Dear Mr. Miller,
The Land Disturbing Permit ER02022-00054 (Asbury Road Minor Subdivision), has been
terminated. The project was initially approved on January 31, 2023. This permit termination
has been made per your request due to failure to begin project per the associated reference in
the Buncombe County Ordinance for Soil Erosion and Sedimentation Control and
modifications to grading totals.
Sec.26-227. Revocation of Permits (b)
When work under a land disturbing permit is not begun within six months following the date of
issuance of the land disturbing permit, the land disturbing permit shall be deemed to be
expired. If the land disturbance has begun within six months of the date of issuance or
construction has not been completed, the land disturbing permit will expire five years from the
date of issuance.
