The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers has verified all stream and wetland locations for the entire subdivision. [15A NCAC 02H .0502(a)(7)] 2. Please provide more details regarding avoidance and minimization of the stream impacts for this project. [15A NCAC 02H .0506(f) and (g)] • This should include alternative designs and layouts of the road crossings. It appears that there is an existing crossing within the project. 3. Please provide the Division a copy of your response to October 21, 2015 request from the U.S. Army Corps of Engineers requesting additional information. [15A NCAC 02H .0502(c)] 4. Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2. [15A NCAC 02B .0267(8)(b)(iv)] 5. Please provide building envelopes for all lots with buffers on the site plans to demonstrate these lots are able to be developed without additional impacts. [15A NCAC 02B .0267] 6. Please enumerate all riparian buffer impacts on the site plan and clearly label impacts (Buffer Impact 1, etc.). The Division recommends highlighting by hatching or shading all impacts areas for temporary impact areas and permanent impact areas. Please provide a Jordan Lake Buffer Authorization from the local delegated municipality to document that impacts to the protected riparian buffer are in accordance with the approved local ordinances. [15A NCAC 02B .0267(7)(b)] 8. Please revise Page 8 of the PCN form to indicate that the project is subject to the Jordan Lake Buffer Regulations and requires a Diffuse Flow or other Stormwater Management Plan. Please provide a copy of the locally approved stormwater management plan with proof of approval. [15A NCAC 02H .0506(b)(5) and (c)(5)] 9. Per Condition 13 in GC 3890 "all culverts must be placed below the elevation of the stream bed by one foot for all culverts with a diameter greater than 48 inches and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches." Please revise the plans to meet this Condition or request an exemption from this Condition and provide justification for the exemption request. [15A NCAC 02H .0506(b)(2) and .0502(b)] 10. As indicated under Item C.3.g (Page 13) of the USACE PCN Complete Help File "The stream impact length should be measured along the centerline of the stream. When proposing a culvert, the impact length is generally greater than the length of the culvert and associated dissipater since the existing stream usually has some sinuosity (curvature)." Please verify or correct the stream impact length as indicated on the PCN form. If necessary, please provide updated drawings and application materials (including Table of Impacts in the PCN form) that properly show the length of impacts to the jurisdictional stream. [15A NCAC 02H .0502(b)] 11. Please provide a detail showing the proper installation (below the streambed elevation) of the riprap pad at the culvert outlets. [15A NCAC 02H .0502(b)] 12. Per Condition 6 of GC 3890, all work must be done "in the dry'. Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. In addition, please ensure that the location of the temporary impacts are shown on the construction drawings and clearly indicated in the impact table in the PCN. [15A NCAC 02H .0502(b)(3)] Pursuant to Title 15A NCAC 02H .0502(e) and 15A NCAC 02B .0267, the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
