate its meters if requested in writing by Trinity to do so,and in the presence of a representative from Trinity,the parties shall jointly observe any adjustments which are made to the meters in case any adjustment is found to be necessary. If upon any test, the percentage of inaccuracy of any meter is found to be in excess of five percent(5%),the bill thereof shall be corrected for a period of time extending back to the time when such inaccuracy began. if such time is ascertainable, and if such time is not ascertainable,then for a period extending back one half(1/2)of the time elapsed since the date of the last calibration, but in no event further back than a period of six months, the bill will be 2 corrected. If,for any reason, any meter is out of service or out for repair,the amount of wastewater discharged during the period shall be estimated by the parties hereto on the basis of the best data available. Where such estimated discharged amounts are found to vary more than five percent(5%)from the subsequent accurately regular-metered period, the estimated amount shall be readjusted by averaging and crediting,re-billed or refunded as appropriate. The unit of measurement for wastewater herewith shall be 1,000 gallons, US Standard Liquid Measure. 5. Affected Area: Trinity and Archdale hereby mutually establish a service area outside the area currently being served by the City of Archdale, The service area map shall be attached hereto as"Attachment A"and shall be incorporated herein by reference and made a part of this Agreement as if fully set forth. Reference is hereby made to a map"Attachment A"prepared by the City of Trinity,entitled"City of Trinity CDBG Target Area Map,"dated July 16,2002. No waste may be generated from outside the above boundary. Trinity will not cause or accept wastewater from any point source outside the service area. Sewer installation shall not be extended beyond this service area,but such area shall be reviewed from time to time to determine if the parties shall expand the limits. Such expansion shall take place only after approval by both City Councils. No multi-family housing will be served under this Agreement,existing duplexes excepted. 6. Limited Discharges: Only residential structures shall be eligible to connect to this public wastewater collection system supplied by the cities of Archdale and Trinity. Archdale will supply wastewater transportation from the service area limits to the City of High Point for treatment services for 75 existing CDBG Target Area residences and as many as 52 additional residences not to exceed a rate of 27,000 gallons per day. All of the wastewater must meet Archdale's SUO limits. Should Archdale be held liable by High Point for violating parameters due to wastewater from Trinity,the City of Trinity shall be liable and indemnify Archdale pursuant to Paragraph 8 below. In the event Trinity exceeds 27,000 gallons per day on an annual basis, Trinity shall pay an"excess usage fee"equal to the rate Trinity will be charged(that is, 150%of Archdale's inside rate)plus 500% for the number of gallons which exceed 27,000. In order to monitor this 52 dwelling unit limitation over time,the City of Trinity will copy the City of Archdale with each zoning_permitissued by the City of Trinity in the CDBG target area at the time of—permit issuance. The City of Trinity may request changes in the total residential volume to the City of Archdale. The City of Archdale will review each request on a case-by-case basis and notify the City of Trinity in writing of any 3 amendments to this Agreement, which must be approved hereunder by the respective City Councils. 7. Rates and Payments: Trinity shall be charged 150%of Archdale's inside City customer rate. In addition, Trinity shall pay Archdale a$54,000.00 Capacity Fee which would be Trinity's share of the cost of Archdale's share in the Eastside Treatment Plant. The Capacity Fee shall be due and payable 30 days after construction of the Trinity connections to the Archdale system and prior to any services to be provided hereunder. At such time as Trinity serves the area through its own wastewater collection and treatment system,Archdale shall reimburse Trinity a prorated share of the fee based on a twenty-five year time period. Payments for metered wastewater will be billed to Trinity monthly and payment is due within 30 days from the date of the bill. The parties hereto-recognize the statutory and contractual duty of Archdale to fix and,from time-to- time, revise the charges for services rendered to Trinity herewith so that revenues will at all times be sufficient to enable Archdale to provide a financially sound system. In addition,Trinity agrees to initially fix and thereafter, from time-to-time, adjust their rates to customers to cover payments to Archdale. Archdale will maintain an accounting system in accordance with the General Statutes of North Carolina and in accordance with accounting and reporting standards established by the National Council of Governmental Accounting and the American Institute of Certified Public Accounts Committee on Governmental Accounting and Auditing. Trinity will have access to such accounting records that pertain to this agreement during regular business hours of Archdale upon reasonable notice. Any matters arising out of this contract that are not satisfactorily resolved at the staff level may be appealed by Trinity to Archdale by requesting a joint meeting of the respective councils. 