Upon closer inspection, the intent of this application was to request Authorization to Construct for a new treatment facility under the facility existing NPDES permit. Your consultant, MacConnell & Associates, P.C., was contacted and advised that submittal of a separate Authorization to Construct application was required. Based on the documentation provided,the proposed plan was to installed new treatment capacity in two phases, and maintain the existing lagoonsystem as a backup treatment system. With the installation of a new domestic treatment facility your NPDES permits must reflect at a minimum federal secondary treatment limits which in this case means the permit's TSS limits will be modified to 30 mg/L as a monthly average limit and 45 mg/L as a daily maximum limit. All other existing permits limits for BOD, pH, Fecal Coliform and DO will not change. The new treatment facility design information indicates the secondary treatment standard were applied so there is no issue with the design criterion. The documentation also indicated the new treatment facility will use UV disinfection so the existing Total Residual Chlorine limit will be reviewed. However,the existing lagoon system does not qualify for meeting secondary treatment standards and cannot be used as a backup. Once the new treatment facility discharge begins the lagoon system must be permanently removed from domestic treatment service. This includes, but is not limited to, removal of solids from lagoon, closure procedure, or repurposing. The changes to the lagoon system must be shown in the Authorization to Construct documentation. Any questions about repurposing the lagoon for stormwater use should be addressed to the Raleigh Regional Office. Before the Division can proceed with your Authorization to Construct application, your NPDES permit must be modified to show the applicable requirements. Since an expansion in treated domestic flow is not required and the resulting modified permit limits will be more stringent the Division has determined a minor permit modification is appropriate. What is the purpose of two phases? Can 8,000 GPD be installed now? Please advise the Division on the final design so the NPDES permit modification can be issued.
