Sullins, Director Division of Water Quality November 14, 2007 Mecklenburg County DWQ Project #07-1810 Mr. Jim Griffith Griffith Equities, LLC 1944 Brunswick Ave. Charlotte, NC 28207 Subject: Hold: Griffith Lakes Development, Charlotte Dear Mr. Griffith: The Division of Water Quality (DWQ) received your application fora 401 Water Quality Certification for the subject project on October 30, 2007. Mr. Alan Johnson of this office has reviewed the application. Based on his review the following information/comments are needed by this office in order to complete our review: a) Acceptance from the Ecosystem Enhancement Program (EEP) for all impacts at the site prior to the issuance of a 401 Certification, or an approved stream/wetland restoration plan. Avoidance and minimization at a site does not count toward mitigation credit. The mitigation proposed in the application is not sufficient. b) Please provide locations for the storm water management ponds. These areas were not identified on the site diagram. c) Please provide construction details for the stream impacts/road crossings (cross sections, profiles, longitudinal profile). Impact associated with culvert installation and rip rap should be identified. d) Bottomless culverts must meet NCDOT standards. Please submit documentation that this is a viable alternative. In addition the culvert should appropriately span the stream into high ground. Pursuant to 15A NCAC 2H .0507(h), please be advised that this project will be placed on hold. Failure to submit the requested information by December 30, 2007 will result in the application being withdrawn from consideration. You may reapply, but a new fee and application will be required. In addition, this office is requesting that the Army Corps of Engineers withhold processing the 404 permit until the requested information is provided.
