Thank you for taking the time to review this application. We did not submit the PCN to DWR prior to submittal to the
USACE, though I'm happy to send it there as well. Apologies for the oversight on that.
@Tankard, Robert — is there a preferred method that I can send you the application? The file is <20MB, so I could send
through email if that's simplest.
Regarding the individual WQC, would the trigger be the proposed permanent impacts to buffers along Neuse River
drainages, as outline in criterion i) of the NWP 58 WQC?

I reached out to Robert Tankard and they're not able to find the submittal for this project on their end. I see you checked
that it isn't for the record only for DWR, so did you send them the prefiling meeting request 30 days prior to submitting the
PCN and/or send the PCN through Laserfiche? It appears the project would require an individual 401 WQC, but once
DWR has the project information they will be able to determine if the project would meet the terms/conditions of the
general WQC associated with NWP 58 or if an individual 401 would be required.
As discussed, the Corps will be reviewing this project under NWP 58, not NWP 43.

Good afternoon Robert,
This email is concerning the attached Pre -construction notification (PCN) received by the U.S. Army Corps of Engineers
(USACE) on November 8, 2023. The Corps Action ID Number associated with this project is: SAW-2023-02172 (East Rose
Pump Station Renovation pond expansion and basin restoration / New Bern / Craven).
Please provide a written response within 14 days from the date of this email, regarding the North Carolina Division of
Water Resources (DWR) receipt date for this project, otherwise, we will consider our receipt date as accurate. Also,
within 14 days, please notify me if the certification request does not contain the nine (9) components listed in Section
121.5(b) of the 2020 Clean Water Act Section 401 Certification Rule.
As specified in the September 16, 2022, Programmatic Agreement (PA) between the USACE, Wilmington District, and the
North Carolina Department of Environmental Quality, Division of Water Resources, the reasonable period of time (RPOT)
for DWR to act on a Section 401 certification request is 120 days unless the RPOT is extended per the terms of this PA.
As such, unless we receive an email request for an extension of the RPOT, the USACE will consider the Section 401
certification for this project to be waived on March 8, 2024.
