Dear Mr. McDonald:
This letter is in response to the Pre -Construction Notification (PCN) you submitted to
the Wilmington District, Charlotte Field Office on January 22, 2024, for a Department of
the Army Nationwide permit (NWP) verification. This project has been assigned the file
number SAW-2024-00213 and is known as Noah's Run. This file number should be
referenced in all correspondence concerning this project.
A review of the information provided indicates that the proposed work would include
the construction of a single and multi -family residential development. The project area
for this determination includes a 176 acre area which is illustrated on the enclosed site
plans/maps. The proposed project involves impacts to 115 linear feet of stream for
culverts. Temporary impacts include 80 linear feet of dewatering. The project/review
area is located at 770 Shue Road, at Latitude 35.586100 and Longitude-80.571300; in
China Grove, Rowan County, North Carolina.
We have determined that the proposed work is authorized by Nationwide Permit #
29 and Nationwide Permit #18 pursuant to authorities under Section 404 of the Clean
Water Act (33 U.S.C. § 1344). The proposed work must be accomplished in strict
accordance with the general permit conditions, any regional conditions, the application
materials, and the enclosed plans. If the extent of the project area and/or nature of the
authorized impacts to waters are modified, a revised PCN must be submitted to this
office for written approval before work is initiated. Any violation of permit conditions or
deviation from your submitted plans may subject the permittee to enforcement action.
This verification is valid until March 14, 2026, unless prior to this date the subject
NWP(s) is suspended, revoked, or is modified such that the activity no longer complies
with the terms and conditions of this NWP. If you commence or are under contract to
commence this activity before the date that the relevant NWP is modified or revoked,
you will have 12 months from the date of the modification or revocation of the NWP to
complete the activity under the present terms and conditions of this NWP.
This NWP verification does not preclude the necessity to obtain any other Federal,
State, or local permits, licenses, and/or certifications, which may be required.

NOTES:
1) All excavation shall be performed in only dry or isolated
areas of the work zone.
2) Impervious dikes are to be used to isolate work from
stream flow when necessary.
3) Maintenance of stream flow operations shall be incidental
to the work. This includes polyethylene sheeting, diversion
pipes, pumps and hoses.
4) Pumps and hoses shall be of sufficient size to dewater
the work area.

2. INSTALL UPSTREAM PUMP AND TEMPORARY FLEXIBLE HOSE.
3. PLACE UPSTREAM IMPERVIOUS DIKE AND BEGIN PUMPING
OPERATIONS FOR STREAM DIVERSION.
4. PLACE DOWNSTREAM IMPERVIOUS DIKE AND PUMPING
APPARATUS. DEWATER ENTRAPPED AREA. AREA TO BE DEWATERED SHALL
BE EQUAL TO ONE DAY'S WORK.
5. INSTALL CULVERT(S) IN ACCORDANCE WITH THE PLANS.
b. EXCAVATE ANY ACCUMULATED SILT AND DEWATER BEFORE REMOVAL
OF IMPERVIOUS DIKES. REMOVE IMPERVIOUS DIKES, PUMPS, AND
TEMPORARY FLEXIBLE HOSE. (DOWNSTREAM IMPERVIOUS DIKES FIRST).
7. REMOVE SPECIAL STILLING BASIN(S) AND BACKFILL. STABILIZE DISTURBED AREA
WITH SEED AND MULCH.
