Dear Mr. Stancil:
On March 21, 2024, I, Bailey Taylor and Tabytha Smith from the.Fayetteville Regional Office of the
Division of Energy, Mineral and Land Resources(DEMLR)„conducted a Compliance Evaluation
Inspection at the Windy Hill Farm Subdivision located in Harnett County, North Carolina. The purpose of
the inspection was to ensure compliance with State Stormwater Management Permit SW6191204 that
was issued on April 01, 2020. A copy of the Compliance Inspection Report is enclosed for your review. As
a result of the inspection and subsequent file review, it has been determined that the facility is Not
Compliant with the conditions of the subject permit and approved plans.
The required actions that are necessary to bring this site into compliance are noted under the Inspection
Summary and Comments sections of the report. You are asked to provide this office a written/typed
response within 30 calendar days from receipt of this letter. Your response should specify actions that will
be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information may constitute the issuance of a Notice of Violation,which is subject to the
assessment of a civil penalty of up to$25,000 per day, per violation. If you have any questions or

Inspection Summary:
Inspection conducted in response to submittal of permit transfer application. At the time of inspection, SCM
1,and 2 appeared to constructed/maintained per the original permit and certified as-built drawings by Timmons
Group.
SCM 3 has gully erosion forming at the corrugated outlet pipe and requires additional riprap to prevent further
erosion.
SCM4 has a plunge pool forming at the inlet swale, causing a settling area and erosion of the southeastern
slope is occuring. Permanent ground cover has not been established in SCM4 and sections of slope remain
bare with dead sod. Gully erosion has occured at the outlet pipe of SCM4 and requires maintenance.
SCM5 does not appear to have accurate elevations on the spillway height and top of berm height, according to
the as-built plans. There is settling in the bottom of pond SCM5 near the spillway, creating a unlevel elevation
that may cause issues with infultration rates.The backside slope of SCM5 has erosion occuring at the time of
inspection. SCM5 requires additional ground cover/stablization along slopes and top of berm.

Comment: SCM 5 does not appear to have proper elevations on spill way and top of berm. SCM5 has low
lying area (uneven bottom of pond)where water will settle, near the southeast portion of the
SCM and the spillway, reducing the available infultration square footage. SMC5 has evidence of
erosion occurinq on the south side (back side)of the berm, below the spillway. SCM4 has a
plunge pool forming at the inlet swale to the SCM. SCM4 has erosion occurinq at outlet pipe and
along southeast slope of SCM.
