This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611 -7447. Unless such demand is made, this decision shall be final and binding. Please take notice this permit is not transferable. Part H, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. If continuous flow monitoring is not feasible, then the discharger shall record the approximate time that discharge began and ended, along with the instantaneous flow at the time of effluent sampling. *** The discharge shall not cause the turbidity of the receiving water to exceed 50 NTU. If the turbidity exceeds these levels due to natural background conditions, the discharge level cannot cause any increase in the turbidity in the receiving water. A. (1). Such discharges shall be limited and monitored by the permittee as specified below: * ** * Acute Toxicity (Fathead 24 hour) Monitoring, Episodic, See Part III, Condition E. * * * * * Monitoring shall be conducted during the first five discrete discharge events after resumption of operations, and then on an annual basis thereafter, with the annual period beginning January of the next calendar year. The pH shall not be less than 6.0 standard units nor greater, than 9.0 standard units and shall be monitored 2/month at the effluent by grab sample. There shall be no discharge of floating solids or visible foam in other than trace amounts. Part III Permit No. NCO071463 E. ACUTE TOXICITY MONITORING (MONTHLY) The permittee shall conduct five (5) acute toxicity tests using protocols defined as definitive in E.P.A. Document 600/4-85/013 entitled "The Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test, using effluent collected as a single grab sample. Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. Sampling and subsequent testing will occur during the first five (5) discrete discharge events after the effective date of the permit. After monitoring of the first five toxicity tests, the permittee will conduct one test annually, with the annual period beginning in January of the next calendar year. The annual test requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test. Failure to submit suitable test results will constitute noncompliance with monitoring requirements. F. Toxicity Reopener Condition This permit shall be modified, or revoked and reissued to incorporate toxicity limitations and monitoring requirements in the event toxicity testing or other studies conducted on the effluent or receiving stream indicate that detrimental effects may be expected in the receiving stream as a result of this discharge. G. Detection Levels Monitoring of petrochemical constituents and metals should be done using an EPA approved method to a detection level of 1 µg/l. H. Before Initiating Operations Before the facility may be placed back into operation, the permittee must obtain the authorization to P ' s. construct a. treatment system and place it into operation. A Spill Control and Control and Countermeasures Plan and a Stormwater Pollution Prevention Plan must accompany the request for authorization to construct. Additional stormwater and spillage from the loading facility would enter into a surface collection system and flow to this same non existent oil/water separator. Discharge is to storm sewer. f. Other Special Items: This company should consider providing a completely new site approach concerning the oil/water separation discharge and an enhanced design and implementation of a Spill Prevention and Containment Plan (especially the truck filling station area). It appears that additional consideration and some consolidation of these issues (and subsequent modifications to the site such as roof extensions, relocation of spill collection basins and asphalt driveway berms) could further reduce potential stormwater contact with petroleum products. PART IV - EVALUATION AND RECOMMENDATIONS WSRO recommends that since this facility is currently not operational that issuance of the Permit be delayed until the company submits proposed and actual site engineering plans for modifications to the site with regards to the SPCP, RCRA and specifications for the existing treatment works onsite (sized to fit existing and proposed conditions) as well as any potential remediation requirements, if necessary. As this discharge is to a water supply, the DHS may also need to comment on this facility. Phenol, TSS and oil/grease limits may be reasonable. NPDES Permit Staff Report Version 10/92 Page 4 The Groundwater Section should also comment on this permit request. It would be advisable to find out about the current conditions of the tanks on site and what steps have or will be taken to provide proper seals and leak detection for the tanks.
