Jackson County State Project No. 17BP14.R.129 (DB14B-490337) Dear Ms. Beckwith: Tlie Nortl� Caroli�ia Department of Transportation (NCDOT) is proposing to replace ttie subject bridge. The esisting 18.5' L x 20' W timber bridge needs to be replaced due to deterioration and insufficient width. The proposed replacement struchu'e will be a 37.7Y L s 27' W x 18" D cored slab bridge. It �vill be centered slightly downstream of the esisting bridge and stage constructed to acconunodate traffic during consh'uction. Enclosed are a PCN application, preliminaiyjurisdictional form, SHPO forms, plan sheets showing the proposed work, a USGS quad map, photographs, and othec pertinent project infonnation. The Noith Carolina Natural Heritage Program database was checked for records of threatened and endangered species. There are 63 species witli federal status that are known in Jackson Counj� from current or historical records. Of tliese, eight species, Carolina no�rthern flying squirrel (G/auco�nys snGrinus colornhrs), Indiana bat (�Llyotis sodrdis), Appalachian elktoe (dlnsulidonla rm�enelirnu�), spruce-tir moss spider (dLicrohext�ra �uo�uirrrga), small �vhorled pogonia (Isoh•ra medeoloides), swamp pink (Helonins brdlntn), rock gnome lichen (G}nnnodermn linem•e), and northern long-eared bat (ill��otis seprentrionolis, NLEB), are Iisted as either threatened or endangere<L Jackson County is now considered occupied summerand wiuter liabitat for NLEB and Indiana bats. Appalachian elktoe are found in some wetl-o�ygenated streams with moderate to fast flowing water and stable, mixed substrates of silt, sand, gravel, and/or cobble. Streams that snpport this mussel arc typic�lly much larger �nd wlrmer than Fisher Creek. Tlie only records in Jackson County are ti�om the Tuckasegee River. Tl�e bridge is uearly 6 miles upstream of the designated critical habitat for Appalachian elktoe in the Tuckesegee River. NLEBs and [ndiana bats winter in caves or mines with stable, but not fi'eezing cold temperahu'es. There are no caves or mines visible at the bridge and, according to USGS data, tl�e nearest underg�nund cave is �bout 0.8 mile away. However, the construction work should not affect caves or the hibernacula becnuse tl�e project requires no blasting. ln summer, NLEBs and Indiana bats may roost in struchires, but they generally prefer to roost uuder the loose bark of hees, eitlier dead with peeling bark or cavities, or live h'ees with sha�gy bark such as white oak, maples, sycamore and hickories. With regard to large trees (>3 incli dbh) the work sliould only require the removal of one large wliite piiie. Neve��theless, any tree removal will be completed from October I S to April I S(winter clearing) to avoid the seasons when either species of listed bat may be roosting in suitable trees. Also, on June 16, 20I5 we conciucted a survey of the bridge and did not see roosting bats or any evidence of b�t usage (i.e. staiuing or guano). This bridge is only 5 feet above tlie water surface and very cool underneath. Therefore, with the winter tree clearing, we recouunend a"may affect, not likely to adversely affecP' determination for NLEB and [ndiana bat. Small whorled pagonia generally occurs in open, dry, deciduous woods with acid soil, though habilats can include slopes aloug streams aud mesic forestwith white pine and rhododendron. There is no suitable forested habitat near the bridge that could support small whorled pagonia. The Carolina noithern flying squirrel, rock gnome lichen, and spruce-fir moss spider are found in spruce-fir forests and other isolated high elevation locations in western North Carolina. Ho�vever, rock gnome licheu is an e�ception because it can occasionally be found at lo�ver elevatious in deep river gorges with high humidity or on some veitical rock faces that are periodically wet These spccies have been found within a few miles of the bridge, but at nuich higher elevations. 