In accordance with the application for a discharge permit received on February 27, 1995, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated December 6,1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and
binding.
Please take notice this permit is not transferable. Part II, EA. addresses the requirements to be followed
in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

1. Continue to operate an existing wastewater treatment consisting of a grease trap, septic tank,
pump tank with dual pumps and high water alarms, surface sandfilter with distribution chamber,
pvc laterals with perforations laying atop concrete blocks, tablet chlorinator and chlorine contact
tanks in series, manhole with tablet dechlorinator, flow recorder, effluent discharge pipe with
flap valve and all associated piping, valves and appurtenances located at Madison County Middle
School, 0.1 mile northeast of NCSR 1143 & US 25-70, southeast of Walnut, Madison County
(See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached map into Brush
Creek which is classified Class C waters in the French Broad River Basin.

* Let me see if I can paint a real clear picture of this....
Where they are... 16,963 population of Madison County.
Where I am... 185,000 population of Buncombe County.
Where you are... 508,000 population of Wake County.
Where you think you might want to be... 569,000 population of
Mecklenburg County (largest in NC).
The point is, this is a rural county with*a small population
and very limited resources. After considerable reluctance by the
former superintendent and much encouragement on the part of the
regional staff, the Madison County BOE finally went to contract
operation of the Madison Middle School (as well as Laurel
School). This was truly a victory for protection of the state's
waters.
In order to make the contract as affordable as possible, the
costs were determined by a weekly ORC visit and appropriate
required tests in accordance with our regs. The school's
maintenance staff takes care of the routine cleaning of the sand
filter beds and other duties. However, the school's staff does
not have daily assigned responsibilities at the WWTP.
* This is a class I septic tank -sand filter facility which
requires a weekly visit by the operator in responsible charge.
* The current (expired 9-30-95) and draft permits have daily
temperature monitoring requirements. The data obtained from
monitoring temperature daily is of no value to us nor the
operator, since there is nothing that the permittee or operator
can do about this.
* The draft permit also changed the total residual chlorine
monitoring requirement from weekly to twice a week.
* I don't think it would be of any more benefit to us or them
to have the temperature or TRC monitored any more frequently than
weekly. I'm not sure I understand why we changed the rules to
require daily monitoring at class I facilities which only require
a weekly ORC visit.

* In addition, the 2B.0500 regs should also be changed to
require weekly temperature and TRC at class I facilities. Since
these facilities require a weekly operator visit, it would
be prudent to only require monitoring that has the potential to
protect water quality, rather than daily monitoring of parameter
for which the operator or permittee has no control (temperature).