8. System Maintenance: It is the responsibility of the City of Trinity to maintain all collection system facilities in their jurisdiction. Trinity may contract with the City of Archdale on a case by case basis. Archdale personnel will then do the work as long as there is manpower available and will bill Trinity on the basis of actual costs incunTed by Archdale. 9. Insurance and Indemnity: Archdale and Trinity shall maintain and provide public liability insurance coverage against any and all damages that may be incurred upon said property through injury, accident,and the like. Archdale and Trinity shall at all times indemnify, save,protect, and keep harmless, each other and the demised property from every and all costs, loss, damage, Iiability, expense, penalty and fine whatsoever which may arise from or be claimed against each party or the property, or damage of whatever kind or character consequent upon or arising from the use of the system or occupancy of said property of consequent upon or arising from any neglect or fault of 4 Archdale or Trinity, its agents and employees in the use of the system and occupancy of the property. 10. Amendments: This agreement may be amended only by written document executed in the same manner as this Agreement. 11. Integration: This instrument contains the entire Agreement between the parties; and no statement, oral or written, made by either party or agent of either party that is not contained in this written Agreement shall be valid or binding. This contract may not be enlarged,modified, or altered except in writing by the parties and endorsed hereon. It should be noted that wastewater treatment services will be provided from the City of Archdale's allotment in the City of High Point's Eastside Treatment facility. The City of Archdale will request from the City of High Point a"letter of flow acceptance"required for State approval of Trinity's sewer extension permit application. Any issues related to the City of High Point which may affect the State's approval of the permit can not be guaranteed by the City of Archdale. 12. Notices: Any notices required or permitted in this Agreement, including address changes, shall be made in writing and shall be made either by mailing registered or certified mail, return receipt requested, and postage prepaid,to the other party at the address shown herein for that party or at such different address for that party,notice of which has been given hereunder,or personally delivering such notice to and officer or other party. The notice,if mailed as provided herein, shall be deemed given on the day of receipt or refusal to accept receipt; and if personally delivered on the date of delivery. The City of Archdale City Council has reviewed the request and agrees to provide the additional capacity as stated above. There will be a capacity fee of an additional$40,000 payable by the City of Trinity to the City of Archdale for this additional capacity. That fee is reimbursable to Trinity under the same terms as stated in the original agreement, that is on a prorated basis over a twenty- five(25) year term. WITNESSETH: WHEREAS, Archdale and Trinity entered into an Interlocal Agreement for Wastewater Services(the"Agreement") on July 16,2002; and WHEREAS, the Agreement was limited to domestic waste only and provided that only residential structures would be eligible to connect to the public waste water collection system supplied by the cities of Archdale and Trinity; and WHEREAS, under the Agreement Trinity agreed to buy wastewater services from Archdale for a limited, residential area for the purpose of qualifying for a North Carolina Community Development Block Grant ("CDBG") for installing a public sewer system to service a targeted residential housing area; and WHEREAS,the CDBG grant to the City of Trinity has now closed; and WHEREAS, Trinity has identified one commercial property in the CDBG area designated Sam's#2 Mart located at 12414 Trinity Road, (the"Property")whose owners have requested consideration to connect to the existing sewer due to concerns caused by their septic tank.and the limitations of the septic system for the Property; and WHEREAS, Trinity's council desires to allow the existing commercial establishment located on the Property to connect to the sewer system subject to the terms and provisions of the Agreement and has requested that Archdale accept this request and enter into a written amendment to the Agreement to allow such connection; and WHEREAS, Trinity and Archdale have determined that it would be in the best interest of the public health, safety and welfare of the area to allow the Property to be connected to the sewer system under the terms and conditions of the Agreement and Archdale has agreed to this limited amendment to the Agreement for the purpose of allowing only the connection requested by Trinity for the Property, and such acceptance shall not be construed to be a precedent or intention to make any other amendment to the Agreement except as may be mutually agreed between Trinity and Archdale upon such facts and circumstances unique to each case in the future; and ./ t P A S A rrhrdale and Trinity d s.irretto mad}( e• greement ac se for ti above.