'Plie bridge site has an elevation of only 2,240 feet and lacks rock faces and other habitat couditions required by these specialist species. There are no wetlands near the bridge that could suppart swamp pink. The project is Limited in scope to a bridge replacement on the e�isting alignment. Erosion and sedimentation control measures will be implemented to minimize adve�se effects of the work on aquatic liabitats. Habitats for listed species appear lacking at the project site and none of these species were obseived during field visits. For these re�sous �ud those discussed above, we recommend that a determination of"uo effect" ou listed species apply to this project, escept for NLEB and fndiana bTt. This project �vas reviewed by NCDOT's Human Euvironment Unit in 2013 and 2014 for potential effects on historic architechn�e and archeology (see attached forms). It was detennined that there would be "no effecf' on historic structures. A swvey was conducted for archeoloaical resomces witli a determination of "no effect". NCDOT best management practices will be used to minimize and conh�ol sedimentation aud erosion on this projecL The constructiou Yoreman will review all erosion control measwes daily to ensure sedimentation ancl erosion controls are beiug effectively controlled. lf the devices are not fimctiouing as intended, they will be replaced immediately with better clevices. Imp�cts to Wate�s of tlie United St�tes Fisher Creek (DWQ Class: C Tr) is shown on the USGS topographic map as a perennial stream. The channel is appro�imately 12 feet in width and �vell defined with a substrate of gravel and cobble. The stream has sufticient Flow ro support fish, including trout, and other aquatic life. Fisher Creek flo�vs to Scotts Creek, which then flows to the Tuckasegee River about 5 miles Bridge No. 337 — Jackson Co. Page 3 November 16, 2015 dowustream. The'I'uckasegee River meets the definition of a Traditional Navigable Water (TN W). For these reasons, we believe Fisher Creek is a Relatively Pennanent Water (RPW) and is under the jurisdiction of the U.S. Arnry Corps of Engineers. In order to construct the project, it will be necessary to impact waters of die United States in the Little Tennessee River Basin (CU 06010203). No archaeological sites were identified withiu the APE. They have recorrunended uo fuither archaeological investigations in thc acea tliey suiveyed. The unsurveyed portion of the APE at the far end of the northcast quadiant l�as subsequently been revie�v by NC DOT archaeologist, Damon Jones. It is unlikely to yield a siguificant archaeological site due disturbance cause by soil erosion. Although the slope at the base of the hill is gradual, it has been dissected by Hie run-off of w�ter, which has impacted any potential deposits. I concur with the recommendntion as the proposed bridge replacemcut project will not impact significant archaeologicnl resources. No additional �vork is necded. However if tl�e project expands and impacts subsurface areas beyond the defined APE, furtl�er archaeological consultations will be nceessary. As specifiect by the NCDOT, the survey corridor (P,rea of Potential Effects [APE]) for arehaeology is defined as a 525-foot (160.02 m) Iong conidor rumung 200 £eet (60.96 m) west and 325 feet (99.06 m) e�st/south aloi�g SR 1448 fiom tl�e center of Bridge No. 337. Thc corridor is approsimately I50 fect (45J2 m) wide exteuding 75 £eet (22.86 m) on either side of SR1448 from its present center. A map review and site Fles search was conducted by Tash� Beuyshek of TRC nt the Wcstern Office of State Archaeology (OSA) on November 21, 2013, whicli conoborated a previous NCDOT revie�v. Tkvs review identified no archaeological sites within or adjacent to the APE. One site (31JK282) is located �vilhin n mile radius of tlie project �rea. The site form indicates Ihat 31JK282 contains only lithic material, includiug debitage aud tools. The Jasper AIIen mowid was located along Scott Creek in thc general projcct viciiuty, but tl�at site's esact location has not been vcri6ed. Topographic maps, United States DeparUnent of Agriculture (USDA) soil swvey maps, and lvstoric maps were esamiucd for iuformation on natuial or cultural variables that might have affected site Iocations. One of the earlicst road m�ps of Jackson Coimty examined (Cox 192a) shows Fisher Creek and