The feature is not jurisdictional regarding the Tar -Pamlico Riparian Buffer Rules as previously
stated. However, jurisdiction per the US Army Corps of Engineers regulatory authority will be determined
by Gary Beecher. Mr. Beecher can be contacted at (910) 251-4629 or
Garv.H.Beecher@usace.armv.mil. If you plan on working within the Tar -Pamlico Riparian Buffer off Bath
Creek, then either Kelly Spivey with the Division of Coastal Management or I can assist you depending on
the nature of the activity. Mr. Spivey will assist you regarding permitting associated with water
dependent activities (i.e. bulkhead and/or piers). I can assist you regarding any clearing activities or
other development within the Tar -Pamlico Riparian Buffer.

Anthony,
Thank you for clarifying this matter and answering questions that both Steve and I had. I do not
believe it will be necessary to have the site visit tomorrow you mention below as this
environmental feature may in fact be non jurisdictional. It is my understanding that I will need to
have a letter from the Army Corp of Engineering stating that this feature is non jurisdictional. Is
my understanding accurate, if so do you have the contact information for the person I need to
contact for this work in the Tar/Pam basin?

Messrs. Campbell, Swindell and Hardison,
I am available to meet this Friday at 2:30 at the subject property. As you may already know, the feature
in question is not be subject to the Tar -Pamlico Buffer Rules. After referencing the the most recent
published version of NRCS Soil Survey for Beaufort and 1:24,000 scale (7.5 minute) quadrangle
topographic map prepared by the USGS, the subject feature does not appear of either of the maps. In
accordance with 15A NCAC 02B .0259 (3) ... "Riparian Buffers adjacent to surface waters that do not
appear on either of the maps shall not be subject to this Rule..." If you have any further questions, please
feel free to contact me.
