PROJECT SUMMARY: The applicant proposes to construct a pier extending 542 ft. below NHW with a gazebo, boatlift and floating dock for a total of 2 formalized slips at the established pier -head line along the AIWW in Sunset Beach. 9. NARRATIVE DESCRIPTION: The proposed project is located at 801 Shoreline Dr. W in Sunset Beach, Brunswick County. Existing structures on the 1.39-acre parcel include a single-family residence and a bulkhead. Based on DCM records, General Permit No. 90192 was previously issued for shoreline stabilization. The south facing property is located approximately 10' above normal high water (NHW) and is vegetated with typical coastal -plain tree species and landscaping ornamentals. The property has approximately 80 linear feet of shoreline frontage along the southern edge and is stabilized with natural vegetation. The adjacent riparian parcel to the east is 719 Shoreline Dr. W which has a single-family home and docking facility. The adjacent riparian parcel to the west is a vacant undeveloped parcel. To the north of the applicant's parcel is Shoreline Dr. W. No Section 404-type wetlands appear present within the project area. High marsh, primarily consisting of Black Needlerush (Juncus roemerianus) and Salt Meadow Cordgrass (Spartina patens), extends approximately 10' waterward of high ground and transitions to approximately 350' of Smooth Cordgrass and mud flats (Spartina alterniflora). The width of the waterbody measures approximately 600' from marsh to marsh in the vicinity of the project area. The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROJECT DESCRIPTION: The applicant proposes to construct a pier extending 542 ft. below NHW with a gazebo, boatlift and floating dock for a total of 2 formalized slips at the established pier -head line along the AIWW in Sunset Beach. The proposed 6' x 652' access pier would start on the high ground and extend south across approximately 100' of high marsh. From the NHW line, the access pier would continue south approximately 350' over a stand of Smooth Cord Grass (Spartina alterniflora). From the waterward edge of Coastal Wetlands, the access pier would extend approximately 167' into the AIWW before reaching the proposed 4' x 8' finger pier on the east side of the access pier. A ramp would extend waterward from the platform leading to an 8' x 12' floating dock oriented perpendicular to the shoreline (Slip 2). The access pier would continue south another 10' past the finger pier waterward and would terminate at a 13' x 17' fixed covered gazebo (see Sheets 2 and 3 of 4). To the west of the proposed gazebo, a 13' x 13' open boatlift would be installed jut landward of the established pierhead line (Slip 91). The applicant states that extending the docking facility to the established pierhead line, as adjacent piers have already done, would allow access to navigable water depths throughout the tidal range and minimize soft -bottom Field Investigation Report: Ronald Johnsen DCM Major Permit Page 12 impacts to the Primary Nursery Area (PNA). The property has approximately 80 linear feet of shoreline and the proposed design appears to remain within the applicant's area of riparian access; no waivers would be required for the proposed project and no waivers were obtained by the applicant. The applicant's design extends waterward of the 1/4 width limit but would meet the 1/3 width and would be approximately 20 ft. landward of the USACE Federal Channel Setback (See Sheet 3 of 4). The applicant proposes to extend to the pierhead line established between 709 Shoreline Dr. W (State Permit 922-18) and 811 Shoreline Dr. W (GP# 66385D). Water depths in the vicinity of the proposed floating dock range from -0.6 ft. to 2.0 ft. at NLW. Water depths in the vicinity of the proposed boat lift range from -1.1 ft. to 2.0 ft. at NLW. To reduce impacts to the soft bottom habitat the applicant proposed to install physical stops at 18" above substrate under the proposed floating dock and to also set the boatlift limit switches to stop at 18" above the substrate (see Sheet 4 of 4). As proposed, the docking facility would extend approximately 180' from the edge of Coastal Wetlands to 30% of the waterbody width. 