Fisher Creek Road, but no side roads or structures are depicted witl�iu tl�e project area. The 1938 Jackson Couuty Nortli Carolina State Highway and Public Works Conwussiou road map shows a fcw structures along Fisl�cr Creek Koad, but tliey appear to be located north of the project area (North Caroliva Slntc High�vay aud Public Works Commission [NCSHPWC] 1938). The 1968 Nortli Carolina State Higliway aud Public Works Conuuission map of Jackson County, sho�vs Fisl�er Creek, Fisher Creck Road and Unity Road, but no strirotures ui the project viciuiry (NCSHPWC 1968; 1972; 1980). The enrliest USGS map available of the area is the Cowee (1897) qundraugle, which depicts Fisher Creek, but no roads or shuctures ui tl�at area. Tl�e later 1907 Cowee quadrangle map depicts a road along Fisher Creek, but Unity Road is not sl�own. Also, no structures are apparent in the general project area, but structures are depictcd elsewhere along Fisher Creek (Co�vee 1907). Tlie 1935 Addie, NC 7.5-minute qu�drnngle illustr�tes Fisher Crcek, Fisher Creek Road, and Unity Road in their currei�t locations. However, Unity Road is sliorter than its current incarnatioa One slructure on the west side of the creek is showu ou this map and may coii�espond with an existing house u� the project con�idor. This same informatio�� is shown on the 1941 and 1942 maps as well (USGS 1935; 1941; 1942). The earliest version of the Sylva North, NC 7.5-minute quadrnnglc datcs to 1967 and sho�vs the current project area including Uuity Road i�i its preseiit layout. Tln�ee su�uctures are depicted �vithiu or near the project area. These include Ihe structure from tl�c 1935 map, the one at tl�e Fisher Creek nnd U�vty Road intersection, and the one at the east end oC the approYimate project area (USGS 1967). Oii-line soils data indicatejust hvo soil types are present in the APE. Separatcd by Fisl�er Q�eek, the �ves� half of the project aren is uinppcd as Dclhvood gravelly Fine sandy loam, which l�as a 0-3% slopes (DfA), while the east half is comprised of S�unook gravelly loam with 2-8% slopes (S�B). The Dellwood soils are moderately well-drained soils found on floodplaii�s and are in areas subject to occasional floods. The Saunook gavelly Ioam is a well-draii�ed soil rype found along ihe b�ses of slopes (NRCS 2013). The arcl�aeological field survey included a systematic �valkover oF thc APE to search for above-ground features aud the excavation of 10 shovel tesls in are�s lackiug standing water, �vedand soils, severe slope or sigus of severe disturbance. The shovel tests measured 30 cm in di�meter ai�d �vere exclvated to subsoil or nt least 75 cm below surface (cmbs). All soils that were uol obvious fill �vere dry-screened tln'ougli '/a-inch inesli. Should tlic desigu plans for the curreut bridgc replacemeut include this property, a review by a NC DOT archaeologist is recommended. Almost Ihe entue project area is located within open residential yards or fields with the exception of the far southeastern end of Ihe corridor which is Iightly wooded (Figures 3-6). Two shovel tests �vere escavated in the �vooded areas, one (ST 1) in thc southeast quadrant and one (ST 10) in the northeast quadranL These two shovcl tests, aloi�g �vifli ST 2 also in the southeast quadrant, encountered the only intact soils within the project corridor; compact brown to dark yellow brown loaui atop a vei�y compact rcd silry clay loam to clay. All remaining shovel tests (STs 3-9) encouutcred vaeyuig degrees of disturbed soils/611 to deptlis rangu�g from 30 to 86 cmbs. Moderu dcbris (i.c., black plastic, asphalt, brick and coucrete, safety glass, and slag) was noted within four shovcl tests (STs 3-6 and 8), but not collected. No above ground evidence of an archaeological site was noted withi�� the defined APE, and no m tif�cts were found within the 10 sliovel tests excavated. Based on the resulis of the bnckground research and field sw vcy, tlierc is i�o evideuce that NRHP-eligible archaeological resources are situated within the Bridge 337 APE. Consequently, no additioi�al arcl�acological iuvestigations are reconnnended for this project as currently defined.