11. ANTICIPATED IMPACTS: The proposed docking facility would result in the shading of approximately 2,700 sq. ft. of Coastal Wetlands and the incorporation of approximately 1,390 sq. ft. of open Estuarine Waters and Public Trust Area. As proposed, the docking facility would be located in an area with water depths ranging from -0.6' NLW to -2.0' NLW within a Primary Nursery Area. The applicant has proposed to set limit switches to 18" above the substrate on the relocated boatlifts and install physical stops at 18" above substrate under the relocated floating dock to reduce soft bottom impacts. The proposal would be past the immediately adjacent pierhead line, but in line with piers along the same shoreline for similar use. The proposed development would be located outside of both adjacent 15' riparian corridor setbacks. The proposed docking facility would be constructed at the established pierhead line which is beyond the 1/4 waterbody width but landward of the 1/3 waterbody width and the USACE Federal Channel Setback allowing for increased water depths within the PNA. Minor increases in turbidity should be expected during piling installation. Existing Land Uses: The applicant's parcel is used for private residential purposes. The adjacent parcel to the east has a single family residential dwelling and a private docking facility. The adjacent parcel to the west is an undeveloped lot. Development Activities Narrative Specifics: The applicant proposes to construct a 2-slip docking facility at the established pierhead line on the AIWW in Sunset Beach. The docking facility will consist of a 5' x 652' fixed pier, 13' x 17' gazebo, 8' x 12' floating dock, 4' x 8' finger pier, and a 13' x 13' open boatlift. The project is located in waters classified SA:HQW by DWR and are designated PNA by DMF. This section of AIWW is closed to the harvest of shellfish. The applicant's parcel has 80 ft. of shoreline and the waterbody width in the vicinity of the project area is approx. 600' from marsh to marsh. Application Narrative: Tidal Creek Permitting has been retained by the property owners, Ronald & Jennifer Johnsen (herein referred to as the "Applicant"), to secure a NC Division of Coastal Management CAMA Major Permit, for a private 2-slip docking facility that is proposed to extend greater than 400 linear feet waterward of the Normal High Water line along the AIWW in Sunset Beach. As proposed, the applicant intends to construct a 5' x 652' fixed pier, originating from the existing bulkhead (GP #90192) and extending south towards the AIWW. The first 110' of the proposed fixed pier would cross over high marsh coastal wetlands including black needlerush, spike grass, and smooth cordgrass. The next 375' of fixed pier would extend from NHW, over low marsh coastal wetlands composed of a dense swath of smooth cordgrass. The remaining 167' of fixed pier would extend over open water and terminate with a proposed 13'x17' gazebo (221 sq ft) at the pierhead line established between 811 Shoreline Dr W (GP #66385) and 709 Shoreline Dr W (Major #22-18). To the west of the proposed gazebo, a 13' x13' open boatlift (Slip # 1) would be installed at the pierhead line with -1.0' NLW at the landward pilings and -2.0' NLW at the waterward pilings. To reduce impacts to the soft bottom habitat, the proposed boatlift would be outfitted with limit switches to stop the boatlift cradle at 18" above the substrate. To the east of the gazebo, a proposed 4'x8' finger pier (32 sq ft) would provide access down to a proposed 8' x 12' floating dock (96 sq ft, Slip #2), oriented perpendicular to the shoreline. Water depths in the vicinity of the proposed floating dock show -1.0' NLW at the landward edge and -2.0' at the waterward edge. To reduce impacts to the soft bottom habitat in this PNA designated area, the applicant has proposed physical stops under the floating dock at 18" above substrate. As proposed, the docking facility would extend approximately 16' waterward of the immediately adjacent pierhead line between 719 and 807 Shoreline Dr W, to reach deeper water at the established pierhead line between 709 and 811 Shoreline Dr W. The waterward end of the proposed docking facility would terminate approximately 20' landward of the 1/3 waterbody width and the USACE Federal Channel Setback. The proposed docking facility would exceed the 1/4 width but not the 1/3 width, extending approximately 180' waterward of the edge of coastal wetlands to 30% of the waterbody (600' total waterbody width). The proposed riparian corridor was previously established through Major Permit #77-18 and follows the deeded parcel lines out to the open water of the AIWW. The proposed docking facility would not encroach into either adjacent 15' riparian setback and no riparian setback waivers were obtained.
